(B) To execute and deliver any deeds, contracts, mortgages, bills of sale, or other instruments necessary or desirable for the exercise of the Executor’s powers;
(C) To employ agents for the sale of any real or personal property, and to pay compensation or commissions to the agents without obtaining any authority from any court;
(D) To compromise, settle, or adjust any claims or demands by or against my estate, and to agree to any rescission or modification of any contract or agreement;
(E) To make non-prorata or prorata (proportionately determined) distributions or division of property in cash, in kind, or both, and to reasonably determine the value of such property;
(F) To assign or transfer certificates of stocks, bonds, or other securities;
(G) To invest and reinvest the funds, property, or assets coming into the Executor’s hands, without being limited by statute, court order, or decision (now or hereafter existing) regulating or limiting investments by fiduciaries and Executors;
(H) To pay from estate funds any interest and/or penalties that are assessed against my estate by reason of any tax returns filed by my Executor or assessed against me because of tax returns filed prior to my death;
(I) To disclaim, in whole or in part, the succession to any property to which I may be entitled;
ITEM VII. If any property is bequeathed or devised hereunder to a person who is a minor at the time of distribution, or to a person who has been adjudicated to be under a legal disability, or to a person not adjudicated incompetent, but who, by reason of illness, or mental or physical disability, is, in the opinion of my Executor, unable properly to administer such property, then such property may be distributed by my Executor in any one of the following methods as my Executor deems best, all without bond:
(A) Directly to the beneficiary;
(B) To the legally appointed guardian or conservator of the beneficiary;
(C) To a relative or a friend of the beneficiary, to be used for the care, support, and education of the beneficiary.
(D) To a custodian (selected by my Executor in his sole discretion, and which may be the person serving as my Executor) for a minor beneficiary under the Transfers to Minors Act or the Uniform Gifts to Minors Act, as is appropriate, of the State of ______, or of the state wherein the minor resides, who shall receive the property on behalf of such minor.
