COMPANY X TRAINING MANUAL

1.0 Scope:

This Training Manual covers the Mandatory training as required by Federal Highway Regulations, ISO-9002 and the Company X Quality Manual.

2.0 Purpose:

To provide employees of the Company X LTD. with the necessary information to better perform their job and to ensure customer satisfaction.

4.0 Training Sections

4.1 Qualification of Drivers

4.1.1 QUALIFICATION OF DRIVERS Sec. 391.11.

A person shall not drive a motor vehicle unless he is qualified to drive a motor vehicle. A motor carrier shall not require or permit a person to drive a motor vehicle unless that person is qualified to drive a motor vehicle

4.1.1.1. A person is qualified to drive a motor vehicle if he or she:

4.1.1.2 Is at least 23 years old, (or as specified in the current insurance company) and;

4.1.1.3 Can read, write and speak the English language to respond and converse with the general public, understand highway signs and signals in the English language, to respond to official inquiries and make entries on reports and records, and

4.1.1.4 Can by reason of experience, training or both, determine whether the cargo he transports has been properly located, distributed and secured in the motor vehicle he drives, and

4.1.1.5 Is physically qualified to drive a motor vehicle and has passed a Physical examination within passed 2 years, and

4.1.1.6 Has been issued a currently valid Motor Commercial Drivers License (CDL) and has only (1) valid license, and

4.1.1.7 Has prepared and furnished the motor carrier that employs him with list of violations received within the past 3 years, and

A. Must have less that six (6) points on record in the past three years.

B. Cannot have over 4 violations in the past two years.

4.1.1.8 Has successfully completed a drivers road test and has been issued certificate of road test, and

4.1.1.9 If appropriate has taken a written examination and has been issued a certificate of written examination, and

4.1.1.10 Has completed and furnished the motor carrier with an application of employment.

4.1.2 SAFETY REGULATIONS

The following is included in the Safety Rules and Regulations Manual of the Department of Transportation:

Violations of any of the following rules are subject to discipline, up to and including dismissal.

4.1.2.1. All drivers must comply with the Department of Transportation safety regulations FMSCR 382, 383, 387, 390-397, 399 & 40.

4.1.2.2. Three (3) avoidable accidents in any twelve-month period will result in the driver being dismissed. However, one (1) avoidable accident, depending on circumstances and severity, could result in dismissal. An avoidable accident is any accident in which the driver is at fault.

4.1.2.3. Drivers are not allowed to exceed the state speed limit at anytime and are required to abide by the posted speed limits in states, counties1 cities, towns and school speed zones.

4.1.2.4. Drivers are not allowed to drive a vehicle for the Company after a serious illness or injury until released by the doctor and authorized to drive by the Safety Department.

4.1.2.5. No driver will be allowed to operate a vehicle for the Company with a patched eye, broken arm, broken foot or broken leg or with any portion of his body in a brace or cast, and must meet ICC and PUCO physical requirements (unless waived by DOT).

4.1.2.6. Drivers are not allowed to carry hitchhikers or any unauthorized personnel in a Company vehicle at any time. (Unless they have written permission).

4.1.2.7. Seat belts must be worn at all times when traveling in Company equipment.

4.1.2.8. All drivers must meet Department of Transportation physical requirements and any additional physical requirements as set by the Company. Drivers must have a physical examination every two years.

4.1.3 ACCIDENT RULES

Drivers of vehicles operated for the Company involved in an accident must do the following immediately:

4.1.3.1 Protect the accident scene to prevent another accident. This means warning other traffic by placement of fuses, reflectors, flags or other warning devices.

4.1.3.2 Assist the injured.

4.1.3.3 Report the accident immediately by telephone to the Dispatcher at XXXXXXXX

4.1.3.4 Get name, Address, license number and make of vehicle of all parties involved and particularly witnesses. (Forms are provided by the insurance company and placed in each truck).

4.1.3.5 Be courteous but give only your name and address and Company name and address to the other parties involved.

4.1.3.6 DO NOT ADMIT LIABILITY TO ANYONE. DO NOT GIVE A STATEMENT TO ANYONE OTHER THAN A POLICE OFFICER, MEMBER OF THE SAFETY DEPARTMENT, REPRESENTATIVE OF COMPANY X OR COMPANY X ’S INSURANCE COMPANY.

4.1.3.7 Take reasonable precaution to protect the unit and cargo from further damage or theft.

4.1.3.8 Make a detailed report upon arriving at destination or home terminal.

4.1.3.9 In the event of a breakdown or accident, flares, reflectors, or fuses must be set out immediately and the driver should assist traffic around disabled vehicle.

A. On all roads except divided or one way, three (3) red reflectors must be placed as follows: One beside the disabled vehicle not less than 10 feet to the front or rear of the vehicle, one, 100 feet to the rear of the vehicle, and one, 100 feet in front of the vehicle. If the vehicle is on the traveled portion of the road these reflectors must be placed in the same lane as the vehicle. If it is off the traveled portion of the road, they should be placed on the shoulder next to the road.

B. On divided or one way roads the three (3) reflectors must be set as follows: One, beside the vehicle not less than 10 feet to the front or rear of the vehicle; one, 100 feet to the rear of the vehicle and one, 200 feet from the rear of the vehicle. If the vehicle is on the traveled portion of the road, these reflectors must be placed in the same lane as the vehicle. If it is off the traveled portion of the road, they should be placed on the shoulder next to the road.

4.1.3.10 DRIVERS MOVING VIOLATION POLICY:

4.1.3.10.1 Any violation (other than parking) in any state whether in a commercial vehicle must be reported to your dispatcher within 5 days. Failure to report a violation could result in immediate termination.

4.1.3.10.2 Disciplinary action for moving violations received within a one year period:

A. Two (2) violations carry no points ------Warning

B. Two (2) violations carry 2 to 4 points - - - -5 days suspension & warning.

C. Three violations of any nature ------Termination (Unless special driver training class is completed)

4.1.3.10.3 Driver receiving violations within a two (2) year period in any combination which totals 6 points will be terminated.

4.1.3.10.4 Avoidable accidents.

A. First accident - depending on severity - driver will receive a minimum of a warning letter and could receive a suspension up to 30 days or termination if it is determined that the driver is found to be grossly negligent.

B. Two avoidable accidents within one year will result in 5 to 20 days suspension.

C. Three avoidable accidents within one year will result in termination.

4.1.4 SAFE DRIVER & EQUIPMENT OPERATION

4.1.4.1 Drivers must always operate their vehicles in a safe and courteous manner.

4.1.4.2 Drivers are not allowed to operate a vehicle for the Company under the influence of drugs, narcotics, barbiturates or alcohol. Violation of this rule will result in dismissal

4.1.4.3 Drivers are not allowed to have in their possession in any form Benzedrine, Dexedrine or any forms of an amphetamine drug or so called "Bennies". Violation of this rule will result in dismissal.

4.1.4.4 Drivers are not allowed to carry alcoholic beverages in or on a Company vehicle unless legally shipped and covered by a bill of lading and a way-bill. Violation of this rule will result in dismissal.

4.1.4.5 Under no circumstances can a driver consume or have in his possession any form of alcoholic beverages while on Company, property and a driver is not allowed on Company property if he has been drinking any form of alcoholic beverages. Violation of this rule will result in dismissal.

4.1.4.6 The refusal of any driver to submit to a sobriety test shall establish a presumption of drunkenness. The refusal of any driver to submit to any test to determine the use of LSD, marijuana, heroin, or other illicit drugs shall result in a presumption of being under the influence of illicit drugs.

4.1.4.7 Drivers are required to follow the instructions of Company supervisors at all times unless performance of these instructions would result in a violation of the safety rules and regulations of the Department of Transportation or the Company safety rules and regulations.

4.1.4.8 After completing a load delivery, the driver must call the dispatcher for instructions unless he has been given previous instructions by Company supervision.

4.1.4.9 No driver is allowed to drop a trailer and bobtail a tractor at any time unless given authorization by the proper personnel or in the case of any emergency.

4.1.4.10 Drivers are not allowed to exchange trailers, tractors, or complete units en route between terminals without authorization.

4.1.4.11 When a driver is passed by another vehicle, it is his responsibility to assist the operator of the other vehicle to complete his pass quickly and safely by slowing his speed if necessary.

4.1.4.12 Drivers are not allowed to cut offheadlights while passing or being passed by another vehicle at night.

4.1.4.13 It is the driver's responsibility to keep his vehicle under control at all times and he must never operate his vehicle too fast for the conditions of the road or weather.

4.1.4.14 Failure to report for duty or assigned runs or after being called in by the Company will result in the driver being relieved from duty until an explanation is given to the terminal manager.

4.1.4.15 Drivers must not leave the engine running unattended, particularly at meal stops and break stops.

4.1.4.16 It is the driver's responsibility to park his unit in a safe manner at all times. A unit is safely and properly parked if all of the following is done: Shut the engine off, set parking brake.

4.1.4.17 It is the duty of all drivers to offer assistance to another COMPANY X driver in the event of an accident or road failure. When stopping to assist another driver, it is the driver's responsibility to park his unit completely off the traveled portion of the highway and in a safe manner. If' another Company vehicle has already stopped to offer assistance it will not be necessary to stop unless signaled to do so. More than one driver stopping to offer assistance creates an unnecessary safety hazard.

4.1.4.18 Drivers operating tractor and trailer units are required to roll the landing gear all the way up before moving the unit.

4.1.4.19 It is prohibited for a trailer to be dropped on the highway or shoulder of the highway except during a road failure that necessitates the changing of power units.

4.1.4.20 It is the driver’s responsibility to check his manifest and bills to see if dangerous article placards are required. Final responsibility rests with the driver to see that the placards are on the vehicle in accordance with Department of Transportation Regulations.

4.1.4.21 It is the driver’s responsibility to check his manifest and bills to ensure that the load corresponds with the documents.

4.1.4.22 Every driver shall have a valid chauffeur’s license from the state in which he resides. A driver losing his privilege to drive in his home state will not be allowed to obtain a license in another state. In case of suspension or revocation of driver's license for any period of time, he is to notify his terminal manager immediately and he will discuss Company policy with him. Violation of this rule will result in dismissal.

4.1.4.23 Drivers must report for duty clean and neatly dressed.

4.1.5 HOURS OF SERVICE

4.1.5.1 DISPATCH HOURS

8:00 AM to 5:00 AM Monday through Friday

4.1.5.2. DRIVERS HOURS

4.1.5.2.1. Drivers must log in accordance with Department of Transportation Regulations.

4.1.5.2.2. A driver must not make a trip until his logs are up to date.

4.1.5.2.3. In accordance with the Department of Transportation, Bureau of Motor Carrier Safety's Interpretation No. 70-1 (Revised) of 49 C.F.R., Part 395, you are relieved from duty and may log "off duty" meal and routine en-route stops of at least 15 minutes but not to exceed 60 minutes for every 4 hours of driving time providing your unit is properly and safely parked.

4.1.5.2.4 Driver is allowed 70 hours in 8 days or 60 hours in 7 days on-duty time.

4.1.5.2.5. Driver can't drive over 10 hours without having 8 hours off.

4.1.5.2.6. Logs will be checked when turned in for accuracy.

4.1.5.2.7. The dispatcher will maintain a computer record of drivers’ logs and hours of service of all drivers.

4.1.5.2.8.Records of fuel stops, PUCO or DOT inspections, trailer interchanges, and other records may be used periodically to check accuracy of logs.

4.1.5.2.9.If a driver is found to be inaccurately making out logs within a six month period he/she may be subject to disciplinary actions.

4.1.5.2.10.It is a driver's responsibility to keep the cab of the truck clean and free from trash and bottles. Trucks should be cleaned out at the end of a trip or day's work.

4.1.5.2.11.A vehicle inspection report must be made out for each vehicle (this includes trailers) operated upon arrival at the destination or upon the completion of a day's work. All defects must be listed. In the event there are no defects, the driver must mark the spot "O.K.".

4.2 DAILY INSPECTION OF VEHICLES AND REPORTS.

4.2.1 Drivers are not allowed to perform mechanical repair work on a Company vehicle unless a minor adjustment is necessary and is made while en route to avoid complete road failure. This adjustment or repair must be written up in detail on a Vehicle Inspection Report upon arrival at destination.

4.2.2 Company equipment is not to be used except for Company business.

4.2.3 Company equipment must not be used to push or shove any other equipment.

4.2.4 It is the driver's responsibility to check the sliding tandem, on trailers so equipped, to be sure the pin is in place and the handle in the proper position.

4.2.5 Drivers are required to make a VISUAL check of the fifth wheel after hooking up tractor and trailer to make certain the jaws of the fifth wheel are properly locked around the king pin. If the trailer has already been hooked up, the driver must still make a visual check. The driver is held responsible if a trailer comes unhooked from the tractor.

4.2.6 It is the driver' s responsibility before making a trip to check the general condition of the equipment such as tires, oil, fuel, lights, brakes, water, turn signals, windshield wipers, horn, mirrors, fifth wheel and safety equipment. It is a requirement of the Company and the Department of Transportation for the driver to check these items.

4.2.7 Drivers are required to check the truck or trailer doors prior to beginning a run or work day and at each stop made to insure that the doors are latched securely. Any defects should be reported immediately to the nearest terminal manager or shop. A truck or trailer must not be operated with a defective door latch.

4.2.8 Drivers must check their unit for fresh damages and report them to maintenance. Failure to do this puts the responsibility of any new damages on the driver.

4.2.9 No driver is allowed to equip Company vehicles with equipment or accessories other than those authorized by the Company. The Company will, upon the request of a driver to the Maintenance Supervisor or the Terminal Manager, install wiring appropriate for a citizen's band or "CB" radio.

4.2.10 Drivers are required to make a tire check to be certain there are no under-inflated or flat tires. Vehicles must not be operated with an under-inflated or flat tire.

4.2.11 No stops are to be made between terminals and other destinations except for authorized breaks, meal periods, or emergencies.

4.2.12 The driver is completely responsible for the tractor and trailer and its safe operation.

4.2.13 Drivers are to turn their bills in to the office personnel along with trip sheet weekly.

4.2.14 It is required that al drivers attend quarterly Safety Training Sessions a year.

4.3 PAPERWORK

4.3.1 HOW TO PROPERLY FILL OUT LOGS AND REPORTS.

HOURS OF SERVICE (LOGS) DAILY VEHICLE INSPECTION REPORTS (VIR)

Every driver will comply with all applicable regulations as described in the Federal Motor Carrier Safety Regulations Handbook.

Each driver will know and understand specifically items 395 (HOURS OF SERVICE) and 396 (VEHICLE, MAINTENANCE INSPECTION). If a driver is unsure of a regulation on either of the above mentioned items, he/she should consult the Company official auditing Logs, or the Maintenance Supervisor, for assistance and clarification.
