NOTICE OF INTENTION TO APPLY TO STOP UP THE HIGHWAY AT

LAND AT NORTHLEACH DRIVE

NOTICE is given that The Council of the Borough of Middlesbrough as Highway Authority intends to apply to Teesside Magistrates Court sitting at the Law Courts, Centre Square, Middlesbrough on 30th May 2017 at 10am for an Order under section 116 of the Highways Act 1980 authorising the stopping up of an area of the highway as described in the Schedule heretoon the grounds that the highway is unnecessary. The effect of the Order will be to extinguish all public rights of way over the said land.

A copy of the draft Order and Plan may be inspected free of charge at the Reception of the Town Hall, Middlesbrough, TS1 9FX between the hours of 9am and 5pm Monday to Fridays (excluding bank holidays and public holidays) or on the Council’s website.

Any person to whom this Notice has been given or who uses the highway specified or who would be aggrieved by the making of the Order may appear before the Magistrates’ Court to raise an objection or make a representation on the application. Any person intending to appear before the Magistrates' Court at the hearing of the application is requested to inform Middlesbrough Council Legal Services at the address below before the 30th May 2017 quoting reference SCM/P/16/0182.

The area of adopted highway approximately 30 square metres designated as ‘footpath’ and centred on Grid Ref NZ 48843 / 14834 and located to the side of number 29 Northleach Drive, Middlesbrough as shown by the zebra hatching on the plan referenced PPO-2016/ND/2.
