(b)Thefollowingactivitiesshallbeexemptfromtheprohibitioninsubsection(a):
(1)Openburningoperationsforthepurposeofrangeorpasturemanagementandconservationreserve program(CRP)burningactivitiesmeetingthe requirementsinK.A.R.28-19-648(a)(1)through(a)(4);and
(2)openburningoperationslistedinK.A.R.28-19-647(a)(1)and (a)(2).
(c)Apersonmayobtainapprovalbythesecretarytoconductanopenburningoperationthatisnot otherwiseexemptiftheconditionsandrequirementsofthefollowingaremet:
(1)K.A.R.28-19-647(b)(1)through(b)(3);and
(2)K.A.R.28-19-647(d) and(e).
(d)Openburningoperationsthatshallrequireapprovalbythesecretaryandaredeemednecessaryandin thepublicinterestshallincludetheopenburningoperationslistedinK.A.R.28-19-647(c)(1)through(c)(3).
(e)InJohnson,Wyandotte,andSedgwickcounties,theopenburningoperationslistedinK.A.R.28-19-
647(c)(4)and(c)(5)shallrequireapprovalbythelocalauthority.

28-19-647.Exceptionstoprohibitiononopenburning.(a)Thefollowingopenburningoperations shallbeexemptfromtheprohibitionontheopenburningof anymaterialsimposedbyK.A.R.28-19-645:
(1)openburningcarriedoutonaresidentialpremisecontainingfiveorlessdwellingunitsandincidental tothenormalhabitationofthedwellingunits,unlessprohibitedbyanylocalauthoritywithjurisdictionoverthe premises;
(2)openburningforcookingorceremonialpurposes,onpublicorprivatelandsregularlyusedfor recreationalpurposes;
(3)openburningforthepurposeofcrop,range,pasture,wildlifeorwatershedmanagementin accordancewithK.A.R.28-19-648;or
(4)openburningapprovedbythedepartmentpursuanttoparagraph(b).
(b)Apersonmayobtainanapprovalfromthedepartmenttoconductanopenburningoperationthatis nototherwiseexemptfromtheprohibitionimposedbyK.A.R.28-19-645if it isdemonstratedthattheopen burningis:
(1)necessary,whichinthecaseofburningforthepurposeofdisposalof anymaterials,shallmeanthat thereisnootherpracticalmeansofdisposal;
(2)inthepublicinterest;and
(3)isnotprohibitedbyanylocalgovernmentorlocalfire authority.
(c)Openburningoperationsforwhichanapprovalisrequiredbutwhicharedeemedtobenecessaryand inthepublicinterestincludethefollowing:
(1)theuseofsafetyflaresfordisposalofflammablegases;
(2)fires relatedtothetrainingof governmentorindustrialpersonnelinfirefightingprocedures; (3)firessetforthe removalofdangerousorhazardousliquidmaterials;
(4)openburningoftreesandbrushfromnonagriculturallandclearingoperations;and
(5)openburningof cleanwoodwastefromconstructionprojectscarriedoutattheconstructionsite. (d)Eachpersonseekinganapprovaltoconductanopenburningoperationpursuanttothisregulation
shallsubmitawrittenrequesttothedepartmentcontainingthefollowinginformation:
(1)thelocationoftheproposedopenburningand thename,addressandtelephonenumberoftheperson responsiblefortheopenburning;
(2)adescriptionoftheopenburningincluding:
(A)theestimatedamountandnatureofmaterialto beburned;
(B)theproposedfrequency,durationandscheduleoftheburning; (C)thesizeoftheareatowhichtheburningwillbeconfined;
(D)themethodofignitingthematerial;
(E)thelocationof anypublicroadwayswithin1,000feetoftheproposedburn; (F)thenumberofoccupieddwellingswithin1,000feetoftheproposedburn;and
(G)evidencethattheopenburninghasbeenapprovedbyappropriatefirecontrolauthorityhaving jurisdictionoverthearea;and
(3)thereasonwhytheproposedopenburningisnecessaryandinthepublicinterestiftheactivityisnot listedinsubsection(c)of thisregulation.
(e)Eachopenburningoperationforwhichthedepartmentissuesanapprovalpursuanttoparagraph
(b)shallbesubjecttothe followingconditions,exceptasprovidedinparagraph(f):
(1)Thepersonconductingtheburningshallstockpilethematerialtobeburned,dryit totheextent possiblebeforeit isburned,andassurethatit isfreeofmatterthatwillinhibitgoodcombustion.
(2)Apersonshallnotburnheavysmoke-producingmaterialsincludingheavyoils,tires,andtarpaper. (3)Apersonshallnotinitiateburningduringthenighttime,whichforthepurposesofthisregulationis
definedastheperiodfromtwohoursbeforesunsetuntilonehouraftersunrise.Apersonshallnotaddmaterial toafireaftertwohoursbeforesunset.
(4)Apersonshallnotburnduringinclementorfoggyconditionsoronverycloudydays,whichare definedasdayswithmorethan0.7cloudcoverandwithaceilingoflessthan2,000feet.
(5)Apersonshallnotburnduringperiodswhensurfacewindspeedislessthan5mphormorethan15
mph.
(6)Apersonshallnotburnwithin1,000feetofanyoccupieddwelling,unlesstheoccupantofthat
dwellinghasbeennotifiedbeforetheburn.
(7)Apersonshallnotconductaburnthatcreatesatrafficorothersafetyhazard.Ifburningistotake placewithin1,000feetofaroadway,thepersonconductingtheburnshallnotifythehighwaypatrol,sheriff’s office,orotherappropriatestateorlocaltrafficauthoritybeforetheburningbegins.If burningistotakeplace withinonemileofanairport,thepersonconductingtheburnshallnotifytheairportauthoritybeforethe burningbegins.
(8)Thepersonconductingtheburnshallinsurethattheburningissuperviseduntilthefireis extinguished.
(9)Thedepartmentmayrevokeanyapprovalupon30daysnotice.
(10)Apersonshallconductanopenburningoperationundersuchadditionalconditionsasthe departmentmaydeemnecessarytopreventemissionswhich:
(A)maybeinjurioustohumanhealth,animalorplantlife,orproperty;or
(B)mayunreasonablyinterferewiththeenjoymentoflifeorproperty.
(f)Thedepartmentmayissueanapprovalfor anopenburningoperationthatdoesnotmeetthe conditionssetforthinsubsection(e)uponacleardemonstrationthattheproposedburning:
(1)isnecessaryandinthepublicinterest;
(2)canbeconductedina mannerthatwillnotresultinemissionswhich: (A)maybeinjurioustohumanhealth,animalorplantlifeorproperty;or (B)mayunreasonablyinterferewiththeenjoymentoflifeorproperty;and

28-19-648.Agriculturalopenburning.
(a)Openburningofvegetationsuchasgrass,woodyspecies,cropresidue,andotherdryplant growth
forthepurposeofcrop,range,pasture,wildlifeor watershedmanagementshallbeexemptfromtheprohibition ontheopenburningofanymaterialsimposedbyK.A.R.28-19-645,providedthatthefollowingconditionsare met:
(1)thepersonconductingtheburnshallnotifythelocalfirecontrolauthoritywithjurisdictionoverthe areabeforetheburningbegins,unlessthe appropriatelocal governingbodyhasestablishedapolicythat notificationisnotrequired;
(2)apersonshallnotconductaburnthatcreatesatrafficsafetyhazard.If conditionsexistthatmay resultinsmokeblowingtowardapublicroadway,thepersonconductingtheburnshall giveadequate notificationtothehighwaypatrol,sheriff’sofficeorotherappropriatestateorlocaltrafficcontrolauthorities beforeburning;
(3)apersonshallnotconductaburnthatcreatesanairportsafetyhazard.If smokemayaffectvisibility at anairport,thepersonconductingtheburnshallgiveadequatenotificationtotheappropriateairport authoritiesbeforeburning;and
(4)thepersonconductingtheburnshallinsurethattheburningissuperviseduntilthefireis extinguished.
(b)Nothinginthisregulationshallrestricttheauthorityoflocaljurisdictionstoadoptmorerestrictive ordinancesor resolutionsgoverningagriculturalopenburningoperations.(AuthorizedbyK.S.A.1994Supp.
