MEMORANDUM OF AGREEMENT
(MOA)
BETWEEN
INSETA
AND
THE HIGHER EDUCATION AND TRAINING/FURTHER EDUCATION AND TRAINING INSTITUTION
FOR
THE DESIGN, MONITORING AND EVALUATION OF THE INSETA INTERNSHIP PROGRAMME IN THE WORKPLACE.
PART 1:
1.DEFINITIONS
Unless the contrary is clearly indicated, the following words or phrases, when used in this Agreement, shall mean the following:
2.1“Agreement” shall mean this written document together with all written appendices, annexes or amendments attached to it from time to time;
2.2“Notice” shall mean a written document;
2.3“Parties” shall mean both INSETA, and the FET/HET Institution
2.4“Internship” shall mean a program for learners who require work experience in order to gain professional registration/ a program for an unemployed graduate who needs work experience.
2.5“Work-based experience” shall mean a program for learners who require experience in order to complete a diploma or degree (eg. “Technikon” or technical college type courses) that require the person to have a certain amount of work experience in order to achieve the qualification.
2.6Qualification shall mean a planned combination of learning outcomes with a defined purpose(s) that is intended to provide qualifying learners with applied competence and a basis for further learning.
2. INTRODUCTION:
INSETA and the HET/FET Institution have agreed to set up a Joint Implementation Plan, through this Memorandum of Agreement, in order to facilitate the placing, monitoring and evaluation of suitable final years HET and FET students and/or HET and FET graduates from the following certificate, diploma or degree programmes, in internships in companies in the insurance Sector:
Management (General)
Financial Management
Actuarial (Specifically Black; and if possible Female)
Information Technology (Broad-based to specific systems engineering design)
Call Centre operatives
Call Centre management
Selling and Marketing
Business Administration.
The PROFILE of the Interns shall require them to be:
- An unemployed South African citizen; or
- Hold dual citizenship, of which one must be South African
- Be a permanent resident
- Fluent in English
- Numerate at, at least a FETC level (can include Bookkeeping, Accounting,
- Computer studies, mathematics)
- Have a desire to work in the Financial Services Industry
- Have written endorsement of completion of the theoretical component of their qualification from their academic institution
- Demonstrate exceptional potential and academic performance.
- Comply with selection criteria which include ability and potential, academic merit and the likelihood that the candidate will successfully complete their programme.
- Prepared to undergo an interview.
- Present a portfolio of work, as required by the Learnerships and ETQA Division.
- The monitoring, reviewing and all assessment activities involved will be funded by INSETA, with the process being managed by the INSETA Programme Office, according to the parameters set out under paragraph 4.
- INTERNSHIPS TO BE ACCOMMODATED UNDER THIS AGREEMENT
3.1INSETA will determine the scarce and critical skills areas, and concomitant qualifications, and INTERNSHIP PROFILES, for which FET/HET graduates shall be sought to be accommodated as INTERNS, under this Agreement. Such Skills areas, qualifications and profiles are as listed in point 2 above, and are included in this agreement.
3.2They may be amended from time-to-time with the agreement of both parties, based on research conducted through the Sector Skills Plan (SSP), and other relevant research.
3.3INSETA will inform the institutions of the changing profiles and qualifications of graduates, for the INTERNSHIP PROGRAMME, based on SSP research. Such notification will be given 6 months before the expiry date of the current INTERNSHIP PROFILE. Upon receipt from INSETA of a written motivation based on sector needs, such profiles will be included, and will form part of the Agreement.
3.4Should no notification be forthcoming, the status of the current signed MOA will be maintained.
- FUNDING OF THE WORK UNDER THE AGREEMENT
4.1The work will be funded by the INSETA in the amount of R1000 for 12 months or R500 for 6 months. This amounts to R250 per quarterly report per learner.
4.2INSETA undertakes to make pro-rata payments to the FET/HET institution on the following basis:
4.2.1An initial payment of 50% of the agreed fee to be paid over to the FET/HET institution, within 20 (twenty) days of the signing of this Agreement, and on receipt of the following:
- A signed MoA
- The availability of the agreed number of suitable graduates from the agreed fields of study for placing in the INSETA INTERNSHIP PROGRAMME
- The design of the skills and tasks to be covered during the Internship, in the workplace
- A documented evaluation process, and template
- An agreement with the relevant company that the FET/HET provider will monitor/evaluate the work-based learning in the Internship
4.2.2A second payment of 50% to be paid over to the FET/HET institution upon completion of the INTERNSHIP programme, in the case of a 6-month Internship period within 20 (twenty) days of receipt and approval by INSETA of the closure report from the FET/HET institution
4.2.3A second payment of 50 % to be paid over to the FET/HET institution, in the case of a 1-year internship period, within 20 (twenty) days of receipt and approval by INSETA of the 6 monthsreport from the FET/HET institution.
- MANAGEMENT OF THE MOA
5.1AnInternship Management Committee will be established where appropriate to ensure the overall success of the INSETA internship programme.
5.2The Committee will comprise the following persons, who will be tasked to monitor progress with the MOA and the implementation of the JIP:

5.2.2Company
5.2.3(INSETA)
5.2.4(IPO)
5.2The Internship Management Committee will meet, when constitutedat the start of the programme, The first meeting will be held within one month of the signing of the MOA, and thereafter if and when necessary during the implementation phase of the Internship programme. The Committee will also meet at the end of the Internship programme, in a closure meeting. The FET/HET provider will make the necessary arrangements for the meetings and supply the necessary logistical and administrative support.
5.3All liaison and administration with regard to the MOA will be managed by the INSETA Programme Office (IPO)
5.4The Director:/Dean of Faculty/other nominated FET/HET institutional representative shall be the Liaison person at the Institution.
- REPORTING ON THE AGREEMENT
6.1The FET/HET Provider will issue INSETA with progress reports on the implementation of the Internshipdependent on the duration of the Internship but no less than every three months. The first report will be due as agreed between INSETA and the FET /HET institution but not later than the end of the third month after the signing of this agreement. Such reports will contain both a narrative and a financial report.
6.2Upon completion of the project a comprehensive final Report of the project, in hard and electronic format will be submitted to INSETA.
- RESPONSIBILITIES OF THE PARTIES TO THIS AGREEMENT
7.1FET/HET PROVIDER OF EDUCATION AND TRAINING
The FET/HET provider shall be responsible for:
7.1.1Identifying suitable graduates from identified fields of study, with the correct profiles, to participate in the Internship programme
7.1.2Implementing all aspects of the Agreement
7.1.3Notifying INSETA of all issues needing clarification or intervention. This notification will be done no later than 1 week after the issue has arisen.
7.1.4If necessary, appointing consultants to carry out the work required to curriculum, work-based tasks sheets, monitoring, and evaluation of the Interns in the workplace.
7.1.5Managing the work of consultants to ensure deadlines are met and quality maintained.
7.1.6Making the necessary logistics arrangements for any meetings that are required for the Internship Management Committee
7.1.7Performing the required administrative tasks to enable the reports to be considered by the INSETA for project progress purposes
7.1.8Compiling the prescribed reports specified under the Agreement.
7.1.9Assisting INSETA in making contact with suitable employers for placement of Interns.
7.2INSETA
INSETA shall be responsible for:
7.2.1Funding the work to be done under the Agreement
7.2.2Identifying the profiles of Interns, the graduate profiles, and the qualifications/fields of study from which graduates are required, and supplying the list to the FET/HET provider
7.2.3Supplying the FET/HET provider with motivated requests for the review and re-development of task sheets, work-place evaluation sheets and other relevant documents.
7.2.4Supplying the provider with the names of people to serve on the INTERNSHIP Management Committee.
7.2.5Supplying the FET/HET institutions with a list of the names of companies willing to take Interns, and the relevant fields of study from which they should be drawn.
7.2.6Managing the general administration of the MOA and related activities through the INSETA Programme Office.
- GENERAL TERMS AND CONDITIONS
8.1This Agreement commences on the date of signature by both INSETA and the FET/HET provider.
8.2The Agreement terminates on …………………………., or upon discharge by the FET/HET provider of the obligations in terms of this Agreement, or whichever occurs first.
8.3INSETA may terminate this Agreement at any time in part or in full without prejudice to any rights to which it is entitled in terms of the law or by virtue of this Agreement if the FET/HET provider:
8.3.1postpones the internship without written notice to and approval of INSETA;
8.3.2cancels the internship without written notice to and approval of INSETA
8.3.3deviates substantially from the aims and objectives of the internship without consulting INSETA;
8.3.4fails to meet any of its obligations arising from this Agreement within the period stipulated in this Agreement;
8.3.5breaches any terms of this Agreement and fails to rectify the breach within 14 days of receipt of INSETA’s written notice.
8.4The Provider may terminate this Agreement at any time in part or in full without prejudice to any rights to which it is entitled in terms of the law or by virtue of this Agreement if INSETA:
8.4.1fails to pay over the funds as stipulated in the agreement
8.4.2fails to supply members to serve on the JIP management Committee
8.4.3fails to supply the Provider with the list of Internship qualifications, Internship profiles to be administered under the agreement
8.4.4fails to identify companies willing to take Interns from relevant fields of study, identified by INSETA, for the purpose of this Agreement.
8.5In the case of termination of the Agreement, INSETA may, without further notice to the FTE/HET provider:
8.5.1discontinue any further payment;
8.5.2reclaim in full or in part any amount already paid;
8.5.3charge compound interest as prescribed in the Prescribed Rate of Interest Act, 1975 (Act No. 55 of 1975), calculated from the date of cancellation or final date of performance of this Agreement and may recover from the Provider any legal costs incurred by INSETA, including collection commission on an attorney and client scale.
8.6 In the event that INSETA or the provider is unable to perform any of their respective obligations in terms of this Agreement, and such non-performance results from an act of God or other events or occurrences beyond the reasonable control of the Parties concerned, such failure shall not constitute a breach of this Agreement.
8.7If a difference or dispute should arise at any time, which the Parties are unable to resolve amicably, then such difference or dispute shall be submitted to arbitration.
Except as may be expressly provided for otherwise in this Agreement, arbitration proceedings shall be conducted in accordance with the Arbitration Laws of the Republic of South Africa.
The arbitration proceedings shall be held on an informal basis, it being the intention that a decision should be reached as expeditiously and as inexpensively as possible, subject only to the due observance of the principles of justice.
Either Party shall be entitled, by giving written notice to the other, to require that a difference or dispute be submitted to arbitration in terms of this clause.
Any decision and/or award made by the arbitrator shall –
8.7.1be final and binding on the Parties;
8.7.2shall be carried into effect by the Parties;
8.7.3may be made an order of court by a Party only if the other Party fails to heed the terms of the award; and
8.7.4may include an Order directing the unsuccessful Party to pay the cost of the arbitrator and the expenses incurred by the successful Party.
- LIABILITIES
Should any party claim from the other the liability will not exceed the agreed amount of payment that would have been disbursed on agreement.
- QUALITY OF WORK
The following criteria pertain to the quality of the Internship Implementation and other documents and processes, to be administered under this Agreement:
9.1INTERNS are to meet all INSETA’s requirements as laid down, inter alia, in the Profiles for Interns, Fields of study from which graduates are drawn, Job Profiles for Interns, Supply of Interns, and Implementation guidelines for Internships.
9.2INSETA must be satisfied that the monitoring and evaluation of Interns in the Internship programme will meet its needs in terms of the requirements of the identified target learner-group.

Notice of change of physical address shall be sent by pre-paid registered post to the other Party and it shall automatically be regarded as the new domicilium replacing the address under 10 above.
