Long Creek Watershed Management District Governing Board

Minutes: January 27, 2016 – 9:30 a.m.

Location: Maine Turnpike Authority Administration Building

1)Call to order: Mr. Bacon called the meeting to order at 9:33 am.

2)Roll call:Dan Bacon, Tom Blake (absent), Curtis Bohlen, John Branscom, Arthur Colvin, Fred Dillon, Brian Goldberg, Craig Gorris, Peter Newkirk, Adam Pitcher (absent), Ed Palmer (absent), Doug Roncarati, Michael Vail

3)Minutes September 30, 2015 (Attachment A):

a)Motion to approve the minutes with amendments made by Mr. Roncarati, seconded by Mr. Bohlen,motion carried.

4)Treasurer’s Report:

a)Mr. Bohlen reviewed the reports and summaries included in the financial report. Budget comparison is on track.

b)Mr. Brewer spoke with Alison Moody at DEP regarding the past due balances for CPSP and Corner Brook. Alison is meeting with the DEP enforcement attorney on January 27thand will provide Mr. Brewer an update.

5)Spring Street/Cummings Road

a)Long Term Maintenance for the 6 BMPs is estimated to be $3,610 annually. All of the proposed BMPs are in the South Portland section of the road. Replacement plants should be included in the budgets for replacement if plants die off. Portland is having luck with lilacs on residential roads. Ornamental grasses can also be used in the esplanade boxes.

b)Mr. Katsiaficas recommended that the Board enter into a letter of agreement with the City of South Portland and Maine DOT to provide maintenance. A few of the BMPs are on private properties and will require BMPs easements, one parcel is a Participating Landonwer and the other a private owner. We need to define through these documents who will maintain the structural portions of these assets.

c)Mr. Roncarati made a motion to authorize Mr. Katsiaficas to developthe letters of agreement and the appropriate easements to take on the maintenance of these BMPs, with the exception that of the City of South Portland will be responsible for the structural component maintenance and replacement, the motion was seconded by Mr. Bohlen and the motion carried.

6)Fairchild Semiconductor Expansion

a)Fairchild Semiconductor is currently designing an expansion on the Foden Road side of the property to install a chemical storage building and three bioretention cells. The design is being done by Sebago Technics and will be reviewed by Long Creek. Fairchild will be designing and installing the BMPs. In the future, they may be asking LCWMD to assume maintenance of the BMPs or to receive credits for the installation of the assets. The Management Plan could be updated to take over maintenance of the BMPs, as an opportunistic installation.

7)Budget Approval

a)FY 2016 Update:Mr. Bohlen and Mr. Brewer presented the suggested updates to the FY 2016 Budget that reflect the accurate costs, based on the mid-year review of the budget.

b)Approve FY 2017 Budget:Mr. Bohlen and Mr. Brewer presented and reviewed the Fiscal Year 2017 Budget, and the estimated five-year budget with estimated cash flows. A motion was made to approve the budget by Mr. Gorris, seconded by Mr. Bohlen. The motion carried with 9 members voting yes and one-member abstaining.

8)Team Update:

a)Contract Check-In: Mr. Brewer presented the Contract Check in list. All contracts are performing as expected.

b)Parcel Inspection Outreach: Mr. Reynolds will be preparing the letters to landowners reviewing their parcel inspection outcomes in February.

c)Main Stem Restoration Update: Mr. Savage provided a summary of the restoration project. The restoration site is the section of the Main Stem between Maine Mall Road and Foden Road. The project outline was recommended by the Expert Review Panel and will reconnect this section of the stream to its flood plain, and two retrofits will also take place to remove detention ponds behind Guitar Center and Corner Brook. Zach Henderson is currently working on the initial cost estimate for this project.

d)Landowner Update:

i)CarMax: CarMax has officially taken over as the Participating Landowner for the parcel. Construction is expected to start after spring snow melt. CarMax has agreed to install pervious sidewalks.

ii)Berlin City: Berlin City leases their corner parcel from GGP and recently brought the parcel up to Chapter 500 standards. They are exploring changing over to an individual permit. If they do, this 1-acre parcel will be removed from the Long Creek General Permit.

iii)Monitoring RFQ Update: The RFQ was posed on January 4, 2016. We did receive questions from potential bidders, so an Addendum was posted on January 20, 2016. The RFQs are due on January 29, 2016. The Board Representatives to the committee will be Peter Newkirk, Fred Dillon and Curtis Bohlen.

iv)Staff Changes:

(1)Troy Barry recently joined the Cumberland County Soil and Water Conservation District as the District Engineer. Troy has more than 20 years of experience in civil and environmental engineering and science with a focus on fluvial geomorphology, stream ecology, overland flow analysis, and watershed hydraulics and hydrology analysis. He has extensive experience in watershed assessments and planning, stormwater treatment systems modelling and design, and developing erosion and sedimentation control plans.

(2)Jennie Franceschi announced that she will be leaving the CCSWCD in February. Jennie has been offered her dream job with the City of Westbrook as the Director of Planning and Code Enforcement. She thanked the Board for the opportunity to work with them on the Long Creek Project.

10)Next meeting: The next meeting will be held on February 24, 2016at 9:00 am at the Town of Scarborough Municipal Office.
