Notice Concerning Regulating the Implementation of the Agreement for Ship Pollution Response Administration Regime Within Yingkou Port
For the purpose of security the implementation of the agreement for ship pollution response regime in Yingkou Port, based on the Regulations of the People’s Republic of China on the Emergency Prevention and Handling of Marine Pollution Caused by Vessels, the Regulations of the PRC on the Prevention and Control of Pollution Caused by Vessels and Their Relevant Operations and provisions as provided for in the their supporting regulations, combining with actual condition in Yingkou, it is hereby notified the administration on Agreement for Ship Pollution Response in Yingkou Jurisdiction as follows:
1. As of January 1, 2012, ships shall conclude ASPRs in accordance with relevant provisions. Where a ship, due to certain reason(s), can not conclude the ASPR before its first entry into a port under Yingkou jurisdiction or before commencement of operations, such ship shall explain such reason(s) to Yingkou MSA, and Yingkou MSA may pre-permit such ship to enter into the port or to commence the operation, however, such ship shall conclude the ASPR before leaving the port. From March 1, 2012 on, Yingkou MSA shall base on relevant provisions to strictly treat those ships failing to conclude ASPRs as required.
2. At present, China Yingcou Port Tanker Cleaning Co., Ltd of Level Two is the only OSRO in Yingkou Port. The contact way is as follows:

3. Since no level-1 OSRO has been established in Yingkou Port, based on the relevant requirements of MOT and China MSA, the cooperation mechanism shall be established between the Level-1 OSROs under the jurisdiction of Liaoning and China Yingcou Port Tanker Cleaning Co., Ltd to take the temporary substituted measures. Ships that shall conclude ASPRs with level-1 OSROs shall contact with China Yingcou Port Tanker Cleaning Co., Ltd regarding signing off the Level-1 ASPRs.
4. Ships that shall conclude ASPRs with OSROs include the ships carrying poisonous hazardous liquid cargoes in bulk and other ships above 10,000GT, as well as the ships supplying fuel in the jurisdictional area.
5. China Yingcou Port Tanker Cleaning Co., Ltd shall timely submit such concluded ASPR to the second supervision department of Yingkou MSA for filing, and the same department shall notify the filings to control center and other local MSA. Where the OSRO has submitted the concluded ASPRs for filing, the control center and local MSA may exempt such ship from being inspected of the ASPR when handling the formality for ship’s entering into or leaving from the port or handling approval formality for operation.
