Introduction

My name is David Scott and I live in Kinnersley and have volunteered to be the Parish Footpaths Officer for Kinnersley.

Kinnersley has some 19.8Kms of footpath within their Parish boundary roughly:

Bad Patch Wood, Logaston and Coronation Wood to the North;

Sarnesfield, Moorhouse Coppice and Norton Wood to the East;

The Spinney, Hurstley Wood and Waterloo to the South;

Parton Cottages, Big Larches and Rough Moors Wood to the West.

All footpaths can be found on a Definitive Map either at the Amey Herefordshireoffices, address below or smaller versions held by me.

Rights and Responsibilities

Landowner Responsibility

Maintaining stiles and gates;

Cutting back of overgrowth;

Keeping paths clear of general obstructions;

Complying with ploughing and cropping legislation.

Landowners will generally be requested to clear theobstruction within 2 to 6 weeks depending on the natureof the problem. If not rectified within the given time period,further action may be taken in accordance with the PublicRights of Way Enforcement protocol.

Footpath Users Responsibilities

User of footpaths should follow the Countryside Code which in simple terms are:

  • Be safe, plan ahead and follow any signs;
  • Leave gates and property as you find them;
  • Protect plants and animals and take your litter home;
  • Keep dogs under close control;
  • Consider other people.

Herefordshire Council Responsibilities

As the Highway Authority, Herefordshire Council has a legal duty to maintain public rights of way. Where necessary, Herefordshire Council will act in default where the responsibilities of others, such as landowners, have not been carried out.

Herefordshire Council are responsible for the following:

  • Maintaining the surface of public rights of way and control vegetationgrowing from thesurface of paths (other than crops);
  • Authorising new gates or stiles (where there was previously not one in place);
  • Providing materials for landowners to maintain stiles or gates on a public right of way;
  • Maintaining bridges over natural water courses and farm ditches which were in place when the path was first recorded;
  • Providing signposts where public rights of way leave metalled roads;
  • Providing waymarkers;
  • Securing the removal of path obstructions;
  • Meeting the requirements of the Disability Discrimination Act 1995 (DDA).

Reporting public right of way problems

Amey Herefordshire and Herefordshire Council are grateful to receive any information from the public regarding any defects or problems encountered by path users.

When reporting defects please supply us with as much information as possible such as:

  • Nature of problem (eg. Missing stile cross-step, broken hand rail, footpath obstructed by crop, field ploughed, obstructed gate etc.)
  • Location of defect - an OS map grid reference would be most useful, obviously we will need to know the general area of the defect (parish or nearest town) but other more specific information such as nearest farm or property will assist us.

All defects reported will be dealt with in accordance with Herefordshire Council's Inspection and Maintenance Policy (download the policy below). There are only limited resources available, a system of priorities has been put in place in order to maximise resources.
