MINUTES OF ROCKBEARE PARISH COUNCIL MEETING HELD ON WEDNESDAY 18TH SEPTEMBER 2013 AT 7.30PM AT ROCKBEARE VILLAGE HALL

  1. TO RECEIVE RESIGNATION OF CHAIRMAN AND ELECT A NEW CHAIRMAN FOR THE CIVIC YEAR

RESOLVED: That Cllr David Mason be appointed Chairman and Cllr B Miller be appointed Vice-Chairman for

the remainder of the civic year.

  1. MINUTES: The Minutes of the previous meeting of Rockbeare Parish Council held on Wednesday 21st August 2013 were approved and signed as a correct record of that meeting
  1. Matters arising from the Minutes

(i)Transfer of strimmer: It was confirmed that a brushcutter, purchased by the Council several years ago, be transferred into the ownership of the parish church to be used for maintenance of the churchyard. The brushcutter to be removed from the council’s insurance policy.

  1. REPORTS

6.1Police Report: PC Dave Smith had sent a written report as follows: crimes for the period 21st August to 16th September, 1 no. dwelling burglary, 1 no. common assault and 1 no. assault (all emanating from the same incident) and 1 no. fear of provocation of violence.

6.2County/District Councillor Reports:Cllr D Button had sent a written report which was circulated to all those present.

  1. PLANNING

7.1 APPLICATIONS: To consider and make comment on the following planning applications:

13/1541/VAR: Mr P Budd: Variation of Condition no 2 of planning permission 11/1035/FUL to include landscaping of the site at Broomfield View, London Road, Rockbeare: No objections

13/1802/MRES: Persimmon Homes (SW) Ltd: Application for approval of access, appearance, landscaping, layout and scale for plots 157-162, 67 and 68 plus addition of 2 new dwellings named as plots 271 and 272. Proposed amendments to details approved under 11/0053/MRES at site of Cranbrook New Community, London Road, Broadclyst: No objections

13/1752/MFUL and 13/1765/LBC: David Lock Associates: Demolition of listed farm outbuildings at Tillhouse Farm plus the development of 590 dwellings, associated roads and open spaces at site of Cranbrook New Community road past Till House Farm, London Road, Broadclyst:

Recommend refusal for the following reasons:

  • The listed farm buildings and wall should not be demolished instead, where possible, the character, appearance and layout of the Tillhouse Farm complex should be preserved e.g. thefarm buildings could be renovated and a courtyard created with 1/2 bedroom units.
  • Play area provision is inadequate: Provision of a single play area in the middle of the development is not sufficient, there should be more play areas and open space to promote access by families.
  • Car parking provision needs to be increased: The Phase 1 development is already congested and potentially dangerous thus demonstrating that the level of parking provision is completely inadequate. Although people may use public transport they will still retain their cars, also many adult children remain at home and have cars of their own.
  • Bat & bird boxes should be fitted to all houses facing the country park area and all houses along the green lanes known to be following the bat flight paths.

NOTE:The Parish Council would appreciate the opportunity to comment on the Construction Environmental Management Plan: before it is finalised. The Plan should exclude construction traffic from using Parsons Lane, Clay Hill, Gribble Lane and Rockbeare Hill. It should also include conditions that:

(i)a wheel-wash facility is used by all construction vehicles leaving the site and

(ii)road sweeping/cleaning is carried out along the old A30 towards both Exeter and Honiton via London Road (Rockbeare Straight) and Hand and Pen.

7.2 To consider and make comment on any planning applications received since the date of this agenda: None

7.3EAST DEVON LOCAL PLAN: The draft Local Plan will be subject to a Public Examination but it first needs to be approved by the Secretary of State who has asked that EDDC first consult on proposed changes to the Publication Draft. A draft response, prepared by Cllr Mason, had been circulated to all members and was approved for submission.

8. BUSINESS & FINANCE

8.1 To receive financial statement for August 2013

RESOLVED: That the Financial Statement for August 2013 is approved.

8.2To approve payments for September 2013

NOTE: Cllr D Miller declared a personal interest in respect of the next item as his wife is a volunteer

8.3 To consider request from the Citizens Advice Bureau (CAB) for a grant of £119.88: It was agreed to defer this item until the next meeting to find out if the Council has made a grant to the CAB in the past.

8.4 To consider suggestions for use of the TAP funding for a joint project: Clerk reported that bothAylesbeare and Broadclyst had made approaches about a joint project. The Clerk to attend a meeting inOttery St Mary on 25th September to discuss possible partnerships and report back. Cllr Miller offered to meet with the Chairman of Aylesbeare Parish Council to discuss a joint project to open up the footpath at Withy Bed Lane.

NOTE: The TAP funding is £1.10 per elector and can only be used where there is least two parishes working together and involving the community to try and solve a local issue.

9. REVIEW OF PARISH BOUNDARIES: A draft consultation response had been circulated to all members, this was discussed and it was agreed that the response, as drafted by Cllr Miller, be submitted to East Devon District Council.

10. HIGHWAYS AND FOOTPATHS

10.1To accept items to report: Fly tipping reported adjacent to the bridge going over the A30 and ditch between Manor gate and Rag Lane.

10.2To consider proposals for speed limit restrictions and other highway alterations in the Cranbrook/Rockbeare area: These were discussed and noted. The Council had no objections to the proposals

11. ENVIRONMENT/COMMUNITY FACILITIES

11.1Health and Safety: None

11.2Youth Club provision: Meeting to be arranged withYMCA to discuss governance arrangements.

11.3Provision of bus shelter in Rockbeare village: Update report: Clerk reported on a meeting with DCC. If a shelter is needed close to Rockbeare Village Hall then it could be achieved if part of the shelter was inside the boundary of the village hall. Concern about whether there is a need for an additional shelter in this area. Continue to investigate options, Clerk to obtain costings.

11.4Tennis courts in Rockbeare: Letter from Mr Noel suggesting that EDDC construct tennis courts on land adjacent to the playing fields. Discussion about who would fund tennis courts and what additional play facilities local residents would prefer. Meeting to be arranged with EDDC s.106 Funding Officer to understand exactly what funding is available for play areas and open space. Cllr Miller offered to contact the landowner’s agent to find out about use of the land.

11.5Open Space Review Consultation: The list of facilities as audited by EDDC for its Open Space Study was noted and agreed, no changes required.

12.CORRESPONDENCE

(i)Devon Association of Local Councils (DALC): Annual Report & AGM, 12th October at Westpoint: noted, Cllr Miller reported that he had recently resigned from the DALC Committee.

13.TO RECEIVE QUESTIONS FROM THE PUBLIC

(i)Opening of Clyst Hontion by-pass: No date received to-date, email DCC asking for opening date.

(ii)Cycle race: Recent cycle race through Rockbeare had caused problems for residents and other road users. It was explained that the race took place on a Sunday to ensure as little disruption as possible and is well marshalled.
