A. Approval for implementation of revised Level 1 Curriculum created by the Curriculum Review Committee (CRC) (tab 3)
a. Legal has reviewed the Level 1 Curriculum and recommends no changes.
b. Discussion and vote to make it the mandatory Curriculum for Level 1 training.
c. Set an implantation date.
B. Approval of Level 2 and Level 3 curriculums for to go for legal review.
a. Make NM DPs new course of fire with extended times the standard for firearms qualification (tab 4)
C. Approval of the Open Meetings Resolution (tab 5)
V. New Business
A. Ratification of Security Guard Instructor approvals. (tab 6)
a. Instructor Approvals IN00116 thru IN0137 (having been vetted by the PI Board staff.)
B. PI Employee levels and fees: discussion and approval to move forward.
C. Public request for discussion of following items;
1. Make a motion for the board to petition the Governor toreturn $250,000 to bring the board into the black and give it $150,000 of operating funds. The board budget is in debt for 100,000. Currently this law is in a status of an unfunded mandate.
2. Address repeated violations of the Uniform Licensing Act and Private Investigators, Act by the Regulation and Licensing Department. See unanswered complaint.
a. A lack of respecting and following a transparent public process.
b. Ignoring precedence and law requirements of the security guard training program.
c. Ignoring conflict of interest complaints sent to the Superintendant, and the boards and Commissions Director.
d. Disturbing response from Secretary of State that ethical conduct is not required of Advisory Board Members.
Advisory Board members are not liable under the Governmental Conduct Act., creates a danger to the public.
3. Adopt the reinstitution of the Private Patrol Operator and Private Patrol Operator Manager Exam. A specific exam used to meet the jurisprudence exam requirement in the law specifically designed for that category of licensee. Form a five person committee to develop and biannually review the exam and a study guide to meet the requirements of the law. Other New Mexico Law that is relevant may be included to ensure applicant competency and protect the industry and public. Cross check the precedent for a broader exam scope with other state licensing professions.
4. Adopt a rule defining the handgun renewal. How much classroom time and shooting requirements. Consequences and process for failure to renew. Documentation ,etc.
a. A specific expiration time that meets the Annual Time requirement stated in the law. May not carry after annual expiration.
b. Recommend mandatory handgun recert within the month of the previous qualification. Or redo 16 hour program as a consequence of failure to recertify inside the time frame
c. Discussion on having documentation indicating recert verses initial course.
d. Discussion on adopting a written test.
5. Adopt a rule for level two renewal training required annually. Intermediate weapon training is customarily done annually, at least in most national level training systems.
In keeping with the findings of the Department of Justice Study on police training, the same weakness is found in the security licensing training program. There is also a concern in taking short cuts in the content of training courses creating a danger to officers and public.
6. The bureau accept background checks provided by the PPO of new security guards to speed hiring and being placed on duty. With a reduction in the licensing fee. Private sector checks are now know to have more accurate information than the Federal Background Check.
7. Adopt a annual public review of PI Bureau Documents and administrative processes by the public. Currently, there is entirely too much duplication and volume of documentation. Arizona accomplished with a single form the same administrative tasks that take the bureau twenty separate documents to license a Level Three officer.
