NOTICE OF BALLOT

PROPOSED PROPERTY OWNER BUSINESS IMPROVEMENT DISTRICT FOR

Piccadilly & St James’s

This is a formal notice of a ballot to be held on the proposal of the Heart of London Alliance to introduce a Property Owner Business Improvement District (PO BID) for Piccadilly & St James’s.

The ballot holder will be Charlie Parker the Chief Executive and Returning Officer for Westminster City Council and the ballot will be conducted entirely by post by The Electoral Reform Services, (ERS) 33, Clarendon Road, London N8 0NW. Ballot papers will be sent to those eligible to vote on or before Monday 18 May 2015 for return to the ERS to arrive no later than 5pm on Thursday 18th June 2015 (the ‘day of the ballot’).

Who can vote in the ballot?

Persons eligible to vote in the ballot will be the property owner defined as the first lessee, above the rateable occupier of a lease granted for a term of more than 75 (seventy five) years, in the absence of a relevant lessee, the freeholder; where the rateable occupier is the first lessee or the freeholder then the rateable occupier shall also be liable for the PO BID, as listed on the Council’s database situated in the geographical area of the proposed PO BID as at the date of this Notice.

Each person entitled to vote in this ballot shall have one vote in respect of each hereditament occupied owned by them within the defined geographical area of the proposed BID (see list of streets below).

Appointment of proxies

Persons eligible to vote in the ballot may appoint someone else to vote on their behalf (for example if you are going to be away at the time of the ballot).

Applications to appoint a proxy can be obtained by contacting ERS at the above address or telephoning 020 88899203

Applications must be submitted to the Electoral Reform Society at the above address to arrive no later than 5pm on Monday 8th June 2015.

Alternatively, you can arrange for the ballot paper to be sent to someone else within your business/organisation so long as that person is located at either the address of the hereditament (business premise) itself within the BID area, or at your principal place of business.

You can do this by writing to ERS at the above address with the name and address of the person to whom the ballot paper should be sent with the details of their position in your business/organisation.

Lost ballot papers

Ballot papers will be sent to those who are eligible to vote on or before Monday 18 May 2015. If you (or your proxy if you appoint one) have not received your ballot paper by Friday 12 June 2015, you may apply to ERS for a replacement paper, providing evidence of your identity.

Spoilt ballot papers

If you inadvertently spoil your ballot paper in such a manner that it cannot be conveniently used as a ballot paper, please return it to ERS at the above address. On receipt of the spoilt ballot paper, a replacement will be issued. No replacements can be issued if the spoilt ballot paper is received on or after Monday 15 June 2015.

Count of ballot papers

Ballot papers will be counted after the close of poll 5.00 p.m. on Thursday 18 June 2015 and the result will be available on Friday 19 June 2015. For the proposal to be successful, there must be a majority of those voting in favour of the proposal, both in terms of the numbers voting and also the rateable value represented by those voting.
