Minutes of the Avon Planning Board-October 9, 2008

Attendance

Present-DeBlock, Egan, Ernst, Maxwell, Placitella, Ryan.

Absent- Davey, Mahon, McGovern, O’Malley, Maloney

Also Present- C. Rooney, Engineer, J. Carton, Attorney, C. Brautigan PB Sec.

The only hearing for this meeting was for Ken and Muriel Rogers of 103 Woodland Ave.

Mr. Rogers and was sworn in as a witness to present evidence. Tom Petersen, Architect, was also sworn in.

Mr. Rogers informed the board that he was here in August, and this application is different in that it is for a single-family residence rather then the two family residence requested at that time.

Tom Petersen explained this application is different in that it has eliminated the apartment over the garage. In addition, as it is an undersize lot of 4580 feet variances will be required. The plans will show this proposed house is not much different then the original plans. On the first floor, it will have a master bedroom, family room, kitchen, and a garage. The second floor will have four bedrooms, two baths and an office. The attic level will be unfinished at this time. The building lot coverage requested is 42.4% and the impervious coverage will be 49.7%. The plans indicate a front porch with a covered second floor deck over the front porch, and a third floor deck.

Engineer Rooney gave his report that outlined the benefits and variances of this plan if it is to be approved.

Some of the variances and/or stipulations of this plan if approved are:

1. It is an undersize lot of 4850 sq. feet as 7000 sq. feet are required.

2. It will require a variance for lot coverage of 42.4%

3. A variance is required for the proposed second floor deck that is covered

4. A variance is required for the proposed third floor deck.

5. A variance for the front yard will be required for Woodland Ave.

6. A variance for the rear yard will be required.

7. No fence, patio, ground decks, outdoor showers, AC units, or other additions to the outside of

the residence will be allowed with out approval of the Planning Board.

8. Details for the proposed driveway and curb cuts will be submitted to Engineer Rooney for

approval.

9. Certified copies of all setbacks will be submitted.

After a discussion with the applicant and his architect, the applicant was allowed the opportunity to discuss the application with his architect. When the meeting was resumed, Mr. Rogers indicated he wanted to carry this application so he could review the plans and available options.

Motion by Maxwell, second by Placitella, to carry this application to the December 11, 2008 meeting.

The resolution from the Caringi appeal was approved as submitted by Attorney Carton.
