INTRODUCTION
Thisintroductionisnotpartofthelicenceanddoesnotpurporttobealegalinterpretationofthelicence.
MurrayWasteRecyclingLimitedhasoperatedawasterecoveryfacilityatCoolatore,Ferns,CountyWexfordsince2005.ThefacilitywaspreviouslyregulatedunderawastefacilitypermitissuedbyWexfordCountyCouncil(WP/08/23)andauthorisedtoaccept21,000tonnesofwasteperannum.Thislicenceauthorisesthefacilitytoaccept24,500tonnesperannumofwasteincludingmixeddry recyclables,recyclables,segregatedmunicipalbiowaste,municipalsolidwasteandconstruction& demolitionwaste.
Thefacilityislocatedinanagriculturalareaandisborderedonallsidesbyagriculturallandexcepttothenorthandnortheastwhereapproximatelyfiveresidentialpropertiesarelocatednexttothefacility.Theclosestresidentialpropertyislessthan25metresfromthefacility.Adrainrunsalongthenorthern boundaryofthefacilityandstormwaterrun-offisdischargedhere.
Therearenoprocessemissionstowaterorsewerfromthefacility.Washdown water from therecyclingbuildingwillbecollected inanundergroundstoragetankandtankeredoff-sitetoanagreedwastewatertreatmentplant.
Thelicenseemustmanageandoperatethefacilitytoensurethattheactivitiesdonotcauseenvironmentalpollution.The licenseeisrequiredtocarryoutregularenvironmentalmonitoringandsubmitallmonitoringresults,andawiderangeofreports ontheoperationandmanagementofthefacility,totheAgency.
ThelicencesetsoutindetailtheconditionsunderwhichMurrayWasteRecyclingLimited,willoperateandmanagethisfacilityatCoolatore,Ferns,CountyWexford.

TheEnvironmentalProtectionAgencyissatisfied,onthebasisoftheinformationavailable,thatsubjecttocompliancewiththeconditionsofthislicence,anyemissionsfromtheactivitywillcomplywithandwillnotcontraveneanyoftherequirementsofSection40(4)oftheWasteManagementActs1996 to2011.
InreachingthisdecisiontheEnvironmentalProtectionAgencyhasconsideredtheapplication,supportingdocumentationandobjectionreceivedfromtheapplicantand thereportsofits inspectors.

PartIIIConditions
Condition1.Scope
1.1WasteactivitiesatthisfacilityshallberestrictedtothoselistedanddescribedinPart IScheduleofActivitiesLicensed,andshallbeassetoutinthelicenceapplicationorasmodified underCondition1.4ofthislicenceandsubjecttotheconditionsofthislicence.
1.2ActivitiesatthisfacilityshallbelimitedassetoutinScheduleA:Limitations,ofthislicence.
1.3Forthepurposesofthislicence,thefacilityistheareaoflandoutlinedinredonDrawingNo.Ce07-253-01-206RevisionAoftheapplication.Anyreferenceinthislicenceto“facility”shallmeantheareathusoutlinedinred.Thelicensedactivitiesshallbecarriedononlywithintheareaoutlined.
1.4Noalterationto,orreconstructioninrespectof,theactivity,oranypartthereof,thatwould,orislikelyto,resultin
(i)amaterialchangeorincreasein:
•thenatureorquantityofanyemission;
•theabatementltreatment orrecoverysystems;
•therangeofprocessestobecarriedout;
•the fuels, raw materials, intermediates, products or wastesgenerated,or
(ii)anychangesin:
•sitemanagement,infrastructureorcontrolwith adverseenvironmental significance;
shallbecarriedoutorcommencedwithoutpriornoticeto,andwithouttheagreementof,theAgency.
1.5Thefacilityshallbecontrolled,operatedandmaintained,andemissionsshalltakeplaceassetoutinthelicence.Allprogrammesrequiredtobecarriedoutunderthetermsofthislicencebecomepartofthislicence.
1.6Thislicence isforpurposesofwastelicensingunderthe WasteManagementActs 1996to2011onlyandnothinginthislicenceshallbeconstruedasnegatingthelicensee’sstatutoryobligations,orrequirementsunderanyotherenactmentsorregulations.
1.7WasteAcceptanceFloursandHoursofOperation
1.7.1WiththeexceptionofemergenciesorasmaybeagreedbytheAgency,thewastefacilityshallbeoperatedonlybetweenthehoursof0630and2100MondaytoSaturdayinclusive.Duringnight-timehours,alloperationsshalltakeplaceindoors.
1.7.2Withtheexceptionofemergenciesorasmaybeagreedby the Agency,wasteshallbeacceptedatordispatchedfromthefacilityonlybetweenthehoursof0800and2000MondaytoSaturdayinclusive.
1.7.3Thefacilityshallnotoperateor accept/dispatchwasteonSundays or onPublicHolidaysunlessagreedbytheAgency.
Reason:Toclarifythe scopeofthislicence.

Condition2.ManagementoftheFacility
2.1FacilityManagement
2.1.1Thelicenseeshallemployasuitablequalifiedandexperiencedfacilitymanagerwhoshallbedesignatedasthepersonincharge.Thefacility manageroranominated,suitablyqualifiedandexperienceddeputyshallbepresentonthefacilityatalltimesduringitsoperationorasotherwiserequiredbytheAgency.
2.1.2Thelicenseeshallensurethatpersonnelperforming specifically assignedtasksshallbequalified onthebasis ofappropriateeducation,trainingandexperienceasrequiredandshallbeawareoftherequirementsofthislicence. Inaddition,thefacilitymanagerandhis/herdeputyshallsuccessfullycompleteaFASwastemanagementtrainingprogrammeoraCertificateinCompostFacilityOperation orequivalentagreedbytheAgency.
2.2Environmental ManagementSystem(EMS)
2.2.1ThelicenseeshallestablishandmaintainanEnvironmentalManagementSystem(EMS)withinsixmonthsofthedateofgrantofthislicence.TheEMSshallbeupdatedonanannualbasis.
2.2.2TheEMSshallinclude,asaminimum,thefollowingelements:
2.2.2.1ManagementandReportingStructure.
2.2.2.2ScheduleofEnvironmental ObjectivesandTargets
ThelicenseeshallprepareandmaintainaScheduleofEnvironmentalObjectivesandTargets.Thescheduleshallas aminimumprovideforareviewofalloperationsandprocesses,includinganevaluationofpracticableoptionsforenergyandresourceefficiency,theuseofcleanertechnology,andtheprevention,reductionand minimisation of waste for disposal.Thescheduleshallincludetimeframesfortheachievementofsettargetsandshalladdressafiveyearperiodasaminimum. Inrelation to waste recovery the schedule shall include aninitialwasterecoverytargetofwastethroughput,aswellastimeframes forachievinghigherrecovery targets.Asaminimumthis shall include specificobjectives forthe control and minimisationaswellasanannualreviewofthedustandnoisenuisancepotentialofthesiteactivities.Thescheduleshallbereviewed annuallyand amendments thereto notifiedtotheAgencyforagreementaspartoftheAnnualEnvironmental Report(AER).
2.2.2.3Environmental Management Programme(EMP)
Thelicenseeshall,notlaterthansixmonthsfromthedateofgrantofthislicence,submittotheAgencyforagreementanEMP,includingatimeschedule,forachievingtheEnvironmentalObjectivesandTargetspreparedunderCondition2.2.2.2.OnceagreedtheEMPshallbeestablishedandmaintainedbythelicensee. Itshallinclude:
•designationofresponsibility fortargets;
•themeansbywhichtheymaybeachieved;
•thetimewithinwhichtheymaybeachieved.
TheEMPshallbereviewedannuallyandamendmentstheretonotifiedtotheAgencyforagreementaspartoftheAnnual EnvironmentalReport(AER).

Areportontheprogramme,includingthesuccessin meetingagreedtargets,shallbepreparedandsubmittedtotheAgencyaspartoftheAER.Suchreportsshallberetainedon-siteforaperiod ofnotlessthansevenyearsandshallbeavailableforinspectionbyauthorisedpersonsoftheAgency.
2.2.2.4Documentation
(i)Thelicenseeshallestablishand maintain an environmentalmanagementdocumentationsystemwhichshallbetothesatisfactionoftheAgency.
(ii)Thelicenseeshallissueacopyofthislicencetoallrelevantpersonnelwhosedutiesrelatetoanyconditionofthislicence.
2.2.2.5CorrectiveAction
Thelicenseeshallestablishprocedurestoensurethatcorrectiveactionistakenshouldthespecifiedrequirementsofthislicencenot befulfilled.Theresponsibilityandauthorityforpersonsinitiatingfurtherinvestigationandcorrectiveactioninthe event of areportednon-conformitywiththislicenceshallbedefined.
2.2.2.6AwarenessandTraining
Thelicenseeshall establish and maintain procedures foridentifying trainingneeds,and forproviding appropriatetraining,forallpersonnelwhoseworkcanhaveasignificanteffectupontheenvironment.Appropriaterecordsoftrainingshallbemaintained.
2.2.2.7Communications Programme
ThelicenseeshallestablishandmaintainaPublicAwarenessandCommunicationsProgrammetoensurethatmembersofthepubliccanobtaininformationatthefacility,atallreasonabletimes,concerningtheenvironmentalperformance ofthefacility.
2.2.2.8Maintenance Programme
Thelicenseeshallestablishandmaintainaprogrammeformaintenanceofallplantandequipmentbasedontheinstructionsissuedbythemanufacturer/supplierorinstalleroftheequipment.Appropriaterecordkeepinganddiagnostic testing shall supportthis maintenanceprogramme.Thelicenseeshallclearlyallocateresponsibilityfortheplanning,managementandexecutionofallaspectsofthisprogrammetoappropriatepersonnel (seeCondition
2.1above).
2.2.2.9EfficientProcessControl
Thelicenseeshallestablishandmaintainaprogrammetoensurethereisadequatecontrolofprocessesunderallmodesofoperation.Theprogrammeshallidentifythekeyindicatorparametersforprocesscontrolperformance,aswellasidentifyingmethodsformeasuringandcontrollingtheseparameters.Abnormalprocessoperatingconditionsshallbedocumented,andanalysedtoidentify anynecessarycorrectiveaction.
Reason:Tomakepro visionfor managementoftheactivityonaplanned basishavingregardtothedesirabilityofongoingassessment,recordingandreportingofmattersaffectingtheenvironment.

Condition3.Infrastructure andOperation
3.1SpecifiedEngineeringWorks
3.1.1ThelicenseeshallsubmitproposalsforallSpecifiedEngineeringWorks,asdefinedinScheduleD:SpecfiedEngineeringWorks,ofthislicence,totheAgencyforitsagreementatleasttwomonthsinadvanceofthe intended dateofcommencementofanysuchworks. NosuchworksshallbecarriedoutwithouttheprioragreementoftheAgency.
3.1.2Allspecifiedengineeringworksshall be supervised by a competentperson(s)and thatperson,orpersons,shall bepresentatalltimesduringwhichrelevantworksarebeingundertaken.
3.1.3Followingthecompletionofallspecifiedengineeringworks, the licenseeshallcompleteaconstructionqualityassurancevalidation.ThevalidationreportshallbemadeavailabletotheAgencyonrequest.Thereportshall,asappropriate,includethefollowinginformation:
(i)Adescriptionoftheworks;
(ii)As-builtdrawingsoftheworks;
(iii)AnyotherinformationrequestedinwritingbytheAgency.
3.2FacilitySecurity
3.2.1Securityandstockprooffencingandgatesshallbeinstalledandmaintained.
Thebaseofthefencingshallbesetintheground.SubjecttotheimplementationoftherestorationandaftercareplanandtotheagreementoftheAgency,therequirementforsuchsitesecuritymayberemoved.
3.2.2ThelicenseeshallinstallaCCTVsystemwhichrecordsalltruckmovementintoandoutofthefacility;theCCTVsystemshallbeoperatedatalltimesandcopiesofrecordingkeptonsiteandmadeavailabletotheAgencyonrequest.
3.2.3Gatesshallbelockedshutwhenthefacilityisunsupervised.
3.2.4Thelicenseeshallremedyanydefectinthegatesand/orfencingasfollows:
(i)Atemporaryrepairshallbemadebytheendoftheworkingday;and
(ii)Arepair tothestandard oftheoriginal gatesand/orfencingshallbeundertakenwithinthreeworkingdays.
3.3FacilityRoadsandSiteSurfaces
3.3.1Effectivesiteroadsshallbeprovided andmaintainedtoensurethesafeandnuisance-freemovementofvehicleswithinthefacility.
3.3.2Thelicenseeshallprovideandmaintainanimpermeableconcrete surfaceintheareasofthefacilityshownonDrawingNo.Ce07-253-0l-206RevisionA;thesurfacesshallbeconcretedandconstructedtoBritishStandard8110oranalternativeasagreedbytheAgency.Thelicenseeshallremedyanydefectinconcretesurfaceswithinfiveworkingdays.
3.4FacilityOffice
3.4.1Thelicenseeshallprovideandmaintainanofficeatthefacility.Theofficeshallbeconstructedandmaintainedinamannersuitablefortheprocessingandstoringofdocumentation.
3.4.2Thelicenseeshallprovideandmaintainaworkingtelephoneandamethod forelectronictransferofinformationatthefacility.

3.5FacilityNoticeBoard
3.5.1Thelicenseeshall,withinonemonthofthedate ofgrantofthis licence,provideaFacilityNoticeBoardonthefacilitysothatitislegibletopersonsoutsidethemainentrancetothefacility.Theminimumdimensionsoftheboardshallbe 1200mmby750mm.Thenoticeboardshallbemaintained thereafter.
3.5.2Theboardshallclearlyshow:
(i)thenameandtelephonenumberofthefacility;
(ii)thenormalhoursofopening;
(iii)thenameofthelicenceholder;
(iv)anemergencyoutofhourscontacttelephonenumber;
(v)thelicencereferencenumber;and
(vi)where environmental information relating to the facility can beobtained.
3.5.3A planofthefacilityclearlyidentifyingthelocationofeachstorageandtreatmentareashallbedisplayedascloseasispossibletotheentranceto thefacility.Theplanshallbedisplayedonadurablematerial suchthatislegibleatalltimes.Theplanshallbereplaced asmaterialchangestothefacilityaremade.
3.6WasteInspectionandQuarantineAreas
3.6.1AWasteInspectionAreaandaWasteQuarantineAreashallbeprovidedandmaintainedatthefacility.
3.6.2Theseareasshallbeconstructed andmaintainedinamannersuitable,andbeofasizeappropriate,fortheinspectionofwasteandsubsequentquarantineifrequired.Thewasteinspectionareaandthewastequarantineareashallbeclearlyidentifiedandsegregatedfromeachother.
3.6.3Drainagefromtheseareasshallbedirectedtothe“draintocollectleachate/washwater”shownonDrawingNo.Ce07-253-0l-206 RevisionA.
3.7WeighbridgeandWheelCleaners
3.7.1Thelicenseeshallprovideandmaintainaweighbridgeand a means ofwheelcleaningatthefacility.
3.7.2Thewheelcleanersshallbeusedbyallvehiclesleavingthefacilityasrequiredtoensurethatnotradeeffluentlstormwaterorwasteiscarriedoff-site.Allwaterfromthewheelcleaningareashallbedirectedtothetradeeffluentdrainagenetwork.
3.7.3Thewheel-wash shallbeinspectedonadailybasisanddrainedasrequired.
Silt, stones and other accumulated material shall be removed asrequiredfromthewheel-washanddisposedofappropriately.
3.8Wastehandling,ventilationandprocessingplant
3.8.1Itemsofplantdeemedcriticaltotheefficientand adequateprocessingofwasteatthefacility(includinginteraliawaste-loadingvehiclesandejectortrailers)shallbeprovidedonthefollowingbasis:
(i)100%dutycapacity;
(ii)20%standbycapacityavailableonaroutinebasis;and
(iii)Provisionofcontingency arrangements and/orbackup andsparesinthecaseofbreakdown ofcriticalequipment.

3.8.2Withinthreemonthsfromthedateofgrantofthislicence,thelicenseeshallprovideareportfortheagreementoftheAgencydetailingthedutyandstandbycapacityintonnesperday,ofallwastehandlingand processingequipmenttobeusedatthefacility.Thesecapacitiesshallbebasedonthelicensedwasteintake,asperScheduleA:Limitations,ofthislicence.
3.8.3Thequantityofwastetobeacceptedatthefacilityonadailybasisshallnotexceedthedutycapacityoftheequipmentatthefacility.Anyexceedanceofthisintakeshallbetreatedasanincident.
3.9WastewaterTreatmentSystem
3.9.1Thelicenseeshallprovideandmaintain aWastewater Treatment plant at thefacilityforthetreatmentofsanitaryeffluentarisingon-site.Anywastewatertreatmentsystemandpercolationareashallsatisfythecriteriasetout intheCodeofPracticeWastewaterTreatmentandDisposalSystemsServingSingle1-louses(p.e10),published by the EnvironmentalProtectionAgency.Thelicenseeshallprovideevidenceofcompliancewiththisconditionwithin 12monthsofthedateofgrantof thislicence.
3.9.2Awash-downwatercollectionsystemandstoragetank shallbeinstalled withinsixmonths ofthedateofgrantofthislicence.Washdownwater fromtherecyclingbuildingstoredin theon-sitestoragetank(s)shallbetankeredoff-siteinfullyenclosedroadtankerstoanagreedWastewater TreatmentPlantoralternativefacilityanddisposedofthere.
3.10TimberandConstructionDemolitionWasteRecoveryArea(s)
3.10.1Withinsixmonthsofthedateofgrantofthislicence,thetimberandconstructiondemolitionwasterecoveryareashallataminimumcomprisethefollowing:
(i)animpermeableconcreteslab;
(ii)collectionanddisposalinfrastructureforallrun-off,
(iii)appropriatebundingtoprovidevisualandnoisescreening;
(iv)appropriate arrangements on operating equipment to contain andrestrictdustemissions;and
(v)containmentofallstockpilestominimisedustgeneration.
3.10.2Onlytimberandconstructiondemolitionwasteshallbeacceptedatthisarea.Wastesthatarecapableofbeingrecoveredshall be separated andstoredtemporarilyinthisareainadvanceofbeingsubjectedtootherrecoveryactivitiesatthefacilityortransportoffthefacility.
3.11Monitoring InfrastructureGroundwater
Groundwater monitoring wells shall be constructed having regard tothe guidancegivenintheAgency’slandfillmanual“LandfillMonitoring”.
3.12Dust/OdourControl
3.12.1Withintwelvemonthsofthedateofgrantofthislicence,thelicenseeshallinstallandprovideadequatemeasuresforthecontrolofodoursanddustemissions,including fugitive dustemissions,fromthe facility. Installationofanodouranddustmanagementsystemshallataminimumincludethefollowing:
(i)Dustcurtains(orequivalentapprovedbytheAgency)shall bemaintainedontheentry/exitpointsfromthewastetransferbuilding;allotherdoorsinthisbuildingshallbekeptclosedwherepossible.

(ii)UnlessotherwiseagreedbytheAgency,allbuildingsusedforstoringorprocessingputresciblewasteshallbemaintainedatnegativeairpressure.
(iii)Provisionof100%dutycapacityand20%standbycapacity,backupsandsparesmustbeprovidedfortheairhandling,ventilationandabatementplant.
3.13UnlessotherwiseagreedbytheAgency,andonfootofanassessmenttobepreparedwithin20monthsofthe dateofgrantofthislicenceoftheneed forabiofilterorotherairabatementequipment,thelicenseeshallprovideandmaintain,within24monthsofthedateofgrantofthislicence,abiofilterorsuitablealternativeforthetreatmentofextractedairfrombuildingsusedforstoringorprocessingputresciblewaste.
3.14Thelicenseeshallprovideanduseadequatelightingduringtheoperation ofthefacilityinhoursofdarkness.
3.15Thelicenseeshallestablishandmaintain,foreachcomponentofthefacility,allinfrastructurereferredtointhislicenceinadvanceofthecommencementofthelicensedactivitiesinthatcomponent,orasrequiredbytheconditionsofthislicence.Infrastructurespecifiedintheapplicationthatrelatestotheenvironmentalperformanceoftheinstallationandisnotspecifiedinthelicence,shallbeinstalledinaccordancewiththeschedulesubmittedintheapplication.
3.16Thelicenseeshallinstallonallemission pointssuchsamplingpointsorequipment,includinganydata-loggingorotherelectroniccommunicationequipment,asmayberequiredbytheAgency.Allsuchequipmentshallbeconsistentwiththe safeoperationofallsamplingandmonitoringsystems.
3.17Inthecaseofcompositesamplingofaqueousemissionsfromtheoperationofthefacility,aseparatecompositesampleorhomogeneoussub-sample(ofsufficientvolumeasadvised)shallberefrigeratedimmediatelyaftercollectionandretainedasrequiredforEPAuse.
3A8Thelicenseeshallclearlylabelandprovidesafeandpermanentaccesstoallon-sitesamplingandmonitoringpointsandtooff-sitepointsasrequiredbytheAgency.Therequirementwithregardtooff-sitepointsissubjecttotheprioragreementofthelandowner(s) concerned.
3.19Tank,ContainerandDrumStorageAreas
3.19.1Alltank,containeranddrumstorageareasshallberenderedimpervioustothematerialsstoredtherein.Bundsshallbedesignedhavingregard toAgencyguidelines‘StorageandTransferofMaterialsforScheduledActivities’ (2004).
3.19.2Alltankanddrumstorageareasshall, asa minimum,bebunded,eitherlocallyorremotely,toavolumenotlessthanthegreaterofthefollowing:
3.19.3110%ofthecapacityofthelargesttankordrumwithinthebundedarea;or
3.19.425%ofthetotalvolumeofsubstancethatcouldbestoredwithinthebunded area.
3.19.5Alldrainagefrombundedareasshallbetreatedashazardouswasteunlessitcanbedemonstratedtobeotherwise.Alldrainagefrombundedareasshallbedivertedforcollectionandsafedisposal.
3.19.6Allinlets,outlets,ventpipes,valvesandgaugesmustbewithinthebunded area.
3.19.7Alltanks,containersanddrumsshallbelabelledtoclearlyindicatetheircontents.
3.20Thelicenseeshallhaveinstorageanadequatesupplyofcontainmentboomsand/orsuitableabsorbentmaterialtocontainandabsorbanyspillageatthefacility.Onceused,theabsorbentmaterialshallbedisposedofatanappropriatefacility.

3.21SiltTrapsandOilSeparators
Thelicenseeshallmaintainsilttrapsandoilseparatorsatthefacility:
(i)Silttrapstoensurethatallstormwaterdischarges,otherthanfromroofs,fromthefacilitypassthroughasilttrapinadvanceofdischarge;
(ii)Anoilseparatoronthestormwaterdischargefromyardareas.TheseparatorshallbeaClassIfullretentionseparator.
The silt traps and separator shall be in accordance with I.S. EN-858-2: 2003(separatorsystemsforlightliquids).
3.22Fire-waterRetention
3.22.1Thelicenseeshallcarryoutariskassessmenttodetermineiftheactivityshouldhaveafire-waterretentionfacility.Thelicenseeshallsubmittheassessment andareporttotheAgencyonthefindingsandrecommendationsoftheassessmentwithinsixmonthsofthedateofgrantofthislicence.
3.22.2Intheeventthatasignificantriskexistsforthereleaseofcontaminatedfire-water,thelicenseeshall,basedonthefindingsoftherisk assessment,prepareand implement,withtheagreementoftheAgency,asuitablerisk managementprogramme.TheriskmanagementprogrammeshallbefullyimplementedwithinthreemonthsofdateofnotificationbytheAgency.
3.22.3Intheeventofafireoraspillagetostormwater,thesitestormwatershallbedivertedtothecontainmentpond.Thelicenseeshallexamine,aspartoftheresponseprogrammeinCondition3.22.2above,theprovisionofautomaticdiversionofstormwatertothecontainment pond.Thelicensesshallhaveregardtoany guidelinesissuedby the Agencywithregardtofirewaterretention.
3.22.4ThelicenseeshallhaveregardtotheEnvironmental Protection AgencyDraftGuidanceNotetoIndustryontheRequirementsforFire-WaterRetentionFacilitieswhen implementing Conditions 3.22.1 and 3.22.2above.
3.23Allpumpssumps,storagetanksorothertreatmentplantchambersfrom which spillageofenvironmentallysignificantmaterials might occur insuchquantities asarelikelytobreachlocalorremotecontainmentorseparators,shallbefittedwithhighliquidlevelalarms(oroildetectorsasappropriate)withinsixmonthsfromthedateofgrantofthislicence.
3.24Theprovisionofacatchmentsystemtocollectanyleaksfromflangesandvalvesofallover-groundpipesusedtotransportmaterialotherthanwatershallbeexamined.ThisshallbeincorporatedintoaScheduleofEnvironmental ObjectivesandTargetssetoutinCondition2ofthislicenceforthereductioninfugitiveemissions.
3.25Allwellheads,asshownondrawingnumberCe07-253-Ol-204Revision A(GW3)and drawingnumberCe07-253-01-208RevisionA (GW1GW2)ofthelicenceapplicationshallbeadequatelyprotectedtopreventcontamination or physical damage.
3.26Thelicenseeshall,withinthreemonthsofthedateofgrantofthislicence,installinaprominentlocationonthesiteawindsock,orotherwinddirectionindicator,which shallbevisiblefromthepublicroadwayoutsidethesite.Thelicenseeshallprovideandmaintainsuitableinfrastructureatthefacilityfortheautomated monitoringandrecordingofwindspeed.
Reason:Toprovidefor appropriateoperationofthefacility toensureprotection oftheenvironment.

Noisefromthefacilityshallnotgiverisetosoundpressurelevels(Leq,T)measuredatthenoisesensitivelocationsofthefacilitywhichexceedthelimitvalue(s).
4.4DustandParticulateMatter
Dustandparticulatemattersfromtheactivityshallnotgiverisetodeposition levelswhichexceedthelimitvalue(s).

Condition5.Emissions
5.1Nospecifiedemissionfromthefacilityshallexceedtheemissionlimitvaluessetout inScheduleB:EmissionLimits,ofthislicence.Thereshallbenootheremissionsofenvironmental significance.

Condition6.ControlandMonitoring
6.1TestProgramme
6.1.1Thelicenseeshall preparetothesatisfactionofthe Agency, a testprogrammeforabatementequipmentinstalledtoabateemissionstoatmosphere. Thisprogramme shallbesubmittedtotheAgencyinadvanceofimplementation.
6.1.2Theprogramme,followingagreementbytheAgency,shallbecompletedwithinthreemonthsofthecommencementofoperationoftheabatementequipment.
6.1.3Thecriteriafortheoperationoftheabatementequipmentasdeterminedbythetestprogramme,shallbeincorporatedintothestandardoperatingprocedures.
6.1.4Thetestprogrammeshallasaminimum:
(i)establishallcriteriaforoperation,controlandmanagementoftheabatementequipmenttoensurecompliancewiththeemissionlimit valuesspecifiedinthislicence;and
(ii)assesstheperformanceofanymonitorsontheabatementsystemand establishamaintenanceandcalibrationprogrammeforeach monitor.
6.1.5AreportonthetestprogrammeshallbesubmittedtotheAgencywithinonemonthofcompletion.
6.2Thelicenseeshallcarryoutsuchsampling,analyses,measurements,examinations,maintenanceandcalibrationsassetoutbelowandasinaccordancewithScheduleC:ControlMonitoring,ofthislicence.
6.2.1Analysesshallbeundertakenbycompetentstaffinaccordancewithdocumentedoperatingprocedures.
6.2.2Suchproceduresshallbeassessedfortheirsuitabilityforthetestmatrixandperformance characteristics shallbedetermined.
6.2.3Suchproceduresshallbesubjecttoa programmeofAnalyticalQualityControlusingcontrolstandardswithevaluationoftestresponses.
6.2.4Whereanyanalysisissub-contracteditshallbetoacompetentlaboratory.
6.3Thelicenseeshallensurethat:
(i)samplingandanalysisforallparameterslistedintheSchedulestothislicence;and

(ii)anyreference measurements forthecalibration ofautomated measurementsystems;
shallbecarriedoutinaccordancewithCEN-standards.IfCENstandardsarenotavailable,ISO,nationalorinternationalstandardsthatwillensuretheprovisionofdataofanequivalentscientificqualityshallapply.
6.4Allautomaticmonitorsandsamplersshallbefunctioningatalltimes(exceptduringmaintenanceandcalibration)whentheactivityisbeingcarriedonunlessalternativesamplingormonitoringhasbeenagreedinwritingbythe Agency for a limitedperiod.Intheeventofthemalfunctionofanycontinuousmonitor,thelicenseeshallcontacttheAgencyassoonaspracticable,andalternativesamplingandmonitoringfacilitiesshallbeputinplace.Theuseofalternativeequipment,otherthaninemergencysituations,shallbeasagreedbytheAgency.
6.5Monitoringandanalysisequipmentshallbeoperatedandmaintainedasnecessarysothatmonitoringaccuratelyreflectstheemissionldischarge(orambientconditionswherethatisthemonitoringobjective).
6.6Thelicensee shallensurethatgroundwatermonitoringwellsamplingequipmentisavailable/installedon-siteandisfitforpurposeatalltimes.ThesamplingequipmentshallbetoAgencyspecifications.
6.7Alltreatment/abatementandemissioncontrolequipmentshallbecalibratedandmaintainedinaccordancewiththe instructions issued bythemanufacturer/supplierorinstaller.
6.8Thefrequency,methodsandscopeofmonitoring,samplingandanalyses,assetoutinthislicence,maybeamendedwiththeagreementoftheAgencyfollowingevaluationoftestresults.
6.9Thelicenseeshallprepareaprogramme,tothesatisfactionoftheAgency,fortheidentificationandreduction offugitiveemissionsusinganappropriatecombinationofbestavailabletechniques.Thisprogrammeshall be included in theEnvironmental ManagementProgramme.
6.10Theintegrityandwatertightnessofallundergroundpipes,tanks,bundingstructuresandcontainersandtheirresistancetopenetrationbywaterorothermaterialscarriedorstoredthereinshallbetestedanddemonstratedbythelicenseewithinsixmonthsofthedateofgrantofthislicence.ThistestingshallbecarriedoutbythelicenseeatleastonceeverythreeyearsthereafterandreportedtotheAgencyoneachoccasion.Thistestingshallbecarriedoutinaccordancewith anyguidancepublishedbytheAgency.Awrittenrecordofall integrity tests and any maintenance orremedialworkarisingfromthemshallbemaintainedbythelicensee.
6.11Thedrainagesystem(i.e.,gullies,manholes,anyvisibledrainageconduitsandsuchotheraspectsasmaybeagreed)andbunds,silttrapsandoilseparatorsshallbeinspectedweeklyanddesludgedasnecessary.Allsludgeanddrainagefromtheseoperationsshallbecollectedforsafedisposal.Thedrainagesystem,bunds,silttrapsandoilinterceptorsshallbeproperlymaintainedatalltimes.
6.12Aninspectionforleaksonallflangesandvalvesonover-groundpipesusedtotransportmaterialsotherthanwatershallbecarriedoutweekly.Alogofsuchinspectionsshallbemaintained.
6.13StormWater
Avisualexaminationofthestormwaterdischargesshallbecarriedoutdaily.Alog ofsuchinspectionsshallbemaintained.

6.14GroundWater
Thelicenseeshall,asrequiredbytheAgency,arrangeforthecarryingout,byan appropriatelyqualifiedconsultantJprofessional,ofacomprehensivehydrogeologicalinvestigationofthesite.Thescope,detailandprogramme, includingreportstructureandreportingschedule,forthisinvestigationmustbeagreedbytheAgencypriorto implementation.AnyrecommendationsarisingfromareportorreportsonthisinvestigationmustbeimplementedwithinsuchaperiodtobeagreedbytheAgency.
6.15Noise
Thelicenseeshallcarryouta noisesurvey ofthe site operations annually. Thesurveyprogrammeshallbeundertakeninaccordancewiththemethodologyspecifiedinthe‘EnvironmentalNoiseSurveyGuidanceDocument’aspublishedbytheAgency.
6.16PollutantReleaseandTransferRegister(PRTR)
ThelicenseeshallprepareandreportaPRTRforthesite.The substance andlorwastestobeincludedinthePRTRshallbeasagreedbytheAgencyeachyearbyreferencetoECRegulationsNo.166/2006concerningtheestablishmentoftheEuropeanPollutantReleaseandTransferRegister.ThePRTRshallbepreparedinaccordancewithanyrelevantguidelinesissuedbytheAgencyandshallbesubmittedelectronicallyinspecifiedformatandaspartoftheAER.
6.17Thelicenseeshall,withinsixmonthsofthedateofgrantofthislicence,developandestabHshaDataManagementSystemfor collation,archiving, assessing andgraphicallypresentingthemonitoringdatageneratedasaresultofthislicence.
6.18LitterControl
6.18.1Allloose litterorotherwaste,placedonorinthevicinityofthefacility,otherthaninaccordancewiththerequirementsofthislicence,shallberemoved,subjecttotheagreementofthelandowners,immediately and inanyeventby10.00amofthenextworkingdayaftersuchwasteisdiscovered.
6.18.2Thelicenseeshallensurethatallvehiclesdeliveringwastetoandremovingwasteandmaterialsfromthefacilityareappropriatelycovered.
6.19Dust/OdourControl
6.19.1Allputresciblewaste,mixedmunicipalwasteandwastefordisposalstored overnightatthefacilityshallbestoredinsuitablycoveredandenclosedcontainers,andshallberemovedfromthefacilitywithin48hours,exceptatPublicHolidayweekends.AtPublicHolidayweekends,wastefordisposalshallberemovedwithin72hoursofitsarrivalonsite.
6.19.2Indryweather,siteroadsandanyotherareasusedbyvehiclesorforstoringpotentiallydustywasteshallbesprayedwithwaterasandwhenrequiredto minimiseairbornedustnuisance.
6.19.3Thelicenseeshallundertake,within sixmonthsofthedateofgrantofthislicence,anodourassessmentwhichshallincludeasaminimumtheidentificationandquantificationofallsignificantodoursourcesandanassessmentofthesuitabilityandadequacyoftheodourabatementsystem(s)todealwiththeseemissions.Anyrecommendationsarisingfrom suchanodourassessmentshallbeimplementedfollowingagreementwiththeAgency.
6.20Operational Controls
6.20.1Thefloorofthewastetransferbuildingshallbecleanedonaweeklybasisandonadailybasiswhereputrescible wasteishandled.Thefloorofthestoragebaysforrecoveredwastesshall bewasheddownand cleaned on eachoccasionsuchbaysareemptied,orasaminimumonaweeklybasis.
6.20.2Scavengingshallnotbepermittedatthefacility.

6.20.3Alltanksanddrumsshallbelabelledtoclearlyindicatetheircontents.
6.20.4Thereshallbenounauthorisedpublicaccesstothefacility.
6.20.5Thewood shredder,theC&Dwastecrusher andtheC&Dwaste screenershallnotbeoperatedwhenwindspeedsexceed 10.7mIs(Force5).
6.21MonitoringLocations
Withinthreemonthsofthedateofgrantofthislicence,thelicenseeshallsubmittotheAgency anappropriatelyscaleddrawing(s)showingallthemonitoringlocationsthatarestipulated inthislicenceincludinganynoise-sensitivelocationsandprivatewellstobemonitored.Thedrawingshallincludetheeight-digitnationalgridreferenceofeachmonitoringpoint.
6.22NuisanceMonitoring
Thelicenseeshalldailyinspectthefacilityanditsimmediatesurroundsfornuisancescausedbylitter,vermin,birds,flies,mud,dustandodours.Thelicenseeshallmaintainarecordofallnuisanceinspections.
Reason: Toprovidefor theprotection oftheenvironmentbyvayoftreatmentandmonitoring ofemissions.
Condition7.ResourceUseandEnergyEfficiency
7.1Thelicenseeshallcarryoutanauditoftheenergyefficiencyofthesitewithinoneyearofthedateofgrantofthislicence.TheauditshallbecarriedoutinaccordancewiththeguidancepublishedbytheAgency,“GuidanceNoteonEnergyEfficiencyAuditing”.TheenergyefficiencyauditshallberepeatedatintervalsasrequiredbytheAgency.
7.2TheauditshallidentifyallpracticableopportunitiesforenergyusereductionandefficiencyandtherecommendationsoftheauditwillbeincorporatedintotheScheduleofEnvironmentalObjectivesandTargetsunderCondition2above.
7.3Thelicenseeshallidentifyopportunities forreductioninthequantityofwaterusedonsiteincludingrecyclingandreuseinitiatives,whereverpossible.ReductionsinwaterusageshallbeincorporatedintoScheduleofEnvironmentalObjectivesandTargets.
7.4Thelicenseeshallundertakeanassessmentoftheefficiencyofuseofrawmaterialsinallprocesses,havingparticularregardtothereductioninwastegenerated.Theassessmentshouldtakeaccountofbestinternationalpracticeforthistypeofactivity.Whereimprovementsareidentified,theseshallbeincorporatedintotheScheduleofEnvironmental ObjectivesandTargets.
Reason:Toprovidefor theefficientuseofresourcesandenergyinallsiteoperations.
Condition8.Materials Handling
8.1Withtheexceptionofwoodshreddingandthe screening and crushing ofconstructionanddemolitionwaste,allwasteprocessing shallbecarried outinsidethewastetransferbuildings.

8.2Onlynon-putresciblewasteshall bestoredoutdoors.Mechanicallyrecoveredmarketablewasteproduced atthefacilitymaybestoredoutdoorsonlyunderconditionsthatwillnotdiminishtheintegrityorvalueoftherecoveredwasteorleadtonuisanceemissionsincludingdustandodour.Allsuchstorageareasshall becoveredexceptasmaybeagreedbytheAgency.
8.3WasteAcceptanceandCharacterisation Procedures
8.3.1WasteshallonlybeacceptedatthefacilityfromLocalAuthoritywastecollectionortransportvehiclesorholdersofwastecollection permits,unlessexemptedorexcluded,issuedunderthe Waste Management Acts 1996to2011. Copiesofthesewastecollectionpermitsmustbemaintainedatthefacility.
8.3.2Withinsixmonthsofthedate ofgrantofthislicence,thelicenseeshallestablishandmaintaindetailedwrittenproceduresfortheacceptanceandhandlingofwaste.
8.3.3WasteshallbeacceptedatthefacilityonlyfromknowncustomersornewcustomerssubjecttoinitiaLwasteprofilingandwastecharacterisationoff-site.Thewrittenrecordsofthisoff-sitewasteprofilingandcharacterisationshallberetainedbythelicenseeforallactivecustomersandforatwoyearperiodfollowingtermination oflicensee/customer agreements.
8.3.4Wastearriving atthefacilityshallhaveitsdocumentationchecked atthepointofentrytothefacilityandsubjecttothisverification,weighed,documentedanddirectedtotheWasteTransfer Building. Each load ofwastearrivingattheWasteTransferBuildingshallbeinspected upontippingwithinthisbuilding.Onlyaftersuchinspectionsshallthewastebeprocessedfordisposalorrecovery.
8.3.5Anywastedeemedunsuitableforprocessingatthefacilityand/orincontraventionofthislicence shallbeimmediatelyseparatedand removed fromthefacilityattheearliestpossibletime.TemporarystorageofsuchwastesshallbeinadesignatedWasteQuarantineArea. Waste shall bestoredunderappropriateconditionsinthequarantineareatoavoidputrefaction,odourgeneration,theattraction ofverminandanyothernuisanceorobjectionablecondition.
8.4Recoveryofwasteon-siteshallonlytakeplaceinaccordancewiththeconditionsofthislicenceandinaccordancewith the appropriate National and Europeanlegislationandprotocols.
8.5Wastesentoff-siteforrecoveryordisposalshallbetransportedonlybyanauthorisedwastecontractor.Thewasteshallbetransportedfrom the siteoftheactivitytothesiteofrecovery/disposalonlyinamannerthat will not adverselyaffectthe environmentandinaccordancewiththe appropriate National andEuropeanlegislationandprotocols.
8.6Thelicenseeshallensurethat,inadvanceoftransfertoanotherperson,wasteshallbeclassified,packaged andlabelledinaccordancewithNational,Europeanandanyotherstandardswhichareinforceinrelationtosuchlabelling.
8.7Theloadingandunloadingofmaterialsshallbecarriedoutindesignatedareasprotectedagainstspillageandleachaterun-off.
8.8Wasteshallbestoredindesignatedareas,protectedasmaybeappropriateagainstspillageandleachaterun-off.Thewasteshallbeclearlylabelledandappropriatelysegregated.
8.9NowasteclassifiedasgreenlistwasteinaccordancewiththeEUShipmentofWaste Regulations(CouncilRegulationEECNo.1013/2006,asmaybeamended)shallbeconsignedforrecoverywithouttheagreementoftheAgency.
8.10Wastefordisposal/recoveryoff-siteshallbeanalysedinaccordance withScheduleC:ControlMonitoring,ofthislicence.

8.11Unlessapprovedinwriting,in advance,bytheAgencythe licensee isprohibitedfrommixingahazardouswasteofonecategorywithahazardouswasteofanothercategoryorwithanyothernon-hazardouswaste.
8.12Thelicenseeshallneitherimport wasteintotheStatenor exportwasteoutoftheStateexceptinaccordancewiththerelevantprovisionsofRegulation(EC)No1013/2006oftheEuropeanParliamentandoftheCouncilof14thJune 2006on shipmentsofwasteandassociatednationalregulations.
8.13Noseparatelycollectedwasteorrecoveredfractionofwasteshallbe mixed with wasteofdifferentcharacteristicsorpropertiesordispatchedfordisposalatanotherfacilityunlessagreedbytheAgency.

Condition9.AccidentPreventionandEmergency
Response
9.1Thelicensee shall,withinsixmonthsofdateofgrantofthislicence,ensurethatadocumentedAccidentPreventionProcedureisinplacethataddressesthehazardson-site,particularlyinrelationtothepreventionofaccidentswithapossibleimpacton theenvironment.Thisprocedureshallbereviewedannuallyandupdated asnecessary.
9.2Thelicenseeshall,withinsixmonthsofdateofgrantofthislicence,ensurethatadocumentedEmergencyResponseProcedureisinplace,that addresses anyemergencysituationwhichmayoriginateon-site.Thisprocedureshallincludeprovisionforminimisingtheeffectsofanyemergencyontheenvironment.Thisprocedureshallbereviewedannuallyandupdatedasnecessary.
9.3Incidents
9.3.1Intheeventofanincidentthelicenseeshallimmediately:
(i)carryoutaninvestigationtoidentifythenature,sourceandcauseoftheincidentandanyemissionarisingtherefrom;
(ii)isolatethesourceofanysuchemission;
(iii)evaluate the environmental pollution, if any, caused by theincident;
(iv)identifyandexecutemeasurestominimisetheemissions/malfunction andtheeffectsthereof;
(v)identifythedate,timeandplaceoftheincident;
(vi)notifytheAgencyandotherrelevantauthorities.
9.3.2ThelicenseeshallprovideaproposaltotheAgencyforitsagreementwithin onemonthoftheincidentoccurringorasotherwiseagreedbytheAgency,to:
(i)identifyandputinplacemeasurestoavoidrecurrenceoftheincident;and
(ii)identifyandputinplaceanyotherappropriateremedialactions.

9.4Emergencies
9.4.1Intheeventofabreakdownofequipmentoranyotheroccurrencewhichresultsintheclosureofthetransferstationbuilding,anywastearrivingatoralreadycollectedatthefacility shallbetransferreddirectly toappropriatelandfillsitesoranyotherappropriatefacilityuntilsuchtimeasthetransferstationbuildingisreturnedtoafullyoperationalstatus.Suchabreakdown eventwillbetreatedasanemergencyandrectifiedassoonaspossible.
9.4.2Allsignificantspillagesoccurringatthefacilityshallbetreatedasanemergencyandimmediatelycleanedupanddealt with soasto alleviatetheireffects.
9.4.3Nowasteshallbeburntwithintheboundariesofthefacility.Afireatthefacilityshallbetreatedasanemergencyandimmediateactionshallbetaken toextinguishitandnotifytheappropriateauthorities.
9.4.4Intheeventthatmonitoringoflocalwellsindicatesthat the facility ishavingasignificantadverseeffectonthequantity andlor quality of thewatersupplythisshallbetreatedasanemergencyandthelicenseeshallprovideanalternativesupplyofwatertothoseaffected.

Condition10.Closure,Restoration andAftercare
Management
10.1Followingtermination,orplannedcessationforaperiodgreaterthansixmonths,ofuseorinvolvementofallorpartofthesiteinthelicensedactivity,thelicenseeshall,tothesatisfactionoftheAgency,decommission,rendersafeorremovefordisposallrecoveryanysoil,subsoil,buildings,plantorequipment,oranywaste,materialsorsubstancesorothermattercontainedthereinorthereon,thatmayresultinenvironmentalpollution.
10.2Decommissioning Management Plan(DMP)
10.2.1Thelicenseeshallprepare,tothesatisfactionoftheAgency,afullydetailedandcostedplanforthedecommissioningorclosureofthesiteor partthereof.ThisplanshallbesubmittedtotheAgency foragreement withinsixmonthsofthedateofgrantofthelicence.
10.2.2Theplanshallbereviewedannuallyandproposedamendmentstheretonotified totheAgencyforagreementaspartoftheAER.NoamendmentsmaybeimplementedwithouttheagreementoftheAgency.
10.2.3ThelicenseeshallhaveregardtotheEnvironmentalProtectionAgency GuidanceonEnvironmentalLiabilityRiskAssessment,ResidualsManagementPlansandFinancialProvisionwhenimplementingCondition
10.2.1above.
10.3The Decommissioning Management Plan shall include, as a minimum, thefollowing:
(i)ascopestatementfortheplan;
(ii)thecriteriathatdefinethesuccessfuldecommissioning oftheactivityorpartthereof,whichensuresminimumimpactontheenvironment;
(iii)aprogrammetoachievethestatedcriteria;
(iv)whererelevant,atestprogrammetodemonstratethesuccessfulimplementationofthedecommissioningplan;and

(v)detailsofthecostingsfortheplanandthefinancialprovisionstounderwritethosecosts.
10.4AfinalvalidationreporttoincludeacertificateofcompletionfortheDecommissioningManagementPlan,forallorpartofthesiteasnecessary,shallbesubmittedtotheAgencywithinthreemonthsofexecutionoftheplan.Thelicenseeshallcarryoutsuchtests,investigations orsubmitcertification,asrequestedbytheAgency,toconfirmthatthereisnocontinuingrisktotheenvironment.
Reason:Tomakeprovisionfortheproper closureoftheactivityensuringprotection oftheenvironment.
Condition11.Notification,RecordsandReports
11.1ThelicenceshallnotifytheAgencybybothtelephoneandfacsimile,ifavailable,totheAgency’sheadquartersinWexford,ortosuchotherAgencyofficeasmaybespecifiedbytheAgency,assoonaspracticableaftertheoccurrenceofanyofthefollowing:
(i)anyreleaseofenvironmentalsignificancetoatmospherefromanypotentialemissionspointincludingbypasses;
(ii)anyemissionthatdoesnotcomplywiththerequirementsofthislicence;
(iii)anymalfunctionorbreakdownofkeycontrolequipmentormonitoringequipmentsetoutinScheduleC:ControlandMonitoring,ofthislicencewhichislikelytoleadtolossofcontroloftheabatementsystem;and
(iv)anyincidentwiththepotentialforenvironmentalcontaminationofsurfacewaterorgroundwater,orposingan environmentthreattoairor land, orrequiringanemergencyresponsebytheLocalAuthority.
Thelicenseeshallincludeaspartofthenotification,dateandtimeoftheincident,summarydetailsoftheoccurrence,andwhereavailable,thestepstakentominimiseanyemissions.
11.2Intheeventofanyincidentwhichrelatestodischargestosewerhavingtakenplace,thelicenseeshallnotifytheLocalandWaterServicesAuthorityassoonaspracticableaftersuchanincident.
11.3Inthecaseofanyincidentrelatingtodischargestowater,thelicenseeshallnotify theLocalandWaterServicesAuthorityandInlandFisheriesIrelandassoonaspracticableaftersuchanincident.
II.4 Thelicenseeshallmakearecordofanyincident. Thisrecordshallincludedetailsofthenature,extent,andimpactof,andcircumstancesgivingriseto,theincident.Therecordshallincludeallcorrectiveactionstakentomanagetheincident,minimisewastesgeneratedandtheeffectontheenvironment,andavoid recurrence. Thelicenseeshall,assoonaspracticablefollowingincidentnotification,submittotheAgencytheincidentrecord.
11.5The licenseeshallrecordallcomplaintsofanenvironmentalnaturerelatedtotheoperationoftheactivity.Eachsuchrecordshallgivedetailsofthedateandtimeofthecomplaint,thenameofthecomplainant(ifprovided),andgive details ofthenatureofthecomplaint.Arecordshallalsobekeptoftheresponsemadeinthecaseofeachcomplaint.
11.6Thelicenseeshallrecordallsampling,analyses,measurements,examinations,calibrationsandmaintenancecarriedoutinaccordancewiththerequirementsofthislicenceandallothersuchmonitoringwhichreLatesto the environmentalperformanceofthefacility.

11.7Thelicenseeshallasaminimumkeepthefollowingdocumentsatthesite:
(i)thelicencesrelatingtothefacility;
(ii)thecurrentEMSforthefacility;
(iii)thepreviousyear’sAERforthefacility;
(iv)recordsofallsampling,analyses,measurements,examinations,calibrationsandmaintenancecarriedoutinaccordancewiththerequirementsofthislicenceandall othersuchmonitoringwhichrelatestotheenvironmentalperformanceofthefacility;
(v)relevantcorrespondencewiththeAgency;
(vi)up-to-datesitedrawings/plansshowingthelocationofkeyprocessandenvironmentalinfrastructure,includingmonitoringlocationsandemissionpoints;
(vii)up-to-dateStandardOperationalProceduresforallprocesses,plantandequipmentnecessarytogiveeffecttothislicenceorotherwisetoensurethatstandardoperationofsuchprocesses,plantorequipmentdoesnotresultinunauthorisedemissionstotheenvironment;and
(viii)anyelementsofthelicenceapplicationreferencedinthislicence.
ThisdocumentationshallbeavailabletotheAgencyforinspectionatallreasonabletimes.
11.8Thelicensee shallsubmittotheAgency, bythe3jstMarchofeachyear,anAER coveringthepreviouscalendaryear.Thisreport,whichshallbetothesatisfactionoftheAgency,shallincludeasaminimumtheinformationspecifiedinScheduleF:AnnualEnvironmentalReport,ofthis licence andshallbepreparedinaccordancewithanyrelevantguidelinesissuedbytheAgency.
11.9Afullrecord,whichshallbeopentoinspectionbyauthorisedpersonsoftheAgencyatalltimes,shallbekeptbythelicensee onmatters relatingtothewastemanagementoperationsandpracticesatthissite. Thisrecordshallbemaintainedon amonthlybasisandshallasaminimumcontaindetailsofthefollowing:
(i)thetonnagesandEWCCodeforthewastematerialsimportedandlorsent off-sitefordisposal/recovery;
(ii)thenamesoftheagentandcarrierofthewaste,andtheirwastecollectionpermitdetails,ifrequired(toincludeissuingauthorityand vehicleregistrationnumber);
(iii)details oftheultimatedisposal/recoverydestination facility forthe wasteanditsappropriatenesstoaccepttheconsignedwastestream,toincludeits permitllicencedetailsandissuingauthority,ifrequired;
(iv)writtenconfirmationoftheacceptanceanddisposal/recoveryofany hazardouswasteconsignmentssentoff-site;
(v)detailsofallwasteconsignedabroadforRecoveryandclassifiedas‘Green’inaccordancewiththeEUShipmentofWasteRegulations(CouncilRegulationEECNo.1013/2006,asmaybeamended).Therationalefortheclassificationmustformpartoftherecord;
(vi)detailsofanyrejectedconsignments;
(vii)detailsofanyapprovedwastemixing;
(viii)theresultsofanywasteanalysesrequiredunderScheduleC:Control& Monitoring,ofthislicence;and
(ix)thetonnageandEWCCodeforthewastematerialsrecoveredldisposedonsite.
11.10Thelicenseeshallsubmitreport(s)asrequiredbytheconditionsofthislicencetotheAgency’sHeadquartersinWexford,ortosuchotherAgencyofficeasmaybespecifiedbytheAgency.

11.11Allreportsshallbecertifiedaccurateandrepresentativebythefacilitymanageroranominated,suitablyqualifiedandexperienceddeputy.
11.12Arecordshallbekeptofeachconsignmentoftradeeffluent,leachateandlorcontaminatedstormwaterremovedfromthefacility.Therecordshallincludethefollowing:
(1)thenameofthecarrier;
(ii)thedateandtimeofremoval oftrade effluent,leachateandlorcontaminatedstormwater fromthefacility;
(iii)the volume oftrade effluent, leachate and/or contaminated storm water, incubicmetres,removedfromthefacilityoneachoccasion;
(iv)thenameandaddressoftheWastewater TreatmentPlanttowhichthetradeeffluent,leachateandlorcontaminatedstormwaterwastransported;and
(v)anyincidentsorspillagesoftradeeffluent,leachateandlorcontaminatedstormwaterduringitsremovalortransportation.
11.13WasteRecoveryReports
ThelicenseeshallaspartoftheAnnualEnvironmentalReportforthesitesubmitareportonthecontributionbythisfacilitytotheachievementofthewasterecoveryobjectivesstatedinCondition2.2.2.2andasotherwisemaybestatedinNationalandEuropeanUnionwastepoliciesandshall,asaminimum,includethefollowing:
(i)therecoveryofmetals;
(ii)therecoveryofCDderivedwastematerials;
(iii)therecovery/treatmentofbiowaste(includingcontributionoffacilitytothepre-treatmenttargetsintheEULandfillDirective);
(iv)theseparationandrecoveryofotherrecyclablematerials.

Condition12.FinancialChargesandProvisions
12.1AgencyCharges
12.1.1Thelicensee shallpaytotheAgencyanannualcontributionof€9,767,orsuchsumastheAgencyfromtimetotime determines,havingregardtovariationsintheextentofreporting,auditing,inspection,samplingandanalysisorotherfunctionscarriedoutbytheAgency,towardsthecostofmonitoringtheactivityastheAgencyconsidersnecessaryfortheperformanceofitsfunctionsundertheWasteManagement Acts 1996to2011.Thefirstpaymentshallbeapro-rataamountfortheperiodfromthedateofgrantofthislicencetothe3ldayofDecember,andshallbepaidto the Agencywithinone monthfrom thedateofgrantofthelicence.InsubsequentyearsthelicenseeshallpaytotheAgencysuchrevised annualcontributionastheAgencyshall fromtimetotimeconsidernecessaryto enableperformancebytheAgencyofitsrelevantfunctionsundertheWasteManagementActs1996to2011,andallsuchpaymentsshall be made withinonemonthofthedateuponwhichdemandedbytheAgency.
12.1.2IntheeventthatthefrequencyorextentofmonitoringorotherfunctionscarriedoutbytheAgencyneedstobeincreased,thelicensee shallcontributesuchsumsasdeterminedbytheAgencytodefrayitscostsinregardtoitemsnotcoveredbythesaidannualcontribution.

12.2Environmental Liabilities
12.2.1ThelicenseeshallaspartoftheAER,provideanannualstatementastothemeasurestakenoradoptedatthesiteinrelationtothepreventionofenvironmentaldamage,andthefinancialprovisionsinplaceinrelationtotheunderwritingofcostsforremedialactionsfollowinganticipatedevents(includingclosure)oraccidents/incidents,asmaybeassociatedwiththecarryingonoftheactivity.
12.2.2Thelicenseeshallarrangeforthecompletion,byanindependentandappropriatequalifiedconsultant,ofacomprehensiveandfullycostedEnvironmentalLiabilitiesRiskAssessment(ELRA)whichaddressestheliabilitiesfrompastandpresent activities. The assessment shall includethoseliabilitiesandcostsidentifiedinCondition10forexecutionoftheDMP.AreportonthisassessmentshallbesubmittedtotheAgencyforagreementwithinsixmonthsofdateofgrantofthislicence.TheELRAshallbereviewedasnecessarytoreflectanysignificantchangeonsite,andinanycaseeverythreeyearsfollowinginitialagreement.ReviewresultsaretobenotifiedaspartoftheAER.
12.2.3AspartofthemeasuresidentifiedinCondition12.2.1,thelicenseeshall,to thesatisfactionoftheAgency,makefinancialprovisiontocoveranyliabilitiesassociatedwith theoperation(includingclosure,restorationandaftercare).Theamountofindemnityheldshallbereviewedandrevisedasnecessary,butatleastannually.Proofofrenewalorrevisionof suchfinancialindemnityshallbeincludedintheannual‘StatementofMeasures’reportidentifiedinCondition 12.2.1.
12.2.4Thelicenseeshallrevisethecostofclosure,restorationandaftercareannuallyandanyadjustmentsshallbereflectedinthefinancialprovisionmadeunderCondition 12.2.3.
12.2.5ThelicenseeshallhaveregardtotheEnvironmentalProtectionAgencyGuidance onEnvironmentalLiabilityRiskAssessment,ResidualsManagementPlansandFinancial ProvisionwhenimplementingConditions
12.2.2and12.2.3above.
