INSTRUCTIONS TO THE TENDERERS

1. Sealed and super-scribed item rate tenders are invited from reputed licensed electrical contractors experienced in the work of Erection of H.T./L.T. Poles, fixing of fabrication material and stringing of lines for the following work:

2. Name of the work : Erection and maintenance of H.T./L.T.poles, fixing of fabrication material and stringing of lines.

3. Area of operation : Thane Corporation, covering Geographical area of Wagle Estate Division and Kalwa Division.

4. Period of completion : 1 year

5. Brief scope of work : As outlined in detail in Schedule Part I to Part III and generally covering erection of such items as H.T./L.T. poles, fixing of fabrication material and Stringing of lines.

6. EMD of 1% of the TENDER VALUE i.e Rs.20000/- is payable by Demand Draft in favour of Maharashtra State Electricity Dist. Company Ltd., drawn on any Nationalised Bank situated in Bombay. The EMD can also be paid in cash in the office of the Superintending Engineer, Thane Urban Circle, Thane. Tenders submitted without earnest money are liable to be rejected

7. The tender fees of Rs. 1000.00/- in the form of Pay Order / Demand Draft drawn in the name of MSEDCL should be enclosed alongwith the Tender document to be submitted.

8. The tenders duly filled in shall be submitted in person in the office the office of the Superintending Engineer, Thane Urban Circle, Thane. Tenders will be opened, if possible on the due date at 15.00 hrs at the above office in the presence of such tenderers who choose to remain present.

9. Overall period of contract will be one year from the date of placing of the order.

10. The successful tenderer shall be required to pay the security deposit amounting to 5 % of the value of the contract either by Demand Draft/ Cheque / Pay Order etc.

11. This is an Annual Work to be executed according to our requirement. The tenderer is requested to get inspected all the Thane Corporation area particularly the roads and see for himself the site conditions regarding approaches, material, water supply labour etc. and all the other matter affecting the work before filling the tender.

12. The tenderers should be registered with the Government of Maharashtra as an electrical contractor. Documentary should be submitted along with tender. The licence number has to be clearly indicated in the Tender.

13. The contractor shall be required to pay the labourers engaged by him on the work not less than a Minimum Wage(which expression shall mean whether for whole time or piece work the respective rates of wages as fixed under the law for the time being in force).The contractor shall, be required notwithstanding any provisions in the contract to the contrary, cause to be paid such Minimum Wages to labourers indirectly engaged on the work, including any labour engaged by his labour contractors in connection with the said work as if labourers had been immediately employed by him.

The contractor shall comply with the provisions of payment of Wages Act, 1936, Minimum Wages Act, 1948, Employees Liability Act 1938,Workmens'Compensation Act 1923, Industrial Disputes Act 1947, Indian Factories Act 1948, Maternity Benefit Act 1961,or any modification thereof or any other law relating thereto and rules made there under from time to time, and give effect to the provisions of any law for the time being in force and regulating the rights and privileges of the labourers employed by him directly or indirectly. The contractor shall indemnify the MSEDCL against any payments to be made under and for the observance of the regulations, for the time being in force without prejudice to his right to claim indemnity from his subcontractors.

14. The contractor shall be responsible for rectification of defects for a period of 12 months from the certified day of completion of work by the MSEDCL. This period of 12 months shall be known as Defects Liability period. Any defects or failures during this period shall be rectified within one week of intimation in writing. If the same is not carried out in the stipulated time, we shall have the right to get it repaired departmentally or through any other agency. The cost of the same shall be recovered from the contractor.

15. All the works should be guaranteed for the period of 12 months from execution of work.

16. If the tenderer has any doubt about the meaning of any portion the tender he should at once get clarification from Superintending Engineer in writing sufficiently in advance and also personally meet him in this respect, before the due date. No additions or alterations in the tender form/conditions etc. should be made by the Tenderer.

17. The tenderers must return the forms of schedules duly filled in the rates in figures and in words and each schedule duly signed. Any schedule not bearing the signature of the Tenderer, the tender is liable to be rejected. Rates quoted for each item of work should be reasonable. Only one rate should be quoted for each item of work. In case dual rates are quoted the offer is likely to be rejected. Tenderers should not offer rates for items not covered in the schedules and also should not split any item of the schedule, doing so, may disqualify the offer. Discount on any account such as quantitative discount, payment discount etc., will not be considered. As such, rate should be on firm quotation basis only.

18. Special attention is invited to the requirements that all corrections must be initialed and dated by the tenderer and that all the pages should bear the full signature of the tenderer at the foot of each page and each schedule should bear the seal of the tenderer.

19. Tenders which do not fulfill all or any of the above conditions or incomplete in any respect are liable to be rejected

20. The submission of a tender by a tenderer implies that he has read these instructions the conditions of contract etc. After acceptance of the offer we shall not pay any extra charges for the lead or for any other reasons in case the Tenderer is found later on to have misjudged himself.

21. Tenders shall remain open for acceptance for a period of 90 days from the date of opening of the tender. During this period no tenderer shall be allowed to withdraw his offer. Any such withdrawal during the said period will entail forfeiture of the Earnest Money deposited with us.

22. The Tenderer should furnish details of his organization, technical experience, equipment and financial capacity to carry out the works set out in the tender within the time stipulated for completion. He shall furnish details of value of works, authority under whom it was executed and period of completion, during the past three years.

23. General conditions of the Annual Work Contract are as per Annexure "I" which shall form part of the contract.

24. The right to reject any or all the offers is reserved by us and we will not be bound to accept any offer without as signing any reason thereof.

25. Tenderers shall submit his offer in the form of tender the schedule of quantities and rates, and other schedules duly signed. Any tender not bearing signature of the Tenderer on all the documents accompanying the tender is liable to be rejected.

26. Before submitting his tender the tenderer shall examine closely the specifications and carefully study all documents.

27. The tenderer is requested to visit the site of work and for himself the site conditions regarding approaches, material, transportation labour etc. and all the other matter affecting the work, before filling in the tender. The tenderer is further requested to study the specifications to the tender and then submit his offer. The Company shall not, however, after acceptance of the contract rate pay any extra charges for lead or for any other reasons in case the contractor is found later as to have misjudged himself.

28. The firm/contractor must arrange for all transport of material and include all such cost in the rates quoted by them for work.

29. The schedule of quantities as indicated in this tender are approximate deletions or additions could be possible while finalizing the Tender.

30. The tenderer should furnish information regarding the works of above nature carried out by him/them in any other department and submit copies of certificates in proof thereof.

31. The Tenderer will have to submit solvency certificate from Nationalized Bank to the extent of 50% of value of the Tender.

32. The Sale Tax / Any Other Tax on material or on transfer of property in goods involved in the execution of work contract or any other material or on furnished any fabricated material or work shall not be separately paid as an addition to the Tender rates by the Company. The rates for several items of work indicated are deemed to include all local and general taxes, excise duty etc. Tenderer should attach a certified photocopy of Sales Tax / Any Other Tax Registration certificate.

33. A copy of work contract registration should be enclosed if not the Work contract tax as specified by the Government will be deducted directly from Contractor’s bill.

34. Any part of the contract shall not be sublet without the written permission of the Superintending Engineer or his authorized representative.

Further information required, if any, can be had from the Office of the Superintending Engineer, but it must be clearly understood that the tenders must be received by the due date and time and according to the instructions.

35. These instructions shall also form a part of the contract.

Envelope No. 1: Qualifying bid shall have following documents

  2. VAT / Service Tax registration copy

  4. Experience certificate regarding completion of said type of work amounting to Rs.5 lacs or more in one calendar year.
  5. Solvency certificate of 50% of value of Tender issued by Nationalized bank
  6. Copy of receipt regarding payment of E.M.D

Envelope No.2:

1) Price Bid shall have only Tender Document properly filled,

quoting your rates.

2) If acceptable the Tenderer may give his consent to work

at lowest parallel rate.

Initially while opening the Tenders, the envelope No.1 i. e Qualifying Bid will be opened first. The price Bids of only those bidders who have qualified in the qualifying Bid will be opened. For qualification all the documents mentioned above are required.

SPECIAL CONDITIONS OF CONTRACT

These special conditions of contract supplement the instructions to tenderers are as part of the contract and where the provisions are at variance with the instructions these conditions shall prevail. The requirements and special conditions of the contract shall prevail although they may be at variance with these “special conditions of the contract”.

1) Name of work : Erection and maintenance of H.T./ L.T.poles, fixing of fabrication material and stringing of lines.

2) Location of work : Thane Corporation, covering Geographical area of Wagle Estate Division / Kalwa

O&M Division.

3) Period of completion : The work is for the period of twelve months from the date of work order.

4. Residential arrangements of the workmen and personnel shall be made by the contractor himself.

5. Local disturbance, if any, on account of the Local people shall be dealt with by the Contractor.

6. All the tools and tackles required for the work shall be arranged by the Contractor.

7. Protection to the equipment and personnel of the Contractor will be his own responsibility.

8. The company is neither responsible for any accident to the workers of the contractor nor any compensation for the accident will be paid by the company.

9. Contractor shall make his own arrangements for water supply as and when required during course of work.

10. Departmental supply of material:

Departmental supply of material will be confined only to those items specifically mentioned in Annexure "A" of the contract. The material will be issued at the Company’s stores as stated in Annexure "A" and the contractor shall make his own arrangement for the transport of the material including loading, unloading etc. from the stores to the actual place of work. The material to be supplied by the Company will be supplied in standard lengths and packing for the works.

The contractor will be responsible for the safe custody of all the material issued to him by the Company and will be required to tender proper account of utilization of the material. The contractor shall return the un-used material from the balance of total material issued to him. In case he is unable to account for the full quantities of material issued to him, recoveries will be effected from him at cost rates prevailing at the time of issue plus 15% to cover Company departmental supervision charges for all material unaccounted for.

The Company will not be responsible for any delay in supply of Annexure "A" material while it will endeavor to see that no delay occurs on this account. Any delay in supply of material from the Company will, however, be given due consideration in granting extension of time for the completion of the work, if found necessary. No claim for compensation for delay for idle time of labour will be entertained on this account.

All the material mentioned in Annexure "B" required for the work shall be supplied by the contractors at his own cost. Recommendations to authorities where required may be made by the Company but the responsibility for the supply of the material shall be that of the contractor and no excuse on this account for delay in the completion of work shall be accepted.

The material required for works shall be drawn from the Division's stock by requisition given in writing by the contractor at least one week before erection of the equipment .

10. Tools, Plants and Machinery : All construction tools, plant and machinery as required for the work shall be provided by the contractor for construction and maintenance works.

11. Time is the essence of the contract : Time being the essence of the contract, various items of works shall be completed in accordance with the work time program decided by the Engineer-in-charge which shall form part of the contract. The time shall be reckoned from the date of issue of the work-order. The contractor shall proceed with the same with due efficiency as ordered by the Engineer-in-charge.

12. Stacking of Material : The material shall be stacked only at the approved place and without obstruction to other work and no extra payment for any additional leads etc. will be admissible for transport of such material to actual place of use.

13. Payment : Payments will be made monthly in reasonable time on submission of bills by the contractor for all approved works executed in the previous month after proper measurements.

14. Income Tax: In accordance with the provisions of Income Tax Act 1961 deduction on Income-Tax as applicable in this Act of gross amount payable shall be made from contractors bills. Such deductions shall not be made in the event of contractor being able to produce necessary exemption certificate from appropriate authorities of Income-tax department.

15. Execution of work during Monsoon : Work will have to be commenced as soon as the work order is issued and site is handed over to the contractor and executed even during the monsoon period. The rates quoted for various items under Schedule Part I to Part III shall be deemed to be inclusive of all arrangements and material required thereof for executing the work during monsoon. No extra claim whatsoever on this account shall be payable to the contractor.
