Dear [HEIR]:

I represent your [CLIENT’S RELATION TO HEIR], [CLIENT], regarding the property located at [PROPERTY ADDRESS], which is currently titled in your deceased [DECEASED’S RELATION TO HEIR]’s name, [DECEASED].

Enclosed please find a copy of a Petition for Determination of Title to Decedent’s Interest in Real Estate Pursuant to 20 Pa. C.S.A. § 3546. This Petition requests that title to the property located at [PROPERTY ADDRESS], be adjudged in the name of [CLIENT] alone, so that [CLIENT] would be the sole owner of the property. An exact copy of this Petition will be filed shortly with the Clerk of the Orphans’ Court Division, City Hall, Room 415, Philadelphia, Pennsylvania, 19107. Once I actually file the Petition with the court, I will send you a notice by mail.

Enclosed you will also find a Consent to Petition form. Should you be in agreement with the enclosed Petition, you should sign the Consent form in front of a notary public and return it to me at the above address. I will then file the Consent form with the Orphans’ Court Division. If you choose to complete this Consent form, it will indicate that you consent to and support [CLIENT]’s Petition to have legal title to your [DECEASED’S RELATION TO HEIR]’s house at [PROPERTY ADDRESS] transferred into the name of [CLIENT] alone.

Should you be in agreement with this transfer of title, I respectfully request that you complete the enclosed Consent to Petition form. Please note that, if you choose to complete this form, a notary public must see you sign the document in order for it to be effective. I ask that you do this as promptly as possible, so that we can proceed forward with transferring title of the house.

However, if you have any objections to the granting of this Petition, you must give your written objections to the Clerk of Orphans’ Court within twenty (20) days of when I send you notice that the Petition has been filed with the court. If you do not file written objections, the Court will assume you have no objections and may grant the prayer of the Petition.
