Kinetic Automotive Maintenance Program Agreement - Basic Package

AND

KINETIC AUTO SERVICE LTD.,

(herein “Kinetic”)

Kinetic shall provide the following goods and services in respect of its Kinetic Automotive Maintenance Program (herein “Program”):

  1. Included Yearly Maintenance:

1) Up to four conventional or three synthetic oil changes

2) Two comprehensive safety/reliability inspections

3) Winter and summer tire changeovers

4) One of each, cabin air filter and engine air filter

5) One set of wiper blades

6) One wheel alignment

  1. Extra Services and Inclusions:

1) Roadside Assistance which can be used in all of Canada and the United States

2) 1 year/20,000 warranty on all repairs

3) Co-ordination of all SGI claims as long as the package policy is purchased through our service provider.

4) Co-ordination of recall repairs (we must be authorized at the dealership to act on your behalf)

5) Priority booking for emergencies (what constitutes as an emergency will be determined by Kinetic Auto Service)

  1. Program and Service Requirements:

1) Pre-Authorized debit payments required, therefore, banking information must be provided.

2) Minimum 1 year contract which can be cancelled within 30 days of the contract end date.

- Contract will be auto-renewed, unless otherwise notified, on the day after the contract end date.

- Two year contract available which will be locked in at the same price for the extended two year period.

3) The monthly payment for this contract will be $______for ______months starting on the ______day of the ______month, ______.

Transfer of Vehicle Ownership:

Service agreement can be transferred to anyone who is purchasing a client’s vehicle as long as the new owner signs a contract with Kinetic.

NSF payments:

Service fees will be charged on any costs incurred to Kinetic due to NSF payments. The service fee shall be $50 plus all bank charges. The Client authorizes Kinetic to place commercial liens upon the vehicle in the event of non- payment for goods and services provided under the Program.

Cancellation Fee:

A cancellation fee will be charged if the service agreement is cancelled before the agreed upon date. The fee will be $50 plus the difference between the amount that has been paid and the price of the services that had been performed while on the Program.

Use of Personal Information:

Kinetic will only use personal information to contact a client regarding the maintenance and repair of their vehicle, to provide a client with education about the services Kinetic is performing or to co-ordinate any repairs necessary at a different location. This may include acting on a client’s behalf at the dealership, insurance provider or SGI.

Authorization and Agreement to be bound by the Program:

The Client hereby agrees to the terms and conditions above and has had an opportunity to review this agreement and to seek any advice necessary before executing the agreement. The Client authorizes the Program to operate as intended in respect of their vehicle and authorizes all repairs to be done as required by the Program including the purchase and charge of the required materials. The Client agrees that Kinetic is not responsible for loss or damage to the vehicle or contents in the case of fire or theft or causes beyond its control. The Client hereby grants Kinetic and its employees and agents permission to operate the vehicle on the streets and highways or elsewhere for the purpose of testing and or inspection. The Client acknowledges the indebtedness for the monetary amount and length of time of this Program as listed in section D (6). The Client understands that a Lien will be put on their vehicle if it has had major repairs close to the beginning of the contract and pre-authorized payments stop or are withdrawn. The Client acknowledges that they are responsible for all goods and services in respect of their vehicle under the Program.

If a required repair is not included in this Program: Kinetic will provide the client with a written estimate. Kinetic will not charge an amount that is more than the estimate that was approved. Occasionally a client will be asked to authorize a revised estimate due to unforeseen circumstances encountered during a procedure. If a client waived their right to an estimate, we must have authorization of the maximum amount that is approved for the repairs. Kinetic may not charge more than the maximum amount authorized. In either case, we may not charge for any work that was not authorized.

THE CUSTOMER AGREES TO PAY THE AMOUNTS AGREED TO UNDER THIS PROGRAM TO KINETIC IN A TIMELY FASHION IN ACCORDANCE WITH THE MONTLY PRE-AUTHORIZED PAYMENT FORM.
