MINUTES OF PUBLIC PROTECTION SUB-COMMITTEE MEETING - 8TH MARCH 2012

1. BEREAVEMENT

At the request of the Chairman, Members observed a period of silence to reflect on the sad death of Councillor Mrs Smith and in recognition of her hard work and long service to the Public Protection Sub-Committee, the Licensing Committeeand the Council.

2. EXCLUSION OF THE PUBLIC

Resolved: That under Section 100 (A) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the whole item, including the decisions referred to at Agenda items3 and4 on the grounds that it would involve the likely disclosure of exempt information as defined in paragraph 1 of Part 1 of Schedule 12A of the Act.

3. DECLARATIONS OF INTEREST

Councillor Mrs Taylor declared a personal interest in Agenda Item 5 - Allocation of Street Collections. The nature of the interest being that she was a member of the Salvation Army.

4. MINUTES OF THE MEETING HELD ON 9TH FEBRUARY 2012

Resolved: That the minutes of the meeting held on 9th February 2012 be signed by the Chairman as a correct record.

5. HACKNEY CARRIAGE DRIVERS LICENCE

The Sub-Committee was informed of one new application for a Hackney Carriage and Private Hire Vehicle driver’s licence, an existing Hackney Carriage driver, an existing Hackney Carriage owner and driver and an existing Hackney proprietorthat had given sufficient cause for concern as to be referred to the Sub-Committee for consideration.

AAH, JAW, JMC and SJN, accompanied by a friend, were in attendance.

Resolved:

1. That in the case of AAH no action be taken to prosecute for failure to declare his previous convictions.

2. That in the case of AAH the application for both a Hackney Carriage and Private Hire vehicle driver’s licences be granted subject to a severe warning letter being issued stating that in the event of further offences, the licences may be suspended or revoked.

3. That in the case of JAW his licence be suspended for a period of 28 daysdue to his driving in full knowledge of the vehicle’s serious defects.

4. That in the case of JMcC his licence be suspended for a period of 14 days due to hisfailure to detect the vehicle’s serious defects.

5. That in the case of SJN a severe warning letter be sent indicating that in the event of further offences the licence may be suspended or revoked and additional conditions be imposed on the licence as follows:

(a) a physical examination to be undertaken on a minimum of a weekly basis on all vehicles licensed or jointly licensed to SJN;

(b) all vehicles licensed or jointly licensed to SJN to be regularly serviced at intervals not exceeding 4,000 miles;

(c) a record of all vehicleinspections and services to be maintained and produced on demand.

NOTE: During consideration of the item at 3, the following motion was moved, seconded, voted upon and lost:

That in the case of JAW his licence be suspended for a period of 42 days due to his drivingin full knowledge of the vehicle’s serious defects.

NOTE: During consideration of the item at 4, the following motions were moved, seconded, voted upon and lost:

(i) That in the case of JMcC a severe warning letter be sent indicating that in the event of further offences the licence may be suspended or revoked.

(ii) That in the case of JMcC, thedecision to suspend his licence for a period of 14 days wouldnot be rescinded following consideration of additionalrelevant personal information that had not been made available prior to the decision being taken.

6. PRIVATE HIRE VEHICLE DRIVERS LICENCE

The Sub-Committee was informed of an existing Private Hire Vehicle driver and owner that had given sufficient cause for concern as to be referred to the Sub-Committee for consideration.

CJW was in attendance.

Resolved: That in the case of CJW a severe warning letter be sent indicating that in the event of further offences the licence may be suspended or revoked and additional conditions be imposed on the licence as follows:

(a) a physical examination to be undertaken on a minimum of a weekly basis on all vehicles licensed or jointly licensed to CJW;

(b) all vehicles licensed or jointly licensed toCJW to be regularly serviced at intervals not exceeding 4,000 miles;

(c) a record of all vehicle inspections and services to be maintained and produced on demand.

7. ALLOCATION OF STREET COLLECTIONS 2012 / 2013

The Sub-Committee considered the applications for Street Collections for 2012/2013 that had been received.

Mrs Davies, Principal Solicitor Licensing confirmed that, in line with the agreed changes to the Street Collection Policy, all organisations on the approved rotaas outlined in the report had been contacted to ask if they wished to hold a Street Collection in Blackpool in the forthcoming year. The Committee noted that the The Salvation Army had advised that the date of collection requestedon the application form had changed from 14th July 2012 to 21st July 2012.

The Sub-Committee also considered other organisations that had applied for Street Collection permits for the same period.

Resolved:

1. That the following organisations on the rota system be granted a day to undertake a street collection in the 12 month period ending 31st March 2013:

St John Ambulance, subject tostatement of return being received following the previous year’sStreet Collection in line with the terms of the Street Collection Policy.

RSPCA

Trinity Hospice

Blackpool R.N.L.I.

The Salvation Army

Barnardos North West, subject to a specified date being agreed by the Senior Licensing Officer which would avoid Armed Forces Week covering the period between 23rd June 2012 to 1st July 2012.

2. That the following organisations be granted permission to hold collections in the 12 month period ending 31st March 2012:

Breast Cancer Campaign

CP Sport

3. That consideration of the application from Royal Marines Association (Blackpool, Fylde and Wyre Branch) via Alexander Rose Charities be deferred to the next meeting of the Sub-Committee to give the opportunity to seek further clarification on information contained within the application.

4. That the application submitted by Prevent Unwanted Pets be refused and that the applicant be invited to resubmit the application with additional information to the next meeting of the Sub-Committee.

5. To authorise the grant of a permit under the Street Collections Regulations to allow the sale to the public of a brochure on the evening of the Switch-On of the 2012 Autumn Illuminations on Friday 31st August 2012.

6. To delegate to the Senior Licensing Officer authority to issue further suitable organisations with permits.

8. HOUSE TO HOUSE COLLECTION APPLICATION

The Sub-Committee was advised that Mr Cook, on behalf of Recycling Solutions N.W. Ltdhad indicated today that he wished to withdraw his application for a house to house collection.

Resolved: To note that the application had been withdrawn at the request of the applicant.
