Limitation of Liability, Waiver, and Indemnity Agreement
For and in consideration of permitting (“Participant”) to enroll in and participate in the Bishop Alemany High School Summer Camp organized and sponsored by Bishop Alemany High School, the Undersigned hereby voluntarily releases, discharges, waives and relinquishes (hereinafter “Waiver”) any and all actions or causes of action for personal injury, property damage or wrongful death (hereinafter “All Claims”) occurring to the Participant arising out of the participation in the Camp or any activities incidental thereto wherever or however the same may occur and for whatever period said activities may continue, and the Undersigned does participate for himself/herself, his/her heirs executors, administrators and assigns hereby release, waive, discharge and relinquish any action or cause of action, aforesaid, which may here-after arise fro himself/herself and for his/her heirs, executors, administrator’s or assigns shall not present or prosecute any claim for personal injury, property damage or wrongful death against Bishop Alemany High School and the officers, employees, volunteers and agents of each of them (hereinafter referred to as “Releasees”) for any said cause of action whether the same shall arise by the ordinary or gross negligence, whether active or passive, of any of said persons or otherwise. This WAIVER shall not apply to any benefits that may be provided under the Supplemental Insurance described in this agreement. Any benefits provided by the Supplemental Insurance shall be the limit of the Releasees liability for ALL CLAIMS.
The Undersigned acknowledges, understands and assumes the risks inherent in participating in the Camp and understands the activities include sports, interactions with other campers, counselors, and other physical activity that entails risks to the participants and property and the Undersigned is allowing Participant to participate with full knowledge of said risks.
The Undersigned acknowledges, understands and assumes the risk, if any, arising from the conditions of the various courts, fields, rooms, facilities, pool, and parking lots and acknowledges and understands that included within the scope of said waiver and release is any action or causes of action arising from the performance, or failure to perform, maintenance, inspection, training, supervision, control, or security of said area and for the failure to warn of dangerous conditions existing on or near said locations or for any action or causes of action for negligent supervision or selection of officials, counselors, administrators, or any campers.
In case of medical emergency, sickness, accident or injury the Undersigned gives the Camp immediate permission to seek emergency medical attention for the Participant. The Undersigned further agrees that Releasees are not legally liable for any claim from any consent given in good faith in connection with such diagnosis or advised treatment. This authorization and consent to treatment of the Participant is given to the Camp in conjunction with any activity.
IT IS THE INTENTION OF YOU ON BEHALF OF PARTICIPATION TO RELEASE RELEASEES FROM LIABILITY FOR ALL CLAIMS (WHICH INCLUDES PERSONAL INJURY, PROPERTY DAMAGE AND WRONGFUL DEATH) CAUSED BY EITHER ORDINARY OR GROSS NEGLIGENCE, WHETHER ACTIVE OR PASSIVE, WITH THE EXCEPTION OF ANY BENEFITS THAT MAY BE PROVIDED BY THE SUPPLEMENTAL INSURNACE DESRIBED IN THIS AGREEMENT.
The Undersigned acknowledges that he/she has read the forgoing paragraphs containing the Waiver, Release and Indemnity Agreement, has been fully and completely advised concerning same, is fully aware of the legal consequences of signing this document, and is the legal guardian or parent of Participant.
