LEASE CONTRACT

  1. TERM: The term of this Lease starts on ______, at ___ (AM/PM) and ends on ______, at ____ (AM/PM).
  2. RENT: You will pay us rent of $_____, 50% of which is due upon the execution of this Lease as a deposit which is non-refundable unless otherwise noted in this Lease. The balance of rent payment is due on ______. In addition, a security deposit in the amount of $250 shall be paid on or before ______. The security deposit shall be returned to you promptly upon our confirmation that there has been no damage or loss at the Dwelling. In the event there is any such damage or loss at the Dwelling during the term of this Lease, the security deposit shall be applied to cover the cost thereof with the balance, if any, to be returned to you. If you cancel this lease more than sixty(60) days before the commencement of this Lease, this Lease will become null and void and your entire deposit will be refunded to you. If you cancel this Lease sixty(60) days or less before the commencement of this Lease, or if you fail to pay the balance of rent when due, this Lease will become null and void and you will forfeit your entire deposit. You will pay the deposit and rent to us either in person or at our address written in Section 9 of this Lease. You will pay the rent even though we do not sent you a bill for the rent or a notice that it is due. Notwithstanding anything herein to the contrary, in the event you are a member of the United States Armed Forces or one of its reserve components and are called to active duty during the term of this Lease, then you shall only be responsible for the pro rata portion of the rent applicable to the time during which you were not called to active duty. In the event more than one person is a tenant under this Lease, the provisions of the preceding sentence shall apply pro rata.
  3. USE: You will only use the Dwelling for a Dwelling for yourself and family. You will not let more than 5 people live in the Dwelling at any time. You also will not sublease the Dwelling or let any other people live in the Dwelling or assign this Lease to anyone else.
  4. LAWS: You will comply with all the laws and regulations regarding the Dwelling. You also will not permit any others to violate any laws or regulations in the Dwelling. The use, possession or sale of illegal drugs at the Dwelling is prohibited. You will pay us the amount of any fines or penalties that we have to pay because you or any others violated any laws or regulations in the Dwelling.
  5. CARE OF DWELLING: You will keep the Dwelling and all fixtures and appliances in a clean and safe condition and will take care not to clog drains, pipes and plumbing. You will remove all ashes, garbage, rubbish and other waste in a clean and safe manner to the place provided by us. You will pay the cost of cleaning or repairing clogged drains, pipes and plumbing, which are clogged or damaged due to your use. You will use all electrical, plumbing, heating, air conditioning and other facilities and you will not destroy or damage any part of the Dwelling or any of our furnishings or appliances in the Dwelling. If you cause damage to any part of the Dwelling, you will pay us for the cost of repairing such damage and any consequential loss of rental income caused by repairing such damage. You also will not remove any of our furnishings or appliances from the Dwelling.
  6. UTILITIES: You will pay for the utilities and services in the Dwelling that are checked: ___ cold water, ___ hot water, ___electricity, ___gas, ___heat, ___air conditioning, ___telephone. The rent will not be reduced if you do not receive any of the utilities or services for reasons beyond our control.
  7. SMOKE DETECTORS: You will notify us promptly if any smoke detector is not operating, and we will then repair or replace it.
  8. PETS: ___ NO pets are allowed. ____ The following pets ONLY are allowed:______. You will keep the Dwelling and the grounds in clean and sanitary condition and will promptly repair any damage caused by your pets. If you do not repair any damage caused by your pets and we are forced to repair the damage caused by your pets, you agree to pay for the costs of such repairs.

  10. PROPERTY CONDITION: You acknowledge that the Dwelling is in good order and repair, unless otherwise indicated in this Lease. You agree to keep the Dwelling in clean condition during your use of the Dwelling.
  11. ENTERING DWELLING: We may enter the Dwelling at reasonable times to make necessary repairs or changes that we are required to make, or to supply the utilities or services that we have agreed to supply. We may also enter the Dwelling at reasonable times to show the Dwelling to possible or actual purchasers, mortgage lenders, tenants, workmen or contractors. We will give you reasonable notice of our intent to enter the Dwelling. You will not unreasonably deny us the right to enter the Dwelling. We may also enter the Dwelling at any time without your consent in case of emergency.
  12. DAMAGE TO DWELLING: In the event your use and enjoyment of the Dwelling is substantially affected because the Dwelling is damaged by fire, wind, water or any other cause or casualty, this Lease will immediately terminate and we will immediately refund the pro rata portion of the rent. You agree to indemnify and hold us harmless from any liability for any physical injury or property damage sustained by you or any of your guests caused by fire, wind, water or any cause or casualty, unless caused by the negligent or willful act of the Owner.
  13. REMOVAL OF PROPERTY: When this Lease ends, you will leave the Dwelling and remove all your property and property of others. If you fail to remove your property or the property of others, we may consider such property abandoned and may dispose of it as we deem appropriate.
  14. DEFAULT: You will be in default under this Lease if: (a) You do not make a payment of rent when it is due; (b) You violate or do not do any of the things you agree to do under this Lease.
  15. MISCELLANEIUS: If there is more than one of you who signs this Lease, then each of you agrees to pay the entire amount that you owe us. We can delay enforcing any of our rights under this Lease without losing them. If we release any of you from this Lease, the rest of you shall still pay the amount you owe us. We can also give any of you more time to pay the amount you owe us.
  16. LOST KEY/ LOCK OUT;BOUNCED CHECKS: There will be a $50 charge for any lost key or unreturned key. There will be a $25 charge for any check that is returned for insufficient funds.
  17. LOSS OR THEFT: We assume no responsibility for loss or theft of your personal property.

We may name different persons or different addresses; we shall give you written notice of any such changes.
  19. SEPARATE PROVISIONS: If any provision of this Lease is invalid or unenforceable, the other provisions of this Lease will still apply.
  20. BINDING EFFECT: This Lease shall be binding upon you and us and our and your respective successors, heirs, executors and administrators.

  22. EXECUTION BY FACSMILE: The parties agree that they may enter into this Lease(including any amendments and riders hereto) via fax. This consent applies only to this transaction, and either party may withdraw such consent by fax or in writing, but such withdrawal will not affect the validity or enforceability of this Lease (or any amendments or riders hereto) after it has been entered into. Faxing requires a fax machine or other appropriate fax technology.
