Lands (Miscellaneous Matters) Act 1984

An Act to revoke the Permanent Reservations of certain Lands, to revoke the Crown grant of certain Lands, to provide for the sale of certain Lands, and for other purposes.

Preamble

WHEREAS the lands referred to in Part I of the Schedule have been permanently reserved for the purposes and in accordance with the particulars respectively set out therein:

AND WHEREAS the land contained in the Crown grant referred to in section 4 was granted to the Council of the Municipal District of Sandridge as a site for a Public Market for general purposes:

AND WHEREAS the lands referred to in Part I of the Schedule and in section 4 are required for other purposes:

AND WHEREAS the land shown hatched on the plan in Part III of the Schedule is Crown Land permanently reserved by Order in Council made 23 May 1881 as a site for public purposes:

AND WHEREAS it is expedient to provide—

(a)that the permanent reservations of the lands referred to in Part I of the Schedule should be revoked;

(b)that the Crown grant specified in section 4, should be revoked;

(c)that the lands delineated and shown hatched on the plan in Part II of the Schedule may be sold to the corporation of the City of Port Melbourne; and

(d)that the Minister be authorized to grant a lease of the land shown hatched on the plan in Part III of the Schedule:

BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1.Short title

s. 1

This Act may be cited as the Lands (Miscellaneous Matters) Act 1984.

2.Commencement

This Act shall come into operation on the day on which it receives the Royal Assent.

3.Revocation of certain Permanent Reservations

(1)The Orders in Council referred to in Part I of the Schedule and any other Order in Council or proclamation affecting lands are hereby revoked insofar as they relate to the lands referred to in Part I of the Schedule.

(2)Section 5 of and the First Schedule to the South Melbourne (Roman Catholic Orphanage) Lands Act 1969 shall be repealed.

4.Revocation of Crown grant

The Crown grant of 12 June 1862 entered in the Register of Miscellaneous Grants Volume 2 Folio 9 shall be revoked.

5.Certain lands to be deemed to be unalienated lands of the Crown

Notwithstanding anything to the contrary in any Act, the lands referred to in Part I of the Schedule and the lands delineated and shown hatched on the plan in Part II of the Schedule shall be and be deemed to be unalienated lands of the Crown freed and discharged from all trusts encumbrances reservations limitations and restrictions whatsoever and from every estate or interest therein.

6.Minister may sell certain lands

(1)The Minister may sell to the corporation of the City of Port Melbourne at a price and on terms and conditions which he thinks fit the land delineated and shown hatched on the plan in Part II of the Schedule.

(2)Where the Minister sells the land under sub-section (1), the Governor in Council shall grant the land in fee simple to the corporation of the City of Port Melbourne when the purchase price is paid in full.

7.Power to Governor in Council to grant lease of land permanently reserved

(1)Notwithstanding anything to the contrary in the Crown Land (Reserves) Act 1978 or any other Act of law the Governor in Council may in accordance with the provisions of section 134 of the Land Act 1958 grant a lease of the land shown hatched in Part III of the Schedule for the purpose of the conduct on the land of a caravan park, including the erection of buildings.

(2)A lease granted under sub-section (1) shall be for a period which ends not later than the thirty-first day of December, in the year two thousand and six.

8.No compensation payable

s. 8

No compensation shall be payable by the Crown in respect of any act matter or thing done under or arising out of this Act.
