Terms and Conditions

By entering mX Sydney Telstra 500 promotion you are agreeing to the following terms and conditions:

1.  STANDARD TERMS

1.1  Information on how to enter forms part of the terms of entry.

2.  WHO CAN ENTER?

2.1  Subject to clause 2.2, 2.3, 2.4, entry is open to all residents of NSW.

2.2  Directors, Management, Employees and their immediate families of Nationwide News, V8 Supercars and their respective related bodies’ corporate, associated agencies and companies are not eligible to enter.

2.3  Entrants under the age of 18 years must obtain the prior permission of a parent or guardian over the age of 16 years before entering the competition.

2.4  If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian.

3.  HOW TO ENTER

3.1  The competition period is from Monday, 29 November 2010 at 14:00PM (AEDST) to Monday, 29 November 2010 at Midnight (AEDT) (“the Competition Period”).

3.2  To enter the competition, readers must SMS in their details to the number printed within mX during the competition period.

3.3  Entrants (including winners) in the competition can enter as many times as they like during the each competition timeframe.

3.4  The time of entry will, in each case, be the time that the SMS is received by Salmat Interactive.

3.5  The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.

3.6  Incomprehensible and incomplete entries will be deemed invalid.

4.  PRIZES

4.1  1 x major prize winner will receive the following:

a)  1 x Double 3 Day General Admission tickets to the Sydney Telstra 500, 3 – 5 December. Valued at $150 each.

b)  Winner and a friend to attend the Tony Hawk training session on Friday, 3rd December. Valued at Money Can’t Buy experience.
Total value is $300 plus Money Can’t Buy Experiences.

4.2  5 x runner up prize winners will receive a limited addition Empire of the Sun - Walking on a Dream - vinyl record and CD box sets. Valued at $100 each.

4.3  Prize values are correct at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.

4.4  In participating in competition, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners agree to grant the Promoter a perpetual and exclusive licence to use such footage and photographs in all media worldwide and the winner (and their companions) will not be entitled to any fee for such use.

4.5  The winners agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation.

4.6  The prize cannot be transferred and cannot be redeemed for cash. No responsibility is accepted for any variation in the value of the prize.

4.7  If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

4.8  The winners must, on request by the Promoters, be able to provide evidence which, to the reasonable satisfaction of the Promoters, demonstrates that the winner is an eligible entrant (as per clause 2.1, 2.2, 2.3, 2.4) and has complied with these Terms and Conditions.

4.9  The prizes must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. If a winner is unable to satisfy these terms and conditions or a prize is not utilised able to be taken as the prize will be forfeited by the winner and cash will not be awarded in lieu.

4.10  The prizes are subject to the terms and conditions of participating service providers or any other terms and conditions that may be notified from time to time.

5.  HOW TO WIN

5.1  Each entrant who has entered the competition over each competition timeframe and registered all details in accordance with clauses 2 and 3 will be entered into the prize draws. There will be one (1) prize draw for each competition period that will take place at Salmat Interactive, Level 17, Innovation Place, 100 Arthur Street, North Sydney NSW 2060 on Tuesday, 30 November 2010 at 10.30am (AEDT).

5.2  One major prize winner and five runner up prize winners will be randomly selected from all valid entries received during the competition period.

5.3  The prize winners will be notified by phone call on the day of the draw and their name published online at mXnet.com.au on Wednesday, 1 December 2010.

5.4  The Promoter’s decision in relation to any aspects of the competition is final and the Promoter will not enter into any correspondence regarding the result.

5.5  It is a condition of accepting the prize that the winners may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

5.6  Entries not completed in accordance with these terms and conditions will not be considered valid and will not be included in the draw. Indecipherable or incomplete entries will be deemed invalid.

5.7  The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bills) in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

5.8  The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions or entry, of who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

5.9  Subject to any written directions given under regulation 37 of the Lottery and Gaming Regulation 1993 (SA), an unclaimed prize draw will take place at Salmat Interactive, Level 17, Innovation Place, 100 Arthur Street, North Sydney NSW 2060 on Thursday, 2 December 2010 at 14:00PM (AEDST).

6.  NO LIABILITY

6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under the Lottery and Gaming Regulation 1993 (SA).

6.2 Nationwide News Pty Ltd and its associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss or damage, loss of opportunity revenue or profit) arising out of or in connection with this promotion, including transportation to and from or during residency in the property or claim that may occur:

a) during the competition period;

b) whilst undertaking any travel won on or connected with their entry into the competition;

c) in the participation in any prize;

d) as a consequence of late, lost or misdirected mail;

e) due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compeer, staff member, journalist, other entrants or any other person;

g) arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this competition.

6.3 If for any reason this competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.

7.  PROMOTER’S DETAILS

7.1  The Promoter is Nationwide News Pty Ltd (ABN 98 008 438 828) of 2 Holt Street Surry Hills NSW 2010.

7.2  Entry details remain the property of the Promoters and its related entities which is collecting the entrant’s personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners). The entrant may request access to his or her personal information by contacting the Privacy Officer on 02 9288 3212.
