Minutes of the Heritage Conservation Committee Meeting held on 05-10-2010

105th Meeting of the Heritage Conservation Committee was held on 05-102010 at 3:00 PM at HMDA office, Greenlands Guest House Office, Begumpet, Hyderabad.

The following were present:

Confirmation of the Minutes of the 104th meeting of Heritage Conservation Committee dated:10.08.2010.

Action taken on the minutes of the 104thmeeting.

i)Action taken by GHMC on the recommendation of the last committee may be obtained and placed in the next committee meeting.

The Committee noted that GHMC officials submitted report dt:10.08.10. In this regard with reference to item no. 6 of the said letter, it was decided that the GHMC may be addressed to inform the specific action taken on the recommendations of the Heritage Conservation Committee regarding the B.P.S cases referred in the Charminar heritage Precinct area.

ii)Regarding the revised proposals for construction of 3 level Car parking and Sports Complex in the Nizam Club Heritage building.

Deferred to be discussed in the next meeting.

iii)The Government of Andhra Pradesh MA & UD Department seeking remarks on delisting of Khusroo Manzil, Heritage Building, Sl.No.111, Grade III.

Deferred to be discussed in the next meeting.

iv)Listing of Additional Heritage buildings

A)INTACH – HUDA Hyderabad Heritage Buildings Listing Project – Study awarded to INTACH, Hyderabad Chapter.

B) The suggestion of previous HCC meeting to notify certain buildings as Heritage Buildings.

The Committee noted that the 16 buildings documentation and preliminary notification is in process. Sri. Sajjad Shahid, Member suggested to HMDA officials that plans and details of the 14 additional buildings & the documentation can be filled at the time of final notification of additional buildings.

v)A letter dated received from Sri M.Ved kumar, President Forum for a Better Hyderabad – Civic plans threaten three heritage structures in Mahaboob College Sec-bad.

Noted that GHMC was addressed in this regard.

vi)Received letter No.768/CSC/TPS/SZ/2009/922 dt: 30.04.2010 received from the Chief City Planner, Greater Hyderabad Municipal Corporation with regard to Proposed construction of 2 Cellar, GF + 4 Floors Pr.No.20-4-224, 20-4-149 to 20-4-1055 situated at Khilwath road, Hyderabad.Called HomeopathyHospital which is extension to the existing building along with C.D.and 2 copies of blue prints.

Deferred to be discussed in the next meeting.

vii) Documentation of notified HeritageBuilding

Noted.

i.A letter dated: 26-04-2010 received from Rt.Rev.T.S.Kanaka Prasad, B.D Bishap in Medak, Church of South India, Medak Diocese addressed to Metropolitan Commissioner,HMDA with a request to stop the renovation work of CSITA St. George’s Church,Abids Road, Hyderabad.

Deferred to be discussed in the next meeting.

iiALr.No.TA7/A/AEE4/RB/Heritage/2010-11,Dt:7.6.2010 received from Sri. T.Babu Raj, M.E,Chief Engineer (R&B),Hyderabad. Regarding delisting of Umidmanzil,Raj Bhavan from Heritage list

Membersnoted that a Lr.No: 13596/Plg/HCC/HMDA/2007, dated: 17-09-2010 was addressed to Sri. T. Babu Raj, M.E, Chief Engineer (R&B) as per the recommendations of the committee.

Other Items:

i)The Committee suggested that GHMC officials may be suggested to inspect and submit a report on the proposed Parking at Motigalli in front of Chowmahalla palace.

ii)The Committee noted that the Charminar Pedestrainisation project work is started without taking any clearance from Heritage Conservation Committee. Therefore the committee suggested that GHMC may be suggested to make a presentation on Charminar Pedestrainisation project in the next meeting.

The GHMC officials made a presentation on the proposal of readaptive use of Sardar Mahal, heritageBuilding in the meeting.

It was decided that the GHMC may be informed to furnish a monthly report on the progress of Charminar Pedestrainisation project to the Heritage Conservation Committee for its review.

iii)The Committee requested the Metropolitan Commissioner, HMDA for issuing of I.D Cards to Heritage Committee members.

Members noted that the matter is under the process.

iv)Development permissions (Building Penalization Scheme) referred by the Greater Hyderabad Municipal Corporation in Notified Charminar Precinct area for NOC/Clearance from Heritage Conservation Committee.

e) A Lr.No.344/ACP/C5/SZ/GHMC/08,dt: 29-05-2010 (received in HMDA on 08-07-10) GHMC A GHMC – Building Penalization Scheme- Pr.No.21-6-195, Babri Alawa, Hyderabad of Sri. Ibrahim Khan Copy of plan forwarded for NOC.

The Committee noted that a Lr. No: 8562/Plg/HCC/HMDA/2008, dated: 23-09-2010 wasaddressed to the Commissioner, GHMC, Hyderabad, stating that the height may be restricted to 10 Mts in regularizing under BPS in Charminar Heritage Precinct area.

ii)A letter No.5943/I1/2010-1, dated: 07.04.2010 received from the Prl. Secretary to Govt. MA & UD Department - Renovation of Heritage Building of Nizamia Unani Hospital & College – Remarks Called for – Reg.

The Committee noted that a letter was addressed to Prl. Secretary to Govt. MAUD Department, to appoint a Conservation Architect and submit conservation plans to HCC/HMDA for further discussion in this matter.

iii)A letter dated 08.07.2010 has received from Sri. S.M. Zakhi Shadab addressed to the Chairman HCC informing that a portion of IrramManzilPalace at the rear west end has been demolished.

The Committee noted that a letter was addressed to the Commissioner,GHMC andChief Engineer, R&Btosee that no demolition should be done to any part of the building.

The committee decided that the Chief Engineer, R & B or his represenatative may be requested to attend the Heritage Conservation Committee meeting to inform the action taken to preserve the heritage building.

NEW ITEMS.

1)A letter dated: 6-09-2010 received from Sri.Satish Kumar G.Shah regarding Private owned heritage buildings and its acquisition, purchase, alternate land in exchange –Reg.

The Committee heard Sri. Satish KumarG. Shah and suggested he may send suggestions and his viewson the conservation of privately owned Heritage Buildings.

2)A letter dated: 20.9.10 receivedfrom Sri.Srinivas Rao, Jr.M.E, Hyderabad Public School with a request to issue No objection Certificate-Reg.

The site was inspected by some members. It was noted that proposed construction is an extension of the existing middle school building which situated behind the south west wing of Jagirdars block.

There is already an existing building adjacent to and partially attached to the Jagirdars block which lies between the heritage building and the proposed construction.

There is already an internal service road between the heritage building and the proposed construction.

The proposed construction will not affect the heritage building in terms of line of site or elevation features being situated away from the building and to the rear. It does not interfere with the heritage environment.

Based on the above observations it is recommended for clearance of NOC from heritage point of view.

3)A Lr.No.26/3/2008/132,dated: 24.7.10 received from the Commissioner of Industries, Govt. of Andhra Pradesh regarding permission for demolition of Devdi Nawab Muqarrab Jung palace.

The committee noted that earlier the Commissioner of Industries had sent proposal for restoration of the said building and had also submitted a project report which was referred to C.E, HMDA.

The committee reiteratesits views that the Heritage building Devdi Nawab Muqarrab Jung palace (Commissioner of Industries Building) had to be preserved.

How ever HMDA may address the Commissioner of Industries that if there is a possibility of any mishap due to the present condition of the structure, necessary precautions may be taken and such portion may be vacated till proper Conservation & Restoration work iscompleted.

4. A Lr.No.841/CSC/TP18/NZ/2009,dated:18.7.10 received from the Commissioner, GHMC,Tank Bund-Opinion on the further preventive / precautionary measures to the Spanish Mosque Heritage building –Reg.

The committee noted that the Government had changed the land use of the site from Residential to Commercial vide G.O.Ms.No. 645 M.A dt: 05-12-1996. One of the conditions of the G.O was that “A minimum 10 Mts side setback must be provided between the Mosque and the proposed building with development of a green belt in the side open space and the proposed construction must be take care to see that no damage is done to the Mosque structure and the foundation which abut the property”.

It was also noted that on a reference from GHMC, in the absence of Heritage Conservation Committee, when the same was not constituted, the HMDA had informed No Objection for the proposed MSB subject to the condition that “10Mts setback is maintained from the Spanish Mosque as per the G.O. cited and it may be ensured that the proposed construction does not damage the Mosque structure and its foundation”.

As per the report of GHMC, committee noted that developer has started the cellar construction before the plans were released by the GHMC which is illegal.Therefore the GHMC may be addressed to pursue the criminal case already filed by public in this regard regarding blasting.

Further the GHMC may be addressed to consider release of the plans after maintaining safe distance of not less than 10 Mts for the cellar portion from boundary wall of the Mosque and to construct a retaining wall from the cellar.

Further the GHMC shall obtain an enforceable guarantee by way of Indemnity Bond and commitment from the developer to the effect that they would be solely held responsible and shall reimburse the cost of Restoration if any damage is caused to the heritage structure abutting the property.

5.A Lr.No.CMPT/AWARDS/2010/09/01, dated:13.9.10 received from Sri.G.Kishan Rao, IAS (Retd), Director, Chow Mahalla palace – Announcement of Award of Merit by UNESCO, Asia Pacific for the year 2010 –Reg.

The Committee were happy to hear about the Award and requested HMDA officials to send anappreciation letter to the Sri. G. Krishna Rao, IAS (Retd), Director, Chow Mahalla palace from the Chairman, Heritage Conservation Committee.

6.a) A letter dated Nill received from Sri.P.Anuradha Reddy, Convenor, Hyderabad Chapter, INTACH-Metro danger to Hyderabad Heritage-Reg.

b) A letter dated 30-09-2010 received from Sri. Vedkumar, President, Forum for better Hyderabad – request for details of the stretches of the route – reg.

On the request of Anuradha Reddy and Shankar Narayan (Architect) of INTACH, the Heritage Conservation Committee allowed a brief presentation by them on the implications of the proposed Metro Rail at Hyderabad on Heritage, Environment, Safety issues etc. The presentation included a route map and some visuals of the proposed elevated railway in different stretches of the city.

The visuals were based on some technical data (not complete) without any data on present status, amount of pollution like noise generation etc.

It was made clear by the Heritage Conservation Committee that it confines itself only to those aspects that affect HeritageBuildings, Heritage Precincts or the skyline by the proposed Metro Line.

There was not enough data to come to any conclusion, but the visuals brought out that in the route, there were too many heritage buildings and not yet known consequences to them. On a quarry of Heritage Conservation Committee whether in the stretches where Heritage Buildings are located the proposed line can go underground without disturbing the Heritage Structures in any manner, it was informed that it was possible but the Metro rail Authorities did not furnish details on this aspects except perhaps the Secunderabad Railway Station area. The reasons given for this by Metro Rail Corporation like Rocky Strata or Cost was not convincing.

Heritage Conservation Committee suggested that the INTACH may prepare a detail plan showing all Heritage Structures etc on the proposed Metro Rail Line and presented to HMDA and Government may be requested to inform the Metro Rail Authorities that this was a matter to be considered in depth, in view of the Heritage Regulations and no commitment for the works etc may be made unless it is examined and on more complete information to be given by the Metro Rail Corporation including information on the possibility of taking the line underground at important stretches where the Heritage Building are likely to be affected.

  1. A letter dated 17.9.10 received from Sri.Vedkumar,President, Forum for better Hyderabad – 254 old structures demolished-Reg.

The Committee suggested addressing a letter to GHMC officials to submit a report on the 254 old structures demolished as alleged in the news paper report.

Table Items:

1. Letter Dt: 31-08-2010 received from the Principal, Hyderabad Public School with regard to work order issued by the G.H.M.C for construction of Public Convenience (Toilet) obstructing the view of Heritage Buildings and causing health hazard to students.

The committee was of the view that the public toilet obstructing the view of the HeritageBuildingshall not be permitted.

Therefore Commissioner GHMC may be addressed accordingly.

2. Letter Dt: 08-09-2010 received from Sri. Narender Luther, President, Society to Save Rocks, addressed to Vice- Chairman, Maulana Azad National Urdu University, in respect of construction near Heritage Rock Precinct “Pathat Dil” & “united-We-Stand”.

Proposed for inspection by members.

3. Letter Dt: 04-10-2010 received from the honorary secretary, The Nizam Club submitting revised plans as desired.

Deferred to be discussed in the next meeting.

4.A news paper clipping received from the member informing that very near to the heritage building Asman Mahal, SI.No. 113, Code.No. 3.43, Grade – III located at Lakdikapul, illegal excavation is in progress.

This was discussed and the members suggested that HMDA should address a letter to GHMC to take necessary action in this matter and to submit a report in this next meeting of Heritage Conservation Committee.

The meeting ended with a vote of thanks to the Chair.

The next meeting will be held on 19th October 2010 at 11.30 AM at Greenlands Guest house, Begumpet to discuss inter alia all the deferred items.
