ADVICE OF RIGHTS
(Request for Contested Hearing on Infraction)
You have been charged with a criminal offense.
1. You have the right to remain silent. Any statement you make may be used against you at trial.
2. You have the right to a lawyer and, if you cannot afford a lawyer, to have one provided at public expense. You must screen for a lawyer at public expense to determine if you qualify. You have the right to a lawyer at all proceedings.
3. You have the right to a speedy and public trial by jury. Unless you waive your right or the Court finds good cause for a continuance, your trial will take place within ninety (90) days if you are out of custody, and sixty (60) days if you are in custody.
4. If you plead not guilty, your case will be set for a pre-trial conference and a trial at a later date, and:
A. You are presumed innocent and the City must prove your guilt beyond a reasonable doubt; and
B. You have the right to hear and question any witnesses at trial who testify against you; and
C. You have the right to call witnesses to testify for you at no expense to you; and
D. You have the right to appeal if you are found guilty.
5. If you plead guilty, the following things may happen:
A. You give up all of the above listed rights.
B. A guilty finding will appear on your criminal record.
C. The Court may sentence you to the maximum amount of jail allowed by law.
D. You will have the right to make a statement to the Court before sentencing.
6. Consular/Non-Citizen Advisement
If you are not a citizen of the United States, a conviction could be grounds for deportation, expulsion from the Unites States, or denial of naturalization. Advise your attorney if you are not a citizen of the United States so that you can discuss the immigration consequences of this case. You have the right to speak to someone from the Consulate of the nation where you are a citizen before being arraigned on any criminal offense. If you are being held in jail you have the right to request that the prosecuting attorney notify the Consulate from the nation where you are a citizen that you are being held in jail. A consular official from your country may be able to help you to obtain legal counsel, and may contact your family and visit you in detention, among other things. If you want your country’s consular officials notified, you may request it at any time. Please discuss these issues with your attorney.
I hereby acknowledge that I have read or have read to me the above rights and that I understand them. I understand that if I am not in custody or if I am not in FTA status that the court will set a contested hearing for infractions that were issued at the time of arrest. I will receive notice of hearing at my last known address. I understand that I can later request a mitigation hearing or deferred finding, if eligible. I understand that failure to appear at the hearing could lead to suspension of my driver’s license and imposition of court costs.
