Sub: Uncalled for change being made by BSNL in the By-laws of RWA approved by BSNL Management Committee - Reg.
Sir,
As you are kindly aware, following formation of BSNL w.e.f. 1.10.2000, By-laws for RWAs of BSNL of BSNL Colonies were approved by BSNL Management Committee in line with the arrangements/provisions made by DOP& T. A copy of the approved By-laws issued by the BSNL is enclosed herewith. A perusal of the By-laws will indicate the following.
(i) Only BSNL employees who are the allottees of BSNL accommodation/quarters will be the regular members of the BSNL Employees Residential Association and accordingly, they will be the office bearers of the Association.
(ii) Membership of RWA shall not be open to Employees of other PSUs, including MTNL, Created under any specific Act of Parliament.
2. However, it has come to our notice that at the instance of MTNL Employees, Shri Ajay Makan, Hon'ble Minister has written to Hon'ble MOC to make modification in BSNL By-laws of the BSNL Employees Residential Welfare Association so that they can also become regular members and the office bearers of the Association.
3. In this connection, it is relevant to mention that the issue of making a combined RWA consisting of allottees of BSNL, MTNL and Postal Department was considered earlier at the level of Hon'ble MOC &IT and it was decided that the old arrangement of P& T Welfare Association will get terminated w.e.f. 31.3.2007, in view of BSNL Management Committee's decision to restrict the Constitution of Management Committee of RWA only to the allottees of BSNL vide D.O. Letter No. 25-10/2006-BSNL(WL) dated 24.8.2007 written by Hon'ble MOC&IT to Shri Ajay Makan, Hon'ble Minister. Also a similar reply was issued to Shri Akhilesh Das, Hon'ble Minister of State for Steel vide D.O. No. 37-4/2007-BSNL (WL) dated 16.7.2007. Subsequently, position was also accordingly intimated to Hon'ble MOSC&IT by BSNL on 6.10.2007 on file.

4. In addition to above, it is stated that RWA is invariably constituted by the allottees of one organization as per the By-laws framed by it. Accordingly, BSNL RWA's By-laws have been framed by the BSNL in line with DOP& T guidelines. MTNL and Department of Posts have their own By-laws, and accordingly, MTNL RWA or Postal Colony RWA should be constituted by their own employees only as per their own By-laws.
5. Moreover, election to the Management Committees of all the RWA of BSNL Colonies has already been held as per BSNL By-laws, barring Kalibari Colony, and accordingly, it will not be appropriate to mix up MTNL/Postal employees with BSNL for the purpose of constituting Management Committee of RWA now as they have already been accommodated as Associate Member in the By-laws of BSNL RWA's. You are, therefore, requested to kindly stop the modification BSNL By-laws of RWA allowing the present arrangement to continue.
