MUNICIPAL OFFICERS MEETING

DECEMBER 5, 2007

Mayor Twomey called the meeting to order at 6:05 p.m.

Roll Call: Patricia Boston, J. Fred Staples, Jr., Clement Fleurent, Susan Deschambault,

Bob Mills, Rick Laverriere, Raymond Gagnon, David Flood, George Lamontagne

The Council honored the Flag by reciting the Pledge of Allegiance.

Adjustment to the Agenda:

Ø  Add Massage Therapy License: The Foot Oasis, LLC

Massage Therapy License: The Foot Oasis, LLC

Motion by Councilor Mills, seconded by Councilor Laverriere to grant the massage therapy license to The Foot Oasis, LLC.

Vote: Unanimous.

Liquor Licenses:

Ø  TJ’s Pizza, Inc.

Ø  Bebe’s Burritos

Ø  The French Quarter

Motion by Councilor Laverriere, seconded by Councilor Staples to grant the liquor license to TJ’s Pizza, Inc.

Vote: 8/1; Councilor Fleurent opposed.

Councilors Boston, Staples, Deschambault, Mills, Laverriere, Gagnon, Flood and Lamontagne in favor. Motion carries.

Motion by Councilor Lamontagne, seconded by Councilor Laverriere to grant the liquor license to Bebe’s Burritos.

Vote: 8/1; Councilor Fleurent opposed.

Councilors Boston, Staples, Deschambault, Mills, Laverriere, Gagnon, Flood and Lamontagne in favor. Motion carries.

Motion by Councilor Gagnon, seconded by Councilor Laverriere to grant the liquor license to The French Quarter.

Vote: 8/1; Councilor Fleurent opposed.

Councilors Boston, Staples, Deschambault, Mills, Laverriere, Gagnon, Flood and Lamontagne in favor. Motion carries.

No citizens addressed the Council.

Consideration of Minutes: November 15, 2007; November 20, 2007

Motion by Councilor Laverriere, seconded by Councilor Lamontagne to accept the minutes as printed.

Vote: Unanimous.

Orders of the Day:

2007.122 IN BOARD OF CITY COUNCIL..DECEMBER 5, 2007

BE IT ORDERED, that the City Council of the City of Biddeford elect a Council President.

Motion by Councilor Laverriere, seconded by Councilor Mills to nominate Councilor Lamontagne as Council President.

Motion by Councilor Deschambault, seconded by Councilor Laverriere that nominations cease.

Vote: 8/1; Councilor Fleurent opposed.

Councilors Boston, Staples, Deschambault, Mills, Laverriere, Gagnon, Flood and Lamontagne in favor. Motion carries.

Vote on nomination of Councilor Lamontagne: Unanimous.

2007.123 IN BOARD OF CITY COUNCIL..DECEMBER 5, 2007

BE IT ORDERED, that the Mayor’s nomination of John Bubier to be City Manager, Carmen Lemieux to be City Clerk, Roger Beaupre to be Police Chief and Robert Fournier to be Fire Chief be confirmed.

Note: This item is required by Article II, Section 2, of the City Charter. Although this procedure is established in the City Charter, the attached state statute has been interpreted by the City Solicitor that due process is required for the removal of municipal officials and employees. Due process requires adequate notice, a hearing (if requested) and “cause” for removal. For this reason, the reappointment of the above named officials should be considered procedural.

BE IT FURTHER ORDERED that I, Joanne T. Twomey, Mayor of the City of Biddeford do hereby appoint Smith Elliott Smith & Garmey, as City Solicitor for a term to expire December 2009, in accordance with the Charter of the City of Biddeford.

Motion by Councilor Lamontagne, seconded by Councilor Laverriere to confirm the nomination of the City Manager, City Clerk, Police Chief and Fire Chief.

Vote: Unanimous.

Motion by Councilor Laverriere, seconded by Councilor Gagnon to confirm the nomination of Smith, Elliott & Garmey as the City Solicitor.

Vote: Unanimous.

2007.124 IN BOARD OF CITY COUNCIL..DECEMBER 5, 2007

BE IT ORDERED, that the City Council of the City of Biddeford does hereby adopt Roberts Rules of Order, in conjunction with Code of Ordinances, Appendix A, Rules of the Council.

Motion by Councilor Lamontagne, seconded by Councilor Boston to grant the order.

Vote: Unanimous.

2007.125 IN BOARD OF CITY COUNCIL..DECEMBER 5, 2007

BE IT ORDERED, that Mayor Joanne Twomey’s appointment to the Finance Committee be confirmed.

Motion by Councilor Laverriere, seconded by Councilor Mills to confirm the Mayor’s appointment of Patricia Boston to the Finance Committee.

Vote: Unanimous.

2007.126 IN BOARD OF CITY COUNCIL..DECEMBER 5, 2007

BE IT ORDERED, that the Council President’s appointment to the Finance Committee be confirmed.

Motion by Councilor Mills, seconded by Councilor Gagnon to confirm Council President Lamontagne’s nomination of Councilor Laverriere to the Finance Committee.

Vote: Unanimous.

City Manager Report was given in writing, and a few questions were asked and addressed.

Other Business:

Councilor Deschambault: Asked if the whole Council is attending the Municipal Officers workshop on December 6th being put on by MMA. All Councilors are attending.

Also asked that the City Manager reports be copied two-sided.

Council President Lamontagne: Expressed his positive outlook for the next two years and shared that he is looking forward to working with this Mayor and Council.

Motion by Councilor Laverriere, seconded by Councilor Gagnon to adjourn.
