CONSIDERATION OF APPROVAL OF A RESOLUTION AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE CONTRACTS WITH THE LAKEELSINORE AND SAN JACINTO WATERSHEDS AUTHORITY (LESJA) FOR SPECIFIED ACTIVITIES AUTHORIZED UNDER THE COSTA-MACHADO WATER ACT OF 2000

DISCUSSION:

On March 7, 2000, the electorate of the State of California voted to approve Proposition13, the Costa-Machado Water Act of 2000 (Act). Contained within the Act is the Lake Elsinore and San Jacinto Watershed Program Subaccount for $15 million (California WaterCode sections79104.100 through 79104.114). Upon appropriation by the State Legislature to the State Water Resources Control Board (SWRCB), the money in the Subaccount may be allocated to LESJA for projects to rehabilitate and improve the Lake Elsinore and SanJacintoWatersheds and the water quality of Lake Elsinore by funding one or more of the following types of watershed projects:

  1. Watershed monitoring
  2. Storm channel modification
  3. Nutrient control
  4. Aeration
  5. Wetlands restoration and enhancement
  6. Wildlife habitat enhancement
  7. Fishery enhancement
  8. Calcium quicklime treatment
  9. Sediment removal
  10. Related planning and administrative costs

In an August 18, 2000 letter to Mr. Bill Campbell of SWRCB staff, LESJA requested that the SWRCB authorize SWRCB staff to negotiate and enter into contracts on behalf of the SWRCB with LESJA to fund costs of the following activities:

  1. Monitoring to assist the Santa Ana Regional Water Quality Control Board (SARWQCB) in the development of:
  1. Nutrient Total Maximum Daily Load (TMDL) for Lake Elsinore and Canyon Lake
  2. Pathogen TMDL for Canyon Lake
  3. Toxics TMDL for Lake Elsinore
/ $500,000
3.Local match for a water quality feasibility study done in conjunction with the U.S.Army Corps of Engineers to determine alternatives in the San Jacinto watershed to address water quality objectives and provide environmental enhancement / $250,000
4.Feasibility analyses of improvements to Canyon Lake to determine the benefits for the watershed and impacts on water quality in LakeElsinore / $50,000
5.Program management and administration to June 30, 2003 / $450,000
Total / $1,750,000

The above-mentioned activities are limited to program administration costs incurred by LESJA and to feasibility and planning studies for possible future actions by LESJA which SWRCB, at this juncture, has not approved, adopted, or funded. Accordingly, compliance with California Environmental Quality Act (CEQA) is not required for SWRCB approval (See Public Resources Code, §§ 21102, 21150). Should LESJA resolve to seek funding from SWRCB under the Act at some point in the future to implement or construct any projects identified as a result of the above-referenced planning and feasibility studies, LESJA is required to submit a project-specific funding application along with any required CEQA analysis to SWRCB at that time. Attached for your information is a list of projects that LESJA anticipates funding under the Act in FiscalYear(FY) 2000-01.

FISCAL IMPACT:

The Governor’s Budget for FY 2000-01 allocated $8,000,000 (less three percent [$240,000] for bond issuance costs) to the SWRCB to fund the Subaccount. Funding this request from LESJA will leave $6,010,000 still available in this year’s authorization for implementation projects.

AUTHORIZING THE EXECUTIVE DIRECTOR OR HIS DESIGNEE TO EXECUTE CONTRACTS WITH THE LAKEELSINORE AND SAN JACINTO WATERSHEDS AUTHORITY (LESJA) OR DESIGNEE FOR SPECIFIED ACTIVITIES AUTHORIZED UNDER THE COSTA-MACHADO WATER ACT OF 2000

WHEREAS:

  1. On March 7, 2000, the electorate of the State of California approved Proposition 13, the Costa-Machado Water Act of 2000 (Act).
  1. The Act creates the $15 million Lake Elsinore and San Jacinto Watershed Subaccount (Subaccount).
  1. Upon appropriation by the StateLegislature to the State Water Resources Control Board (SWRCB), the Act stipulates that the money in the Subaccount may be used by SWRCB to rehabilitate and improve the Lake Elsinore Watershed and San Jacinto Watershed and the water quality of LakeElsinore.
  1. The Governor’s Budget for Fiscal Year 2000-01 allocates $7,760,000 from the Subaccount to the SWRCB to implement the purposes of the Act.
  1. It is important to get the administrative and developmental contract(s)in place to be able to develop and manage the projects that will be funded through the Subaccount.

THEREFORE BE IT RESOLVED THAT:

The SWRCB authorizes the Executive Director, or his designee, to negotiate, execute, and amend contracts on behalf of the SWRCB with LESJA, or designee, to fund the following activities not to exceed a sum of $1,750,000 from the Costa-Machado Water Act of 2000--Lake Elsinore and San Jacinto Watershed Subaccount:
