ISTANBUL METROPOLITAN MUNICIPALITY
The CONSTRUCTION WORK OF USKUDAR-UMRANIYE-CEKMEKOY METRO LINE 1ST PHASE (BETWEEN USKUDAR-IHLAMURKUYU) shall be given out through open tender procedure as per Article 19 of Public Tender Law numbered 4734. Detailed information about the tender is as provided below.

4. The provisions of submission to the tender, the documents required and the criteria for adequacy assessment:
4.1. The provisions of submission to the tender and the documents required:
4.1.1. Certificate of Chamber of Trade and/or Industry, or the Chamber of Profession that the applicant is registered to in accordance with its legislation,
4.1.1.1. In the case of a real person; a document showing their registration to the chamber of trade and/or industry or the craftsmen’s association or the relevant chamber of profession which the person is registered to, obtained within the year of the tender date or the first announcement,
4.1.1.2. In the case of a legal person; a document showing its registration to the Chamber of Trade and/or Industry in accordance with the legislation the legal person is subject to, obtained within the year of the tender date or the first announcement,
4.1.2. Signature Declaration or Signature Circular showing the authority to bid.
4.1.2.1. If the tenderer is a real person; notarized signature declaration.
4.1.2.2. If a legal person; Trade Registry Gazette showing the current status as well as the partners, members or founders and the personnel of this legal person, in case all these information is not comprised in a single Trade Registry Gazette; relevant Trade Registry Gazettes or the documents showing all these information as well as the notarized signature circular of the legal person,
4.1.3. Letter of Proposal, the structure and content of which is defined in the Administrative Specifications.
4.1.4. The bid bond; the structure and content of which is defined in the Administrative Specifications.
4.1.5 The Tenderers shall submit the list of the works they plan to have done by subcontractors in the enclosure of their proposals.
4.1.6 In the case where the document submitted by the legal person to show its work experience belongs to a partner who has more than half of that legal person’s shares; a document which is issued by trade registry offices or a sworn-in public accountant under a chamber of trade and industry/trade or independent financial accountant after the first announcement and which shows that this provision has been preserved continuously for one year backwards from the document’s issue date.
4.2. Documents governing economic and financial adequacy and the criteria applying to these documents:
4.2.1 Documents to be obtained from Banks:
Bank reference letter indicating unrestricted deposits or unused cash or non-cash credit in the bank in an amount to be determined by the tenderer on condition that such amount is no less than 10% of the amount offered by the tenderer,
These criteria can also be met by adding deposit and credit amounts or submitting several bank reference letters.
4.2.2. Balance sheet and equivalent documents:
The documents below shall belong to the year preceding the tender’s year:
a) The parts of year-end balance sheet and the balance sheet which are deemed necessary,
b) Equivalents of the documents specified in clause (a),
It is adequate to submit one of the documents specified in clauses a and b.
The adequacy criteria for the tenderer are as follows;
a) The current ratio (current assets/short term debts) needs to be at least 0.50;
b) Equity ratio (equity/total assets) needs to be at least 0.10;
c) The proportion of short term bank debts to the equity needs to be less than 0.75;
All these three criteria are expected to be met at the same time.
Tenderers who can not fulfill these criteria for the previous year can also present their documents for the past three years. In this case, whether the average of those three years fulfills the adequacy criteria shall be taken into account.
4.2.3. Documents indicating the business volume:
a) Income statements indicating the total turnover for each year of the three-year period before the year when the tender takes place,
b) Receipts issued in the last three years indicating the monetary amount of the finalized construction works or the completed portions of construction works which are being carried out under pledge,
It is adequate to submit any one of these two document pertaining to the last three years.
1/3 of the total sum for these years which these documents are submitted for should not be less than 15% of the amount offered for the turnover; monetary amount of the finalized construction works or the completed portions of construction works which are being carried out under pledge should not be less than 12% of the offered amount. The tenderer who meet any of these criteria and document it shall be considered adequate.
The tenderers who cannot fulfill these criteria for the last three years can submit the documents about the last six years; in this case, whether the average of those years is able to fulfill the criteria shall be taken into account.
4.3. Documents indicating Professional and Technical Adequacy and the criteria applying to these documents:
4.3.1. Documents on work experience:
Documents indicating work experience pertaining to the works that were pledged in the last fifteen years within the scope of a contract which included remuneration, or similar other works, and whose amounts are not less than 60% of the offered amount,
4.3.2. Documents on Organizational Structure and Personnel Status:
a) Key Technical Personnel:
In order to be able to carry out the works within the tender’s scope, the Tenderer is required to have the Key Technical Personnel who possess the qualities below. It is obligatory that the specified personnel are hired before the tender date and they should be working with the tenderer as of the tender date. Work experience in the private sector is certified by the document indicating the duration of registration to the relevant chamber of profession; experience in the public sector is certified by statement of services and/or registration document to the chamber of profession; the personnel’s employment with the tenderer is certified by the documents which are verified by the social security institution and which indicate that insurance premiums for the relevant personnel are paid and that they are employed.
Documents indicating that they are employed by the tenderer are not required for real person tenderers who possess these qualities as well as partners of private companies; partners who act as directors in limited companies; partners who are board chairmen, board members, executive directors and general directors who possess these qualities.
In business partnerships, the entirety of the key technical personnel of the pilot and other partners shall be taken into consideration regardless of the percentage of shares.
The persons indicated as key technical personnel can not also be employed as technical personnel in the works which are within the tender’s scope.

4.4.2. Engineering or architecture departments to be considered equivalent to similar works:
Diplomas of Civil Engineering and Geological Engineering shall be regarded as work experience document.
5. The most economically-advantageous offer shall be determined solely on the price basis.
6. The tender is open to all domestic and foreign tenderers. There shall be no price advantage for domestic tenderers.
7. Perusing and purchasing of the tender document:
7.1. The tender document can be seen in the administration’s address and can be purchased from Istanbul Buyuksehir Belediyesi Ek Hizmet Binasi, Rayli Sistem Mudurlugu (Istanbul Metropolitan Municipality’s Supplementary Service Building, Directorate of Railway Systems) M. 7.2. It is obligatory to purchase the tender document for those who will make a proposal.
8. Proposals can either be submitted to Istanbul Buyuksehir Belediyesi Ihale Isleri Mudurlugu (Istanbul Metropolitan Municipality Directorate of Tender Affairs) M. Nezihi Ozmen Mahallesi Kasim Sk. No.62 34010 Merter, Gungoren-Istanbul or can be sent to this address by certified mail.
9. Tenderers shall submit their proposals as proposed unit price on basis of the total amount which will be calculated by multiplying the amounts of each work item by unit prices offered for these work items. At the end of the tender, a unit price contract shall be signed with the tenderer who is awarded the bid.
In this tender, proposals shall be submitted for the entirety of the work.
10. On condition that it is not less than 3% of the price they offer, the Tenderers shall give a bid bond in the amount that they determine.
11. Validity period for submitted proposals is 180 (one-hundred-and-eighty) calendar days beginning from the tender date.
