AGREEMENT

Acceptance of Terms

Catholic Commission for Employment Relations (CCER) is pleased to offer its National Police Checking Service to you on the basis of the Contract signed between your organisation and CCER for the provision of the National Police Checking Service, and the following terms and conditions.Please confirm your acceptance by signing this agreement.

Terms and Conditions

  1. In these terms and conditions: ‘you’ means the designated employer; ‘applicant’ means each individual about whom you require a National Criminal History Check (NCHC).
  1. Results from the NCHC are provided to CCER from CrimTrac. CCER does not accept and is not liable for the accuracy or completeness of the information provided.
  1. CCER will use its best endeavours to provide the requested NCHC results within 14 business days, however CCER is not liable for any delay or failure to provide information caused or contributed by a third party, including CrimTrac.
  1. You agree to keep all user name/s and password/s, password reminder question/s and answer/s and any other security or access information confidential to prevent unauthorised access and to prevent unauthorised use of the NCHC service. You agree not to give or make available your access information to any unauthorised person.
  1. CCER reserves the right, under certain circumstances, to deny your access to the NCHC service, in order to maintain or restore security.
  1. You agree that all electronic communications received via the NCHC service will be deemed valid, authentic and binding obligations. These electronic communications (e.g. ticking signed consent and confirming identity) will be given the same legal effect as your written and signed paper communications and shall be considered “writing” or “in writing” and shall be deemed for all purposes to have been “signed”.
  1. It is an essential condition of CCER’s agreement with you that:

(a)You will only use the reports and information received for the purposes of employment screening andprobity checking.

(b)You will take proper and reasonable steps to ensure that the reports and information remain confidential and you will not disclose information without the relevant individual’s consent except as otherwise permitted or required by law.

(c)You warrant that the fax, email or mailing address you provide CCER for correspondence is suitable for maintaining the confidentiality of the information CCERprovides you and you will notify CCER of any change to any confidential contact numbers.

  1. It is an essential condition of this agreement that you ensure that any person or organisation to which you provide any information that was provided to you by CCER complies with the obligations as set out in clause 9.
  1. You agree to indemnify and defend CCER against all suits, liabilities, claims, costs and demands whatsoever which may be brought or made as a result of any disclosure, use or misuse of personal information relating to an applicant which occurs as a result of any act or omission on your part.
  1. CCER reserves the right to vary its terms and conditions and our rates of charge from time to time. Any changes will be applicable from the date CCER notifies you.
  1. The fees for the cost of a NCHC are $41for paid staff and $15.38 for volunteers, unless further advised byCCER in writing.
  1. Costs become payable once the NCHC has been forwarded to CrimTrac.
  1. As a result of a NCHC, where you request CCER to conduct further inquiry in the form of a risk assessment, an additional payment will be charged. Additional payments are required for CCER to carry out risk assessments.
  1. Risk assessment costs may involve the application for relevant court transcripts and/or briefs of evidence containing police facts sheets etc. These costs will need to be borne by you or the applicant about whom the NCHC relates.Where such information is considered necessary CCER will seek prior approval for the application of such information from you before proceeding.
  1. CCER’s services are payable within fourteen (14) days of invoice. We reserve the right to suspend or cease providing NCHC services if invoices are not paid within the specified time period.
  1. The Laws of the State of the New South Wales govern this contract, and you hereby agree to submit to the nonexclusive jurisdiction of the Courts of New South Wales.
