The Producer intends (but is not obliged) to produce the Program. The Producer has asked you to participate in the Program for good and valuable consideration including the Fee(the receipt of which you hereby acknowledge) and you have agreed:
1.to participate in, appear in, perform in and be interviewed, filmed and recorded for the Program and agreed that the Producer can make recordings, films, transcripts, photographs and other records that include you, your image, your likeness and/or voice (Materials);
2.that the Producer will own the Program and Materials and you hereby assign all right, title and interest (including current and future copyright) in and to the Program and Materials to the Producer, throughout the world, in perpetuity, for use (in whole or in part) in any and all formats and media whether now known or later devised;
3.that you are not entitled to any remuneration, royalties, compensation or payment of any kind or any expenses, except for the Fee;
4.that the Program and Materials may be materially altered and edited at the Producer’s sole discretion and the Producer may delete material and change the sequence of any events, actions, questions and/or answers;
5.that you irrevocably consent to the Producer doing or omitting to do any act in respect of the Materials and/or the Program which might otherwise infringe your moral rights or performance rights and to use the Materials and/or the Program in connection with any other material;
6.that you will keep confidential and will not, at any time, disclose to any third party the terms of this Performer Release Form or any information regarding the Program except as authorised by the Producer in writing or as required by law;
7.that the Producer may use your name, likeness, biographical material and appearance in the Program and the Materials to promote the Program and any ancillary materials made in connection with the Program [including merchandise];
8.that the information you provide for the Program and Materials will not be defamatory of any person or entity, breach any confidence or rights of privacy, infringe copyright or infringe any other rights of third parties or breach any laws;
9.to release and indemnify the Producer from any claim by you or anyone on your behalf arising out of the Program and/or the Materials and their use and exploitation, including defamation, breach of any confidence or rights or privacy, and use of personal and sensitive information as defined under the Privacy Act 1988 (Cth);
10.that your participation and performance are voluntary and that you do not have any other obligations which prevent you from complying with your obligations in this Performer Release Form;
11.to waive any right to seek or obtain injunctive relief to prevent or restrict the Producer’s (or the Producer’s assignees or licensees) use and exploitation of the Program and/or Materials;
12.that you understand that the Producer may assign its rights or novate its obligations under this Performer Release Form to any third party;
13.that this Performer Release Form contains the entire agreement between the Producer and you relating to the Program with the sole exception of the Deed of Release, Indemnity and Personal Risk document you may have signed with the Producer in connection with the Program on or about the date of this Performer Release Form;
14.that the provisions of this Performer Release Form are severable to the extent they are invalid or unenforceable and the remainder of the document will remain in full force and effect; and
15.that this Performer Release Form will be governed by the laws of New South Wales and that you agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.

(a)warrant that I have full and complete authority to execute this Performer Release Form as a binding and enforceable document for and on behalf of my son, daughter or person of whom I am guardian;
(b)agree to indemnify the Producer, its officers, employees, agents and contractors against any claim, liability, loss or damage arising out of or in connection with the participation, performance or appearance in the Program by the minor on whose behalf I am signing this document; and
