1. Consignor hereby warrants that Consignor has complete title to the merchandise consigned and will not hold ConsignNashville responsible for any claim or title to it. Consignor has the legal right to enter into this Consignment Agreement and that the goods are saleable and/or free and clear of liens or other claims.

2. Consignor agrees that all items have been checked for recalls. Consignor has checked the Consumer Product Safety Commission website and checked that all items are safe according to CPSC standards. Consignor assumes responsibility and liability for all items. Consignor agrees to hold ConsignNashville harmless should any claims be filed resulting from recalled products.

3. ConsignNashville reserves the right to reject any item deemed unacceptable for sale and may remove an item from the sales floor at any time. ConsignNashville retains the right to display items for sale as it sees fit.

3. Consignor agrees to allow ConsignNashville to sell any and all items checked into ConsignNashville. Consignor agrees to complete and provide an Inventory Intake Form. ConsignNashville reserves the right to assess a fee of 10% of the total sales price if the Inventory Intake Form is completed by a representative of ConsignNashville.

4. Consignment Period is 90 days from date of acceptance. Item will be sold at original price as listed on the Inventory Intake Form (IIF). If item is marked as discounted on the IIF, it may be discounted 25% on the 46th day of the Consignment Period. If item is marked as discounted on the IIF, it may be discounted 50% on the 76th day of the Consignment Period. ConsignNashville reserves the right to discount any item marked as discounted on the IIF at any time for Special Discounts and Sales. Discount could be 75% of the original sales price in January and July.

5. Consignor agrees to hold harmless and make no claim against ConsignNashville, property owner, Michelle Sadler, any volunteer, or paid participant of ConsignNashville for any loss, theft, vandalism, natural disaster, water, fire damage, or claims not contained within this agreement for any items consigned with ConsignNashville. Consignor assumes risks of these events occurring by consigning items.

6. Consignor agrees to waive any and all claims for personal injury resulting from participation in consigning items, from whatever cause, against ConsignNashville, property owner, Michelle Sadler, any volunteer, or paid participant of ConsignNashville, and the insurer of ConsignNashville.

7. Unsold items not picked up within 10 days after expiration of Consignment Period will become the sole property of ConsignNashville to be resold or donated at the discretion of ConsignNashville.

8. ConsignNashville agrees to pay Consignor _____% of the total sales price of each item sold. Payments are mailed on or before the 15th day of each month for items sold in the previous month.

9. Checks not cashed within 90 days of date of issuance will be void.

I agree to all terms listed above by signing below and selling through ConsignNashville Consignment.
