Breeding Quality Health Tested Border Collies for Companionship and Show/Performance Venues

Congratulations on your new Border Collie puppy!

I hope that your new puppy brings you years of companionship, joy and love.

With this in mind and my wish for your puppy to be deserving of the best for its life, I only sell to homes which agree to the following terms and conditions.

The above named and described Border Collie shall hereafter be known as dog.

The buyer agrees to the following:

The buyer is aware of the needs and care of taking care of the physical and mental needs of a border collie puppy.
If the dog cannot be kept for any reason, at any time in its life that I am contacted and given the opportunity to take the dog back for rehoming, and any costs associated with the return of the dog will be paid for by the buyer. Under no circumstances is the dog to be placed in a pet shop, animal shelter, or similar establishment, and under no circumstances is this dog to be used in dog fighting, or similar activities.
The puppy must be housed and kept in a safe environment during its entire life and never tied, chained or tethered for long periods of time. The buyer agrees to never strike, whip or beat the said puppy, and to never leave it outside without adequate and appropriate shelter for the weather conditions.
The dog must receive all required vaccinations, periodic worming, constant flea and tick treatment and any other preventative medicine regimes recommended by a licensed veterinarian, and cannot be euthanized unless it is recommended by a licensed veterinary surgeon to ease pain and suffering.
The breeder must be advised of any major health conditions that may arise over the lifetime of the dog.
The buyer agrees to enroll the puppy in a puppy pre-school course as well as a basic manners training course, with a professional dog trainer or dog club.
The buyer understands that the dog is sold on limited register, and that it may not be used under any circumstances for breeding and the buyer understands that if the dog is to be bred, the puppies will not be eligible for registration with the Australian National Kennel Council, and will not be deemed purebred.
The buyer will spay/neuter the dog after 6 months of age, but before 12 months of age, as recommended by a licensed veterinarian and will provide the seller with proof of desexing.
The buyer agrees with the seller that within 72 hours of the purchase of the dog the buyer will take the dog to a veterinary surgeon to confirm that the dog is in good health and without defect. In the event the buyer does not take the dog within 72 hours to a veterinary surgeon, then it will be assumed there is no defect in the dog and it is in good health at time of purchase. The seller does not assume any liability for any injury to the dog during or after delivery and will not be held responsible for any expenses incurred by the buyer for any reason, and at no time will the Breeder refund the purchase price except as stated in this contract.
The buyer agrees this dog is not sold for export purposes. Should it be exported without knowledge and/or agreement of the seller (in writing) DogsWest will not issue export documentation for the dog.
The buyer agrees to send, at minimum, one photo and update per year for the lifetime of the dog to the seller, and to update the seller if there Is a change in address, email, or contact number.
The buyer agrees that if any terms agreed to on this contract are broken, the seller has a right to relinquish the dog from the buyer, and all registration paperwork will be signed over to the seller.

The seller agrees to the following:

The seller is a registered breeder with the Australian National Kennel Club in good standing, and the requirements of DogsWest Code of Practice for the keeping, welfare, breeding and disposal of dogs has been implemented.
All puppies come with ANKC limited registration pedigree papers, which are pedigree papers for companion animals not to be used for breeding under any circumstances.
The seller warrants the dog has been inspected by a licensed veterinarian and declared to be healthy at time of sale. A copy of the vaccination certificated and microchip identification will be provided to the buyer.
The seller has ensured that the puppy is up to date with all worming medications, and has been wormed at 2,4,6, and 8 weeks of age, as recommended by a licensed veterinarian.
The parents of the puppy have been DNA tested for Collie Eye Anomoly, Neuronal CeroidLipofuscinosis or Trapped NeutrophilSyndrome, and are guaranteed to be unaffected by these aforementioned genetic diseases. A purchase price refund will be given if the dog has been found to have CEA, CL, or TNS.
The parents of the puppy have also been hip and elbow scored with acceptable results and no sign of degenerative joint disease. The buyer understands that hip dysplasia is a multi-faceted disease in which genetics, and environment play a role and agrees to keep the dog at an appropriate body condition score deemed by a licensed veterinarian and discourage strenuous repetitive activities such as fence running, excessive retrieving, jumping into/out of high vehicles or agility obstacles prior to 18 months of age.

The Breeder neither makes nor implies any warranties or guarantees, expressed or implied, other than those written in the agreement including, without limitation, the warranties of merchantability and fitness.

Both parties agree that this contract is being entered into and is to be performed in the state of Western Australia. Any and all disputes will be settled in the state of Western Australia. The “loosing” party agrees to incur all legal court, lawyer, and defense costs in full.

If any portion of this contract should be determined to be unenforceable in a court of law that portion shall be severed and the remainder of this contract shall remain binding.

THIS CONTRACT IS LEGAL AND BINDING
