The Parliament of Victoriaenacts:

Melbourne Cricket Ground Amendment Act 2008
No. 42 of 2008

1Purpose

The main purpose of this Act is to amend the Melbourne Cricket Ground Act 1933 to provide for the reservation of a stratum of land at the Melbourne Cricket Ground.

2Commencement

This Act comes into operation on the day after the day on which it receives the Royal Assent.

After section 11E of the Melbourne Cricket Ground Act 1933insert

"11F Stratum to be added to Melbourne Cricket Ground

(1)In this section, relevant stratummeans the stratum of land being Crown Allotment 2065 on the plan numbered OP122691 and lodged in the Central Plan Office of the Department of Sustainability and Environment.

(2)This section has effect despite anything to the contrary in the CrownLand (Reserves) Act 1978 or any other Act or law.

(3)The Order in Council dated 9 June 1873 is revoked to the extent that it applies to the relevant stratum.

(4) Crown grant Volume 600 Folio 119902 is revoked to the extent that it applies to the relevant stratum.

(5) On the commencement of the Melbourne Cricket Ground Amendment Act 2008, therelevant stratum—

(a)is deemed to be permanently reserved under section 4(1) of the CrownLand (Reserves) Act 1978 as a Site for the Melbourne Cricket Ground; and

(b)is deemed to be included in, and form part of, the land reserved under the Order in Council dated 20 February 1934 and referred to in Crown grant Volume 5925 Folio 1184828.

(6)If any part of the relevant stratum is or is being used as a road, that part of the relevant stratum ceases to be a road and all rights, easements and privileges existing or claimed in it either in the public or by any body or person as incident to any express or implied grant or past dedication or supposed dedication or by user or operation of law, cease.

(7) The Registrar of Titles is authorised and directed to make entries in the Register that are necessary to give effect to subsections (4), (5) and (6).".

4Repeal of amending Act

s. 4

This Act is repealed on the first anniversary of its commencement.

Note

The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
