Sub: Annual Maintenance Contract (AMC) of Networking equipments comprising of Cisco Routers, Cisco RAS’s and Cisco LAN switches installed at 45 Type “A1”, “A2” and “B” locations of NIB-1 network of BSNL
Reference:
1. Notice Inviting Tender (NIT) vide BSNL/DNW/AMC-NIB-1/2007/9 October 12, 2007 for sealed price quotations for AMC of Networking Equipments at 45 Locations of NIB-1 Network.
2. Price quotation submitted on 19-Oct-2007 submitted by M/s TCS
3. Subsequent Letter no. NIL dated 24-10-2007 by M/s TCS for unconditional compliance to terms and conditions of AMC
Your kind attention is invited to above referenced NIT of BSNL and price quotation for Annual Maintenance Contract (AMC) of Networking Equipments comprising of Cisco Routers, Cisco RAS’s and Cisco LAN switches installed at 45 type “A1”, “A2” and “B” locations of NIB-1 Network of BSNL, the approval of the competent authority is hereby conveyed for AMC for a period of 3 years. AMC agreement shall be effective from 1-Nov-2007. An agreement to this effect with terms and conditions mentioned in the Annexure-A of NIT (at reference ‘1’ above) will be submitted on Non-Judicial Stamp Paper of value Rs 100/- before 15-11-2007.
The following needs to be noted and necessary action shall be taken accordingly.
1 / Scope of Work & Contract Period / Annual Maintenance Contract (AMC) of Networking Equipments comprising of Cisco Routers, Cisco RAS’s and Cisco LAN switches installed at 45 type “A1”, “A2” and “B” locations of NIB-1 Network of BSNL for three years. The AMC agreement shall be effective from 1-Nov-2007 (The detailed terms and conditions are attached in annexure-A of referenced NIT at ‘1’).BSNL reserves the right to extend the duration of AMC for further two years, extendible in terms of one year at a time. BSNL also reserves the right to terminate this agreement at any time, by giving an advance notice of three month.
2 / Price Details / Annual Price of AMC shall be Rs 1,28,86,071(Rupees One Crore Twenty Eight Lakhs Eighty Six Thousand and Seventy One only).
The price is inclusive of all taxes except, service tax. The service tax as applicable shall be payable by BSNL
3 / Payment Terms and Condition / AMC Charges shall be paid by BSNL on quarterly basis, after the expiry of quarter, subject to deduction of penalties (mentioned in clause 17 of Annexure-A of referenced letter ‘1’), statutory taxes etc for previous quarter.
M/s TCS shall submit quarterly report:- “No Fault Pending Reports” from BSNL Node Incharges”, “Fault Details/Fault Response Details for quarter” and “Quarterly PM Report” at the end of each quarter.
4 / Paying Authority / Paying authority for quarterly AMC charges shall be Chief Accounts Officer, O/o, CGM, Data Networks, Lobby No. 1, 4th Floor, Mahanagar Doorsanchar Sadan, 9, CGO Complex, Lodhi Road, New Delhi-110 003.
5 / Performance Bank Guarantee / M/s TCS shall submit Performance Bank Guarantee (PBG) of Rs 6,44,304/- (Rupees Six Lakhs Forty Four Thousand Three Hundred and Four only ) valid for three and half year w.e.f. 1-Nov-2007, to CAO, Data Networks, New Delhi latest by 15-Nov-2007.
PBG shall be issued by a scheduled bank (located in Delhi), in favour of CGM, Data Networks, BSNL, New Delhi and in the format attached at Annexure-9 of Annexure-A of referenced NIT at ‘1’.
In case BSNL extends the AMC beyond three years, PBG validity shall have to be extended accordingly.
6 / Non-Disclosure Agreement / M/s TCS shall submit the signed Non-Disclosure Agreement as per Annexure-8 of Annexure-A of referenced NIT at ‘1’, latest by 15-Nov-2007.
