NOTICE INVITING TENDER

Tenders in two bid system i.e. “EMD + Technical bid” and Financial bid, Separately (in two envelops) are hereby invited for the following work from contractors of appropriate class of CPWD, Railway, MES, Post & Telegraph Department and/or from those who have worked out for CSIR or its laboratories/Institutes and having:

i) Valid sales tax / TIN registration certificate,

ii) Average Annual financial turnover during the last 3 years, ending 31st March of the previous financial year, should be at least 30% of the estimated cost. And

iii) Experience of having successfully completed similar works during last 5 years ending last day of month previous to the one in which applications are invited should be either of the following:

a). Three similar completed works costing not less than the amount equal to 40% of the estimated cost / or

b). Two similar completed works costing not less than the amount equal to 50% of the estimated cost / or

c). One similar completed work costing not less than the amount equal to 80% of the estimated cost.

(The tenderers are required to attach proof of fulfilling these conditions while submitting the tender documents).

Terms & Conditions :

1.  Tenders should be on the specified form (Non-transferable) which may be obtained from

NISCAIR Bookshop, Dr. K.S. Krishnan Marg, Pusa , New Delhi during office hours upto

17/11/2006 on payment of Rs. 500/- by demand draft of a scheduled bank drawn in favour of Director, NISCAIR, New Delhi (Non-refundable).

2.  Tenders should be submitted in two separate sealed covers (Technical Bid & Financial bid) super-scribed with the name of the work, date and time of opening written both on the inner and outer envelopes. They will be received upto 3.00 P.M. on 20/11/2006 and Technical Bids will be opened on the same day on 20/11/2006 at 3.30 PM on the same day in the presence of bidders if any. Tenders should be dropped in the tender box before the closing date and time indicated.

3.  Earnest money of Rs. 8,750/- has to be deposited in the form of Demand Draft/ Pay Order, drawn in favour of NISCAIR,payble at New Delhi along with the tender. Earnest money will be refunded to the unsuccessful tenderers on finalization of tender. Tenders received without earnest money will be invalid.

4.  A sum @10% of the gross amount of the bill shall be deducted from each running bill of the contractor till the sum along with the sum already deposited as earnest money, will amount to security deposit of 5% of the tendered value of the work. In addition, the contractor shall be required to deposit an amount equal to 5% of the tendered value of the contract as Performance Security within the period prescribed for commencement of work in the letter of award issued to him.

5.  Time for carrying out the work shall be 45 days ( Inclusive of all holidays) and the date of commencement shall be reckoned from the 10th day of issue of award letter.It is to be noted that execution of work shall be during working hours only (i.e 9.00 A.M.- 5.30 P.M. , Monday to Friday). NISCAIR reserves the right for getting the work executed beyond office hours and on all gazetted Holidays, Sunday & Saturday during the stipulated period of completion and shall be abided by the Contractor.

6. Before tendering, the tenderer shall inspect the site to fully acquaint himself about the condition in regard to accessibility of site, nature and extent of ground, working condition of site and locality including stacking of materials, installations of tools and plants (T&P) etc., conditions affecting accommodations and movement of labour etc. required for the satisfactory execution of the work contract. No claim whatsoever on such account shall be entertained by the Employer in any circumstances.

7. No material will be issued by the department. Contractor has to arrange & provide all the materials and T&P etc. at his own cost at site.

8. The work will have to be carried out as per the latest CPWD specification,CPWD works manuals, and to the entire satisfaction of Engineer-in-charge.

9. Any damage done by the Contractor or his labour to the existing structure fittings/fixtures shall have to be made good by the contractor,at his own cost. In failure to do the same, the necessary cost for making the good shall be recovered from the final bill of the contractor.

10. Quantities mentioned in the schedule of work may decrease or increase as per the site conditions. Nothing shall be payable for any reduction in scope of work.

11. Samples of all the materials required to execute the work shall be approved brand & manufacture and are of best quality. The same shall have to be got approved by the contractor from the Engineer-in-charge before execution of the work.

12. Canvassing in connection with the tenders is prohibited and the tenders submitted by the contractor who resort to canvassing are liable for rejection.

13. The tenderers shall not be permitted to tender for works in the concerned unit of NISCAIR in which a relative is posted in the grade between Controller of Administration and Junior Engineer, (both inclusive). He shall also intimate the names of persons who are working with him in any capacity or subsequently employed by him and who are relatives as mentioned above.

NOTE: A person shall be deemed to be a relative or another if, and only if, (a) they are members of a Hindu undivided family; or (b) they are husband and wife; or (c) the one is related to the other in the following manner: Father, Mother (including step mother), Son (including step son), Son’s wife, Daughter’s (including step daughter), Father’s father, Son’s son, Son’s son’s wife, Son’s daughter, Son’s daughter’s husband, Daughter’s husband, Daughter’s son, Daughter’s son’s wife, Daughter’s daughter, daughter’s daughter’s husband, Brother (including step brother), Brother’s wife, Sister (including step sister), Sister’s husband.

14. Tender submitted shall remain valid for 90 days from the date of opening for the purpose of acceptance and award of work, validity beyond 90 days from the date of opening shall be by mutual consent.

15. The tenderer shall quote rates both in figures and words. He shall also workout the amount for each item of work and write in both figures and words. On check if there are differences between the rates quoted by the tenderer in words and in figures or in the amount worked out by him, the following procedure shall be followed:

i)  When there is a difference between the rates in figures and in words, the rates which correspond to the amounts worked out by the tenderer shall be taken as correct.

ii)  When the amount of an item is not worked out by the tenderer or it does not correspond with the rate written either in figures or in words, the rate quoted by the tenderer in words shall be taken as correct.

iii)  When the rate quoted by the tenderer in figures and in words tallies but the amount is not worked out correctly the rate quoted by the tenderer shall be taken as correct and not the amount.

iv)  After opening of price parts all the prices shall be checked for arithmetic errors, if any. Items rates which have not been quoted in the first instance, will NOT be called for from the Bidders. The prices of such bidders shall be evaluated based on loading by the highest quoting item rates by any bidder/in-house estimate for such items whichever is higher, subject to the provisions contained in Para (v) below.

v)  The price bid of the bidders shall be rejected if they do not quote rates for certain items and approved estimate for such items is more than 0.5% of their total quoted price of the work. If such price impact of unquoted items is 0.5% or less than 0.5% of his total quoted price and, Owner/ NISCAIR decide to consider the bid, then for the purpose of comparison, the unquoted items shall be loaded by the price impact calculated on the basis of the highest of the rates quoted by other bidder/ in-house estimate. In such cases NISCAIR will recommend for negotiated settlement with respect to the lowest rates for these items quoted by other bidders, before award of work.

16. The tenderer should see drawings (if any) and in case of doubt obtain required particulars, which may in any way influence his tender from the Engineer as no claim whatsoever will be entertained for any alleged ignorance thereof.

17  Earnest money will be forfeited if the contractor fails to commence the work as per letter of award and he shall not be eligible for any claim.

18 Except writing rates and amount, the tenderer should not write any conditions or make any changes, additions, alterations and modifications in the printed form of tenders. Tenderers who are desirous to offer rebate the same should be brought out separately in the covering letter and submitted along with the tender.

19. If the work by the contractor is delayed beyond the stipulated date of completion, Penalty shall be imposed @ 1% of the value of the work awarded for each day’s delay, subject to a maximum of 10% of the gross amount of work done.

20. The Defect Libility Period shall be of 12 months and shall be start from the actual date of satisfactory completion of the work. Defects pointed out during defect libility period shall be made good by the contractor at his own cost, failure to do the same, the necessary cost for making the good shall be recovered from the amount of security deposit.

21. The issues not covered in the NIT clauses shall be governed by the clauses laid in conditions of contract for works in CPWD specification, CPWD work manuals & General Condition of Contract for CSIR (copy of the same can be obtained from work section, NISCAIR, Pusa)& CSIR guidelines (as amended time to time). The clause No. 28 of general conditions of contact relating to Escalation is not applicable to this work.

22. The Contractor should confirm any ambiguity and discrepancy related to the work and tender in writing before submitting the tender document.

23. The Director NISCAIR will be the owner/employer of the work and wherever CSIR is printed in conditions of Contract for Works and at other places, that to be replaced with NISCAIR 14 satsang vihar Marg, New Delhi 110067.

24. Before tendering, the tenderer shall inspect the site to fully acquaint himself about the condition in regard to accessibility of site, nature and extent of ground, working condition of site and locality including stacking of materials, installations of tools and plants (T&P) etc., conditions affecting accommodations and movement of labour & material, Covering & Protecting various books shelves, literatures, computer installations, furniture equipment & miscellaneous installations etc. required for the satisfactory execution of the work contract. Housekeeping & Cleaning of site including removal of splashes of paints etc. from floors, installations, furniture etc. including removal of debris / malba etc. is included in the scope of contractors. No claim whatsoever on such account shall be entertained by the Employer in any circumstances.

25. Arbitration

i.  In the event of any question, dispute/difference arising under the agreement or in connection herewith (except as to matters the decision of which is specially provided under this agreement) the same be referred to the sole arbitration DGCSIR or his nominee.

ii.  The award of the arbitrator shall be final binding on the parties. In the event of such arbitrator to whom the mater is originally referred is being transferred or vacating his office or resigning refusing to work or neglecting his work of being unable to act for any reason whatsoever, the Director-General, CSIR shall appoint another persons to act as arbitrator in place of the out-going arbitrator in accordance with the terms of this agreement and the persons so appointed shall be entitled to proceed with the reference from the stage at which it was left by his predecessor.
