BOARD OF ADJUSTMENT

MINUTES OF JULY 10th, 2013

The July 10th, 2013 regularmeeting of the Borough of Totowa Board of Adjustment was held at the Municipal Building.Chairman Fierrocalled the meeting to order at 8:10 p.m., followed by the Flag Salute. Attorney William C. Saracino read the Open Public Meetings Act.

Roll Call:

Present: Chairman: Nick Fierro, Vice President: John Krautheim,Commissioner Niland, CommissionerD’Ambrosio,Commissioner Patten, Commissioner Mancini, Alternate Masi,Attorney Saracino, Engineer Murphy, Secretary Steinhilber.

Meeting of the zoning board was read by Attorney Saracino.

A motion to accept the minutes of the June 12th, 2013 meeting was made by Commissioner D’Ambrosio and seconded by Vice President Krautheim. On a roll call vote all Commissioners present voted in the affirmative.

1ST CASE:MR. & MRS. KALENIKOVA

340 LINCOLN AVE, BLOCK 59, LOT 3

Applicant requesting Floor Area Ratio variance and any other necessary variance(s) for construction of single family home.

Applicant, Tatiana Kalenikovasworn in by Attorney Saracino. Mrs. Kalenikova resides at 32 West 32nd St, Woodland Park New Jersey. Mrs. Kalenikova has Architect, Andre Szalay present to answer any questions. Mr. Szalay place of business is 554 Bloomfield Ave, Suite 3A in Caldwell New Jersey. Mr. Szalay has already been approved as a qualified architect.

Attorney Saracino has reviewed all notices and they are all adequate.

Mrs. Kalenikova wants to rebuild a house on existing property which was torn down. She is asking to add 3080 square feet which includes the garage. 1404 square feet is the total of the 2nd floor and 1676 square feet is the total of the 1st floor.

Per Engineer Murphy, applicant needs to do the following:

  1. Calculations for floor plans need to be added
  2. Porch dimensions need to be noted on plans
  3. Set back dimension for rear deck
  4. Driveway curbing needs to be noted in plans
  5. Regrade
  6. 2-3 feet of fill
  7. Maple tree was removed per architect
  8. Seepage pit-more detail to be clarified
  9. Incorrect graphic scale
  10. Reference Survey needs to be submitted to building department

Commissioner D’Ambrosio asked if Mrs. Kalenikova will be residing at residence and she responded yes. President Fierro asked about the above ground pool and if it was removed, Mrs. Kalenikova responded yes. Commissioner Patten asked if the residence will remain a single family home and if there will be a replacement of the trees that were cut down, Mrs. Kalenikova responded yes to both questions. Attorney Saracino stated there is insufficient curbing and siding needs to be noted in plans.

A motion to grant the necessary variance including stipulations made by Engineer Murphy, was made by Vice President Krautheim and seconded by Commissioner D’Ambrosio. Vote to grant: 7-0(Tape #2, #0-1255)

2nd CASE: BONG KYU JUNG

79 UNION BLVD, BLOCK 11, LOT 601

Applicant requesting necessary variance(s) for Change of ownership of Pure Healing Spa.

Applicant Bong Kyu Jung sworn in by Attorney Saracino. Property located at 79 Union Blvd Totowa. Mr. Kyu Jung phone number is 718-224-1532. Mr. Kyu Jung is requesting a transfer of ownership and a Certificate of Occupancy. Mr. Kyu Jung states that the business will remain the same, layout will remain the same, and there will be no improvements.

Attorney Saracino asks the following questions:

  2. Will the days open and hours remain the same-Mr. Kyu Jung replies 10am – 10pm 7 days a week

Public to be heard:

Totowa resident, Mr. Robert A. Monteyne sworn in by Attorney Saracino. Mr. Montyene resides at 8 Lookout Point, Totowa New Jersey. Mr. Monteyne asked when the resolution was approved for the first owner-the answer by the board was last year.

Vice President Krautheim asked Mr. Kyu Jung if he has any other establishments and Mr. Kyu Jung replied no.

A motion to grant change of ownership was made by Commissioner Niland and seconded by Commissioner Patten. Vote granted 7-0(Tape #2, #1255-2019)

THE FOLLOWING RESOLUTION(S) WAS MEMORIALIZED:

590 UNION BLVD, BLOCK 139, LOT 1

Variance(s) granted for construction of residential apartments in B-2 business zone.

Motion to adjourn meeting was made by Commissioner D’Ambrosio and seconded by Commissioner Mancini. The meeting was adjourned at 9:36pm.
