SECTION1.110 TITLE

ThisdocumentshallbeknownastheTangentLandUseDevelopmentCodeandmaybereferredto

asthe"DevelopmentCode"or "Code."

SECTION1.120 PURPOSE

ThepurposeofthisCodeistoestablishstandardsandproceduresfortheorderlydevelopmentofland

withintheCityofTangentinconformancewiththeTangentComprehensivePlan,toprotectproperty rights,providedueprocessoflawandpromotethepublichealth,safetyandwelfareofthe citizensof Tangent.

SECTION1.130 COMPLIANCESTANDARDS

(1) TheTangentComprehensivePlanshallbetheofficialpolicyguidefortheTangentLandUse

DevelopmentCodeandshallserveasthebasisfordecisionsaboutgrowth,development,and conservationofnaturalresourcesinTangent.

(2)Nolot,structureoruseshallbepermittedifit isathreattothehealth,safetyor welfareofthe userorthepublic.

(3) Everylotorparcelshallabutandhaveaccesstoapublicstreet.

(4)Apropertymaybeused andastructureorpartof astructuremaybeconstructed,altered, occupiedorusedonlyas thisCodepermits.

(5)Noproperty,yard,off-streetparkingarea,off-streetloadingareaorotheropenspaceexistingon oraftertheeffectivedateofthisCodeshallbereducedbelowtheminimumrequiredforit bythis CodeunlessauthorizedundertheproceduresofthisCode.

(6) Noproperty,yard,off-streetparkingarea,off-streetloadingarea,orotheropenspaceshallbe usedtomeettherequirementsforanotherpropertyoruseunlessspecificallyauthorizedinthis Code.

(7)Recreationalvehicles,fifth-wheelers,traveltrailers,tenttrailers,tentsorsimilarfacilitiesmay notbeoccupiedformorethanthirty (30)daysinacalendaryearwithintheCitylimits.TheCity shallgrantoneseven (7) day extensionuponreceivingawrittenrequest.

(8)NopersonshalldividelandordeveloplandwithintheCitywithouthavingcompliedwiththe applicableprovisionsofthisCodeandtheapplicableprovisionsofcounty,stateandfederallaw.

(9)NopersonshallsellanysubdivisionlotorpartitionparceluntilthePlatofthesubdivisionor partitionhasbeenapprovedbytheCityand recordedwithLinnCounty.

(10) TheCityshallbenotifiedofanypendingsaleofasubdivision,partitionorofanyproperty

wheretheConditionsof Approval,Varianceconditionsorrequiredimprovementshavenotbeen completed.Saleofpropertyundertheseconditionsshallinvalidatetheapprovalgrantedbythe CityunlessanagreementtocompletetheapprovedrequirementsisacceptedbytheCity.

(11) AllapprovalsgrantedbytheCityshallbecompletedwithinthetimeperiodspecifiedinthe approvalorwithinoneyearof approvalifnotspecified.Acompletionform,containedinthe ApplicationformsprovidedbytheCity,shallbesubmittedtotheCityuponcompletionofall approvalconditionsandrequirements.Periodicreviewsoftheprogressmaybe conductedbythe City.

SECTION1.150INTERPRETATION

(1)WheretheconditionsimposedbyanyprovisionofthisCodearelessrestrictivethancomparable

conditionsimposedbyanyotherprovisionsofthisCodeoranyothercityordinance,statelawor federallaw,theprovisionswhicharemorerestrictiveshallgovern.

(2)Arequestforaninterpretationofthecontentor applicabilityofthisCode,theComprehensive

PlanoranyapplicableprovisionoflawshallbemadetotheCityAdministrator.

(3)Apersonrequestinganinterpretationshallsubmittherequestinwritingandmayofferan opinionorrecommendation.Thefeefor aninterpretationshallbepaidincompliancewith Section1.190.Clarificationsandinterpretationsof thisCodeortheComprehensivePlanmaybemadebytheCityAdministratorormaybe referredtothePlanningCommission.Public notificationsandaPublicHearingbythePlanningCommissionwillbescheduledfor interpretationsaffectingadjacentpropertyowners.

(4)TheCityAdministratorshallissueawrittenresponseassoonaspossible,butwithinamaximum of45daysfromreceiptoftherequestforreviewoftheinterpretation.ACityAdministrator interpretationshallbemadeinwritingandtransmittedtothepersonrequestingtheinterpretation.

(5)AppealofaninterpretationmaybefiledincompliancewithSection3.700.

(6)InterpretationsshallbeissuedinwritingandshallbebindingontheCityandthepetitioner unlessappealed.ARecordFileshallbemaintainedforwritteninterpretations.

SECTION1.160VALIDITY

TheprovisionsofthisCodeareseverable.If anysection,sentence,clauseorphraseofthisCodeis

adjudgedbyacourtofcompetentjurisdictionto beinvalid,thedecisionshallnotaffectthevalidityof theremainingportionsof thisCode.

SECTION1.170ADMINISTRATION

(1)TheCityshallmaintainauthorityoverall activitieswithintheCityLimitsasprovidedbylaw

andtheCityCharter.All powersoftheCityshallbevestedintheCityCouncilunlessotherwise providedintheCityCharterorCityOrdinances.

(2) TheCityAdministrator,underthedirectionoftheCityCouncil,shallhavetheauthorityandduty toenforcetheprovisionsofthisCodeandall relatedcity, county,stateorfederalregulations.An AdministrativeDecisionisadecisionbytheCityAdministratorwithnotificationofactions

takenprovidedtothePlanningCommissionandCityCouncil.

(a)TheCityAdministratorshallhavetheinitialauthorityand responsibilityto interpretall terms,provisions,andrequirementsofthisCode.

(b)TheCityAdministratorshallhavedecisionauthorityforPropertyLineAdjustments specifiedinSection2.310,TemporaryManufacturedDwellingPlacementsspecifiedin Section6.144,FinalPlatsignaturespecifiedinSection2.337andFloodPlaindevelopment permitsnotinvolvingplacementoffillorfloodwaydevelopmentasspecifiedinSection

4.210.

(c)AllcorrespondenceandinquiriesrelatedtothisCodeshallbedirectedtotheCity

AdministratorattheTangentCityHall.

(d)TheCityAdministratormaydesignateotherCityOfficersorStafftoundertakespecialized duties,includingbutnotlimitedto,theCityAttorney,CityEngineerandCityPlanner.

(3)ThePlanningCommissionshallhavetheauthoritytoreviewand approveallSitePlanReviews, ConditionalUses,Variances,PropertyLineAdjustmentsspecifiedinSection2.313(3), Partitions,SubdivisionsandFloodplainDevelopmentPermitsinvolvingplacementoffillor floodwaydevelopmentasspecifiedinSection4.210.

(4)TheCityCouncil,withrecommendationfromthePlanningCommission,shallhavetheauthority toreviewand approveallComprehensivePlanandZoningMaporTextAmendments,Vacations andAnnexations.ApprovedLegislativeAmendmentsandAnnexationswillthenbereferredto votersinaccordancewiththeCityCharter.

(5)Inthe eventthatasinglelanduseapplicationrequiresmorethanonedecision,thehighest decidingauthoritywillmakealldecisionsrequestedintheapplication.

(6)AdecisionbytheCityAdministrator,thePlanningCommissionortheCityCouncilmaybe appealedasprovidedinSection3.700.

SECTION1.180ENFORCEMENT

Ownersand/oroccupantsoflandorbuildingswithintheCityofTangentaresubjecttothe

enforcementauthorityof theCityofTangentasprovidedbyStateLawand theprovisionsofthis

Code,includinganyotherapplicableOrdinancesadoptedbytheTangentCityCouncil.

Astructurelocated,constructed,maintained,repaired,alteredorusedinviolationofthisCode,orland usedinviolationofthisCode,shallconstituteanuisance.TheCitymay,asanalternativetoother remediesthatarelegallyavailableforenforcingthisCode,instituteinjunction,mandamus,abatement or otherappropriateproceedingstoprevent,enjoin,abateor removetheunlawfullocation, construction,maintenance,repair,alterationoruse.

TheCityAdministrator,actingonbehalfoftheCityCouncil,shallhavethe authoritytodetermineand designateaviolationofthisCodeoraviolationoftheConditionsofApprovalofapriorlanduse decision.TheCityCouncilshallhavetheauthoritytoinitiateorprosecuteviolationsofthisCodeor anyviolationsof alandusedecision.

(1)Remedy.TheCityAdministratorshallprovidewrittennoticetothepropertyownerandtothe tenantofthepropertywhereanallegedviolationofthisCode,oraviolationofapreviouslyissuedlandusedecisionhasoccurredbeforeinitiatinganyenforcementactionunderthis

Section.

(2)Procedures.

(a)Within14daysafterdeterminationofaviolationofthisCode,theCityAdministratorshall notifythepropertyownerand/oroccupantinwritingthatapotentialviolationexists.Any suchnoticeshallreasonablyadvisethepropertyowneroroccupantofthefollowing:

1.Adescriptionoftheactivity,useor actiondeemedtobeaviolationofthisCodeora violationoftheConditionsofApprovalof apriorlandusedecision.

2.ThesectionofthisCodeorthepriorlanduse approvaldeemedtobeviolated.

3.Alistofthedatesand/ortimesonwhichsuchviolationswereobservedor knownto haveoccurred.

4.AsummaryoftheactiontheCitybelievesisrequiredtobringthepropertyowneror occupantintocompliancewiththisCodeorpriorland-useapproval.

5.Asummaryofthepotentialpenaltiesorlegalconsequences,includingfinesand reimbursementoftheCity’scostsincurredinthe enforcementactionforwhichthe propertyowneroroccupantmaybeheldliable.

6.Thetime,dateandlocationatwhichthepropertyowneroroccupantshallbeafforded anopportunitytorespondtotheallegedviolationsandtheprocedureforanappealto theCityCouncil.

7.Thatimmediateenforcementwillbesoughtunlesstheviolationiscorrectedor correctiveactionhasbeeninitiatedwithin20daysofthenoticeorwithin10daysof thepropertyowneroroccupant’sresponsetotheCity’sNoticeunlessappealedtothe CityCouncil.

Adefectinthenoticeof violationshallnotpreventtheenforcementofthis Code.

(b)Ifnecessary,theCityAttorneyshallbedirectedtotakesuchlegalactionasrequiredto insurecompliancewiththisCodeunless:

1.It hasbeendemonstratedtothesatisfactionoftheCitythattheviolationhasbeen corrected,removedor correctiveactionhasbeeninitiated.

2.Oracourtofcompetentjurisdictionhasstayedenforcementpendingtheoutcomeofa proceedingbeforeit,concerningtheviolation.

(3)Penalty.AviolationofthisCodemaybethesubjectofcriminal,civil,orothersanctions authorizedbyStateLaworCityOrdinances.

(a)Inadditionto,orinlieuofcriminalactions,aviolationofthisCodeorapermitissued hereinmaybethesubjectofacivilpenaltytoberecoveredbyacivilactioninthenatureof adebtorof anyappropriateremedyissuingfromacourtof competentjurisdiction, includingmandatoryand prohibitoryinjunctionsandordersof abatement.

(b) UponconvictionofacivilviolationofthisCode,afineupto$750maybe imposed.Each daysuchviolationcontinuesbeyondtheten(10)dayNoticeof Violationfirstprovidedby theCityAdministrator,willbeconsideredaseparateoffense.

SECTION1.190FEES

TheCityofTangenthas determinedthatit isnecessarytochargefeestocoverthecostofprocessing

applicationspresentedto theCity.Thesefeesshallcoverthe actualcostrequiredtoprocessan application.

FeeDepositsshallbeestablishedbyResolutionoftheCityCouncil.AFeeDepositshallbepaidby the applicanttotheCityatthetimeofsubmittinganapplicationandshallbeinadditiontootherfees establishedbycounty,stateorfederalregulations.TheCitywillrefundtotheapplicanttheportionof theFeeDepositnotutilizedinthecostofprocessinganapplication.Processingcostsexceedingthe FeeDepositshallbedue andpayablebytheApplicantpriortoauthorizationofthedevelopment approval.TheCostofprocessinganapplicationthathasbeendeniedbytheCityisnotrefundable.

Thesubmittingoftheapplicationandpayingofthecostofprocessinganapplicationshallbethesole responsibilityoftheapplicant.Anycostofprocessinganapplicationthatisnotpaidinfullbythe ApplicantshallbeadebtowedbytheapplicanttotheCityrecoverablebycivilaction.

SECTION1.200DEFINITIONS

(1)Rulesof Construction.Thefollowingrulesofconstructionshallapplyunlessinconsistentwith

theplainmeaningofthe contextofthisCode:

(a)Tense:Wordsusedinthepresenttenseincludethefuturetense.

(b)Number:Wordsusedin thesingularincludetheplural,andwordsusedintheplural includethesingular.

(c)ShallandMay:Theword"shall"ismandatory;theword "may"ispermissive.

(d)Gender:The gendermayincludethefeminine,masculineandneuterwhichcanmeanany ofthoseforms.

(e)Headings:Ifthereisanyconflictorinconsistencybetweentheheadingof anarticle, sectionorparagraphofthisCodeandthecontextthereof,thesaidheadingshallnotbe deemedtoaffectthescope,meaningorintentofsuchcontext.

(2)Definitions.ThewordsandphrasesusedinthisCodeshallhavethe followingmeaning:

ABUTContiguoustoorimmediatelyjoined.For example,twolotswithacommonpropertylineare consideredtobe abutting.

ACCESSThewayormeansbywhichpedestrians,bicycles,andvehiclesshallhavesafe,adequate andusableingressandegresstoproperty.

ACCESSMANAGEMENTRegulationofaccesstostreets,roads,andhighwaysfromabutting propertyandpublicand privateroadsanddriveways.

ACCESSORYSTRUCTUREORACCESSORYUSEAstructureoruseincidental,appropriate andsubordinatetotheprimaryuseofpropertyand locatedonthesamepropertyastheprimaryuse.

ACCESSWAYAright-of-wayoreasement,notlocatedwithinastreetright-of-way,thatprovidesa spaceforpedestrianand/orbicyclepassage.

ADEQUATEACCESSReasonablydirectroutesoftravelbetweendestinations.

ADEQUATEAREASpacesufficienttoprovideall requiredpublicservicestostandardsdefinedin thiscode.

ADVERSEIMPACTAnimpactthatisdetrimentaltoorcontrarytothedesiredeffectorsoopposed astocauseharmfulinterference.Anegativeeffectthatisdetrimentaltothepublicwelfareorinjurious topeople,propertyorthe communityenvironment.

BEDandBREAKFASTFACILITYAdwellingwheretravelersarelodgedforsleepinganddining purposesundertheprovisionsoflocalorstatelawgoverningsuchfacilities.

BICYCLEFACILITIESFacilitiesthatprovidefortheneedsofbicyclists,includingbikewaysand bicycleparking.

BIKEWAYThe generaltermforthefourbasictypesofbikeways:

(a)Bikeslanesarepaved5to6-footwidedesignatedlanesadjacentto(vehicle)travellanes.

(b)ShoulderBikewaysarewherebicycliststravelwithintheroadway'spavedshoulder.Typically, shoulderbikewaysare fourtosix feetinwidth.

(c)SharedRoadwaysareroadwayswherebicyclistsandmotorvehiclessharethetravellane.

(d)Multi-UsePathsareseparatedfromvehiculartraffic.Theyaretwo-waypathwaysabout10feet wideusedbypedestrians,bicyclistsandjoggers.

BOARDINGAND/ORROOMINGHOUSEAbuildingwherelodging,withorwithoutmeals,is providedforcompensation,butshallnotincludeHomesfortheAged,NursingHomesor GroupCare Homes.

BUFFERINGTolessentheimpactbetweenuses.

BUILDINGAnystructureusedorintendedforsupportingorshelteringanyuseoroccupancy.

BUILDINGLINEAlineonaplatormapindicatingthelimitbeyondwhichbuildingsorstructures maynotbe erected.AlsoreferredtoastheSetbackline.Theareabetweenthebuildingorsetbackline andthepropertylineisreferredtoasthe"yard."

CEMETERYLandusedorintendedtobeusedfortheburialofthedeadanddedicatedforcemetery purposesincludingcolumbaria,crematories,mausoleums,andmortuaries,whenoperatedin conjunctionwithandwithintheboundaryofsuch cemetery.

CHURCHAbuilding,togetherwithitsaccessorybuildingsanduses,wherepersonsregularly assembleforworship,andwhichbuilding,togetherwithitsaccessorybuildingsanduses,is maintainedandcontrolledbyareligiousbodyorganizedtosustainpublicworship.

CITYTheCityofTangent,Oregon.

CITYADMINISTRATOR/COORDINATORTheCityAdministratoristheCityCoordinator,and thetermsareusedsynonymouslyintheCode.SeetheauthoritydescribedinSection1.170(2).

COMMUNITYCENTERAfacilityownedand operatedbyagovernmentalagencyor anon-profit communityorganizationwhichisopentoanyresidentoftheneighborhoodinwhichthefacilityis locatedortoanyresidentoftheCityorsurroundingarea,providedthattheprimarypurposeofthe facilityisforassembly,andprovidedfurtherthatnopermanentortemporarycommercialeatingor drinkingfacilitiesshallbeoperatedonthepremises.

COMMUNITYSEPTICSYSTEMAsewagetreatmentanddisposalsystemservingtwoormore dwellingunits.

COMPREHENSIVEPLANAcityplanfortheguidanceof growthandimprovementoftheCity, includingmodificationsorrefinementswhichmaybemadefromtimetotime.
