Traffic Calming Device

Guidelines Procedures

In response to Session Law 2009-310 House Bill 182, the North Carolina Department of Transportation(NCDOT)hascreated theDivision10NeighborhoodTrafficManagement GuidelinesforuseonstatemaintainedsubdivisionroadsinCabarrus, Stanly, Mecklenburg, Anson, and Union Counties. Theguidelinessetforththeprocesstobefollowedwhenaneighborhoodassociationdesiresto havea traffic calming device(TCD) installed in their subdivision.

SessionLaw2009‐310HouseBill182prescribes thefollowing:

1) Atraffic engineering studymustbeapprovedbythedepartment.

2) The installationofthedevicesmustbe withinoneofthefollowingareas:

a. Asubdivisionwithahome ownersassociation;or

b. Aneighborhoodinwhichthepropertyownershaveestablishedacontractual agreementoutliningresponsibilityforthetrafficcalmingdeviceinstalledinthe neighborhood.

3) ThetrafficcalmingdevicesarepaidforandmaintainedbythesubdivisionHOA,its

successor, or theneighborhoodagreement.

4) TheHOAhaswrittensupportfromatleast 60percentofmemberpropertyowners, or theneighborhoodagreementissignedbyatleast60percentofthepropertyowners.

5) TheHOAortheneighborhoodagreementpostaperformancebondsufficientforthe maintenanceandremovalofthetrafficcalmingdevice(s).Thebondshallremainin effectfor aperiodofthreeyears fromthedateofinstallation.

Ataminimumalloftherequirements,asprescribedintheSessionLaw2009‐310HouseBill

182,shallbemetinorderforatrafficcalmingdevice tobeinstalledonastatemaintained roadway.ThefollowingistheprocesstobefollowedbyanHOA whendesiringtohave TCD’s installed in their subdivision.

1)TheNCDOTDistrictofficemustbecontactednotifyingthedepartment thattheHOAis requesting theplacement of TCD’son a statemaintainedroadway.

2)Once the department has determined that the roadway(s) is(are) eligible for TCD installation,theHOAmustthenproceed withobtainingaTrafficStudysealedbya professionalengineer. TheTrafficStudymustbesubmittedtotheDistrictOfficefor reviewandapproval and must include thefollowing.

  1. Acompletedescription of thestudyareawith applicable maps,photos and list of propertyowners.
  2. Athoroughdescription of theproblemthat theneighborhood desirestoremedy. Thisshould includefielddata collectedtoshow themagnitudeof theproblem. (i.e.volume and speeddata). A speeding issue is defined as the average speed exceeding the posted speed by 5 mph or more or the 85th percentile speed exceeding the posted speed by 10 mph or more.
  3. The NCDOT will accept a variety of different options for traffic calming devices. Knowing that the most commonly wanted TCD is a speed table a standard drawing for this device has been developed.(SeeAttachedTraffic/SpeedTableDrawings)
  4. The locations wheretheneighborhood requeststoinstall thetraffic calming devicesas well as any additional signs,pavementmarkings.
  5. Adetailedcost ofthetraffic calming device,theexpectedroutine maintenance requirementsand an estimateof thecost toremovethedevices.

3)Once approval of the Traffic Study is given by the District Office, the HOA must then requestandreceivewrittenapprovalof60percentormoreofthememberproperty owners.

4)Oncethe60percentmemberpropertyownerapprovalhasbeenreached,theHOA mustthenpostaperformance bondintheamountequalto100%oftheconstruction costofthetrafficcalmingdevices.Thisbondmustremain ineffect foraperiodofthree yearsfromthedateof installation.

5)An encroachment agreement between the NCDOT and the HOA must then be

completedinorderfortheHOAtobegininstallationofthe TCD’s.TheTrafficStudyinits entirety mustbeattachedtotheencroachmentagreement.

6)TheHOAand/orcontractormustcontacttheDistrictOfficeaminimumof 48hoursprior tothestartof theTCD installation.

EligibleRoadways

Statemaintainedroadwayswhoseprimarypurposeistoprovideaccesstoresidentswillbe consideredas theonly eligible roadwaysfor theinstallation of TCD’s.
