IN THE COUNCIL CHAMBERS

Mayor Roll called the meeting to order with a Pledge of Allegiance and welcomed the public.

Mrs. Williams, Mrs. Lawrence, Mrs. Desch and Mr. Bischoff were present. City Administrator Jim Hammons and City Clerk Glena Hook were also present.

Mayor Roll stated the purpose of the Public Hearing was to hear public comments concerning the Animal Control Ordinance and the proposed changes. Mayor Roll stated the comments will be limited to three minutes.

PUBLIC COMMENT

John Carlock residing at 1st and Colorado Avenue, Libby stated on the Animal Ordinance it states you can’t feed the pigeons, but he feeds wild birds and sometimes pigeons come in and eat the bird feed. Mr. Carlock stated he was not feeding the pigeons and when they came in he, shoos them away. Mr. Carlock was concerned if he would be in violation of the Ordinance. Mrs. Williams stated that feeding wild birds was not against the ordinance but feeding pigeons intentionally was and that Mr. Carlock would not be in violation of the Ordinance as long as he was not intentionally feeding the pigeons.

Jim Walker residing at 1209 Montana Avenue, Libby stated he had neighbors that are intentionally feeding the pigeons and would like it to stop. Mayor Roll the Ordinance would not go into effect until 30 days after it was passed.

Jennifer Nelson residing at1026 Washington Avenue, Libby stated she wanted to comment on the portion of the ordinance that has the definition of the animals at large. Jennifer Nelson stated it was specific for dogs and would like it to include cats. Jennifer Nelson also had a letter from Game Warden Phil Kilbreath of Fish, Wildlife and Parks, Troy area that she read to the mayor and council stating he was in support of the part of the Animal Ordinance concerning the feeding of turkeys.

Kathy Burrell residing at 1413 W 4th, Libby stated the cats in her neighborhood are destroying everything and asked if putting out feeding blocks for deer was legal. Mayor Roll stated it was not legal.

Fiona Walker residing at 1209 Montana, Libby wanted to add that their neighbors that feed the pigeons are also attracting deer because they place the feed on the ground.

DC Orr residing at 1117 Nevada Avenue, Libby stated that he would like the council to consider that the failure to license a dog could have a fine up to $300 and felt it was a little high. Mr. Orr also stated on the whole the definitions in the ordinance are not as well defined as under the old ordinance and some definitions are purposely vague and stated he is dead set against the ordinance.
