MINUTES OF THE MEETING OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SODA SPRINGS, CARIBOU COUNTY, IDAHO HELD APRIL 20TH, 2011.

MEETING CALLED TO ORDER AT 5:00PM BY KIRK L. HANSEN, MAYOR.

The invocation was given by Robert Lau, Mayor Hansen then led everyone in the

‘Pledge of Allegiance’.

Mayor Hansen added to the agenda a consideration of an amendment to the garbage collection contract which is pertinent due to circumstances.

The Council reviewed the minutes from the last meeting and the pre-paid accounts payable. Councilmember Prescott moved to dispense with the reading of the April 6th, 2011 minutes and approve them as written along with the pre-paid accounts payable for April, 2011. Councilmember Smith seconded the motion. All in favor, motion carried.

The Mayor and Council revisited the new Caribou County Emergency Operations Plan. Director Skinner noted a few items that had changed included names being removed and replaced with titles and also just more detail added to the same tasks that were in the prior plan. Councilmember Hart reported that he briefly reviewed the plan and said it looked good and he had no problem with it. Councilmember Hart moved to approve acceptance of the Caribou County Emergency Operations Plan dated February, 2011 and authorized the Mayor’s signature. Councilmember Lee seconded the motion. All in favor, motion carried.

The Mayor and Council reviewed a written request from Jim McCullouch asking permission for a small scout troop to camp at Kelly Park on Friday, April 22nd. It would be for one night only. The Council discussed whether the restrooms were open. Director Skinner will check on the restroom situation and advise the scout troop. Councilmember Prescott moved to approve allowing the scouts to camp at Kelly Park, seconded by Councilmember Smith. All in favor, motion carried.

Director Skinner reported that City clean-up week will be May 21st through the 27th. He explained that because of Memorial weekend the drop-off site will be open the Saturday before clean-up week on May 21st and then the drop-off site will be open and curb side

pick-up will take place the week of May 23rd through the 27th. MR & E Inc. has again agreed to have roll offs available at the shop and will empty as needed and metal will be collected separately to be recycled. Clerk Vorwaller mentioned that flyers will be included with the utility bills.

Clerk Vorwaller requested to attend an annual State Tax Commission workshop in Pocatello on May 11th. Mayor Hansen approved Clerk Vorwaller attending the workshop.

Director Skinner presented a request from Carl Toupin of MR & E Inc. to amend the contract between MR & E and the City, deleting one paragraph that restricts Mr. Toupin from pursuing business expansion opportunities. The current 7 year contract expires in September of 2012. The Mayor, Council and Attorney Nelson discussed at length the best way to amend the contract. Councilmember Smith moved to approve striking paragraph 2 of Section 8 of the Refuse Collection and Disposal Contract with MR & E Inc. Councilmember Lee seconded the motion. All in favor, motion carried. Attorney Nelson will prepare the amendment for signatures.

Councilmember Smith moved to adjourn the meeting at 5:25pm, seconded by Councilmember Prescott. All in favor, motion carried.
