CHANGE* in No Pass No Drive

Beginning August 1, 2007, any sixteen (16) or seventeen (17) year old applying for a drivers license permit (Instruction Permit) will be required to have a completed school Compliance Verification Form. THE FORM VERIFIES that the student is compliant with the components of the No Pass No Drive statue that was passed by the state LEGISLATURE of Kentucky.

If the student is not COMPLIANT, a form will not be issued. If a sixteen (16) or seventeen (17) year old student (with a driver's permit or license) accumulates nine (9) or more unexcused absences, the school will report the student as noncompliant. Absences due to suspension shall be unexcused absences. Additionally, if a sixteen (16) or seventeen (17) year old driver drops out of school, a report of noncompliance will be made via the web portal.

A student shall be deemed academically deficient when he or she has not received passing grades in at least four (4) courses, or the equivalent of four (4) courses. Reports of noncompliance based on academic deficiency will be made via the web portal beginning with grades from the fall 2007 semester OR FIRST TRIMESTER. The "No Pass, No Drive" law specifics that a student "shall" pass four (4) courses (or the equivalent of four (4) courses per semester; 4/6 = 66%). AS OF NOW, PASSING AT LEAST FOUR CLASSES ARE REQUIRED FOR OUR HIGH SCHOOLS.

Compliance Verification Form Instructions

  1. Compliance Verification Form – Beginning August 1, 2007, before a student can receive a learning permit he/she must obtain a school Compliance Verification Form from their high school. Attached is a copy of the form for you to duplicate.
  2. The form must be signed by the legal parent/guardian consenting to release their child’s information to the Department of Transportation and that they understand that the form must be completed by their student’s high school verifying that they are in compliance with the No Pass/No Drive Statue.
  3. The form must be return to the school to be verified. You can not verify the form unless it is signed by the legal parent/guardian. A school representative must verify the student’s information, sign the form and affix the school seal to the form. If the student is not in compliance the form will NOT be completed by the school.
  4. The school will need to make a copy of the form (after it has been signed and affixed with the seal) for their files. The original is to be given back to the student who will take it to the Circuit Clerk’s Office. The student must also provide a copy of their birth certificate, signed social card and a legal parent/guardian must be present.
