MINUTES OF EMPLOYMENT AND APPEALS COMMITTEE MEETING - 24TH AUGUST 2009

1. EXCLUSION OF THE PUBLIC

Resolved: That under Section 100 (A) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the whole item, including the decisions referred to at Agenda items3 and4 on the grounds that it would involve the likely disclosure of exempt information as defined in paragraph1 of Part 1 of Schedule 12A of the Act.

2. DECLARATIONS OF INTEREST

Councillor Doherty declared a prejudicial interest in Agenda Item 3 (5) in that the appellant was known to him.

2. MINUTES OF THE MEETING HELD ON 13TH JULY 2009

Resolved: That the minutes of the meeting held on 13th July 2009, be signed by the Chairman as a correct record.

3. HOME-TO-SCHOOL TRANSPORT APPEALS

The Committee was informedthat seven appeals had been lodged in connection with decisions taken by officers within the Children’s Services Directorate, not to provide assistance with home-to-school transport.

Mr Stone accompanied by Mrs Rowbottom, presented the case on behalf of the Authority.

Appellants 3/4 and 5 were in attendance at the meeting.

Resolved:

1. That the cases be heard in the absence of appellants not in attendance at the meeting, on the grounds that it had been made clear to them that that would be the case.

2. That in all the cases the appeals be refused and the original decision of the officers be upheld on the grounds that they had been made in accordance with the Council’s Policy on school transport and the Committee did not consider that there were sufficient special circumstances or considerations to justify overriding the policy.

Councillor Doherty having declared a prejudicialinterest in Appealnumber 5, in that the appellant was known to him, left the meeting for the duration of that case.

4. GRIEVANCE REVIEW

Resolved:To note that there was no Grievance to hear as the issues had been resolvedprior to the meeting.
