PLEASE READ CAREFULLY BEFORE SIGNING DOCUMENT.

By signing this waiver, release of liability and assumption of risk agreement, I announce my intention to play baseball in the Land O’ Lakes Baseball League (referred to as LOL in balance of document) with the ______of the SOUTHWESTERN - WESTERN DIVISION of the LOL

I understand that I am subject to the ruling of the League Commissioner and agree to abide with the rules, regulations, and By-laws of the SOUTHWESTERN - WESTERN DIVISION and LOL.

I know, or have read these rules and understand them. In addition to the rules there are also standards of behavior generally known as a code of conduct, which I know. I am aware that failure to abide by the rules and regulations or code of conduct could result in my suspension from the division and/or League.

I, ______, also understand and am aware that by signing this letter of intent I cannot sign or play with another team or league without obtaining a player release from my manager.

I hereby agree to release, indemnify and discharge LOL baseball, its employees, officers and volunteers, heirs, assigns, personal representative and estate as follows:

•I acknowledge that my participation in the LOL league entails known and unknown risks that could result in physical or emotional injury, paralysis, death or damage to myself, to property or to third parties. I understand that such risks cannot be eliminated without jeopardizing the essential qualities of the sport.

•I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.

•I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of LOL equipment or facilities, including any such claims which allege negligent acts or omissions.

Should LOL or anyone acting on its behalf be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs. I certify that I have adequate insurance to cover any injury or damage that I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition that I may have.

I hereby understand, agree and acknowledge that if I damage, harm or destroy any equipment, fixtures, assets or property of the LOL or harm, injure or cause the death of another person through a negligent, careless, reckless or willful act, I hereby covenant, warrant and agree that I shall be fully and completely liable and responsible for: (i) the monetary amount of any and all costs, damages, losses and expenses resulting from such damage; (ii) the cost to repair/replace any equipment, fixtures, assets or property of LOL; and (iii) any and all medical, hospital or related expenses, and other costs, damage, losses and expenses incurred by another person as a result of my acts.

Furthermore, I hereby covenant, warrant and agree to completely defend, indemnify and hold its members, owners, employees, officers, agents, representatives, successors and assigns, harmless for any and all costs, damages, losses, and expenses, including judgments, fines, settlements, punitive damages and attorneys fees, arising from any threatened, pending or instituted claim, wither civil, criminal administrative or arbitrative, and any appeal to such a claim, in which the LOL or any of its members, owners, employees, officers, agents, representatives, successors and assigns, is joined as a party, or threatened to be joined as a party, resulting from, or in connection with, any such damage or injury by myself.

On behalf of myself, I hereby understand, agree and acknowledge that this Agreement is intended to be construed under the laws of the State of Wisconsin, as broadly and inclusively as is permitted thereby; and that if any portion or provision of this Agreement shall be held invalid, illegal or unenforceable, this shall not affect the validity or enforceability of any other provision of this Agreement.

I ______assure that I do not suffer from any minor or serious physical injury, illness, or disability that would make me especially prone to injury or disability in performing. I also assure the league, I am physically able to fully participate in practices and game situations and comprehend and accept all risk associated with my participation. I understand that I am responsible for my insurance coverage.

By signing this document, I acknowledge that if anyone is hurt or property damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against LOL on the basis of any claim from which I have released them herein.

I hereby understand, agree and acknowledge: (A) THAT I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT; (B) THAT I HAVE READ AND UNDERSTAND THIS DOCUMENT, AND AGREE TO BE BOUND BY ITS TERMS; (C) THAT I HAVE NOT RELIED ON ANY ORAL OR WRITTEN REPRESENTATIONS MADE BY LOL OR ANY OF ITS MEMBERS, OWNERS, EMPLOYEES, OFFICERS, AGENTS OR REPRESENTATIVES; (D) THAT I AM FULLY AWARE OF, AND HAVE BEEN ADVISED OF THE POTENTIAL RISKS CONNECTED WITH PARTICIPANT’S USE OF LAND O’ LAKES’ FACILITY AND PARTICIPATION IN LOL BASEBALL ACTIVITIES AND; (E) THAT I AM SIGNING THIS DOCUMENT VOLUNTARILY, AND OF MY OWN FREE WILL.
