This is a proposed policy draft of JFAB (Admission of Non-Resident Tuition Students) based upon recommended updates from Drummond Woodsum. The proposed JFAB would replace the current JFAB (included below). The new JFAB also addresses admission and tuition of non-resident students of employees. The criteria for acceptance of non-resident students of employees is the same as other non-resident students, but the tuition charge is different, as the board has already approved that employees would pay tuition minus the state subsidy amount. If the new JFAB is adopted, the board would need to rescind policy JFABA.

TUITION/ADMISSION OF NON-RESIDENT STUDENTS

I.The Superintendent of Schools is authorized to admit non-resident students, when space is available, under any one of the following conditions:

A.Upon payment of the tuition fee allowed by state law under agreements with other school units.

B.Upon agreement to pay the tuition fee allowed by state law after receipt of a written request.

C.Instances where a resident of the Town of Brunswick is in the process of obtaining legal guardianship. Such approval shall be contingent upon transfer of legal guardianship, and persons enrolling students under this section may be subject to tuition charges in the event that legal guardianship is not obtained.

D.As a foreign exchange student assigned under the auspices of a recognized foreign exchange program. In such cases, no tuition shall be assessed.

E.In accordance with state statutes relating to the assignment of students for school purposes.

II.Official birth certificates must be presented by all students entering the schools for the first time.

III.Additional requirements relating to physical examinations and immunizations are outlined in policies JLCA and JLCB.

ENROLLMENT OF NON-RESIDENT CHILDREN

OF SCHOOL EMPLOYEES

Children of non-resident, full-time staff members may request to attend the Brunswick School Department's schools on a tuition basis (set as the yearly tuition rate minus the state subsidy per child). The Superintendent (or designee) will make a determination on initial enrollment, considering, but not limited to, the following factors: space availability, the need for hiring additional staff, the cost of any needed additional services, and the disciplinary record of the student. If approved, parents will be responsible for transportation. Admission will be reviewed on a yearly basis or more frequently if conditions warrant an earlier review.

ADMISSION OF NON-RESIDENT TUITION STUDENTS

The Brunswick School Departmentadopts this policy for accepting tuition students atany Brunswick school facility. This policy applies to non-resident students who may be tuitioned by other school departments that do not maintain a contract for services with the Brunswick School Department. This policy also contains provisions that address the admission of foreign national students in J-1 visa status and F-1 visa status.

  1. The Brunswick School Departmentshall accept non-resident tuition students by application only. Application shall be made to the Superintendent or his designee. Admission may be denied to any non-resident student who is currently subject to an expulsion or suspension or is the subject of an expulsion or suspension proceeding. Admission decisions are made by the Superintendent of Schools or his/her designee in consultation with the Principal or other administrators as appropriate. The decision of the Superintendent shall be final.
  1. Admission of non-resident tuition students shall be based on the availability of space within an existing program or class that the student would be attending. The availability of space in a particular program or classshall be determined by the Principal or his/her designee in consultation with the program or class teachers, and may include consideration of the overall number of students in that program or class, any applicable state or local mandates for program or class size, the particular demands on teacher time presented by students currently scheduled for that program or class, and a reasonable estimate of the number of new students from within the District who may join that program or class during the school year in question. The Brunswick School Departmentshall not create new programs or classrooms to serve non-resident tuition students.
  1. All requirements for entry into Brunswick School programs that apply to resident students (such as age, health examinations and immunization requirements) also apply to tuition students.
  1. Tuition students are expected to meet the same academic, extracurricular and behavioral standards and are subject to the same disciplinary procedures as resident students.
  1. The Superintendent may revoke the admission of a non-resident tuition student if the Superintendent determines that the student cannot obtain an appropriate education in an existing program or class at the school. In the case of students with disabilities, the Superintendent’s decision shall be made in consultation with the student’s Pupil Evaluation Team (PET) and all applicable laws.
  1. Admission of a tuition student shall be valid for one school year only. If the student wishes to continue for additional years, the student and sending school unit must reapply before the start of each new school year.
  1. The Brunswick School Departmentwill charge an annual tuition at the maximum rate permitted by state law, 20-A M.R.S.A. § 5805, including amounts for special education in accordance with state special education regulations. Tuition for children of non-resident Brunswick School Department staff members shall be charged at the annual tuition rate minus the state subsidy per child. Tuition amounts for the upcoming semester shall be paid in full by the first day of each schoolsemester, unless guaranteed by a sending school administrative unit. Should a sending school unit fail to pay tuition as due, the Superintendent shall notify the Commissioner of the Department of Education for payment, as set forth in 20-A M.R.S.A. § 5810(2). Failure by a parent to pay tuition as due shallbe grounds for revoking the admission of the non-resident tuition student.
  1. The Brunswick School Departmentshall not furnish transportation for non-resident tuition students except where the student can otherwise access normal bus runs offered by the school.
  2. The Brunswick School Department is authorized to accept foreign national students in valid J-1 visa status. The student must be sponsored by a recognized foreign exchange program that has been certified by the U.S. Department of State. If the Superintendent has approved the acceptance of a J-1 visa student, the student shall be considered a resident of the Brunswick School Department, as set forth in 20-A M.R.S.A. § 5205 (9). J-1 visa students shall not be charged tuition. The decision to accept a J-1 visa student shall be made by the Superintendent or his/her designee.
  3. The Brunswick School Department is authorized to accept foreign national students in valid F-1 visa status. F-1 visa students shall be sponsored by the Brunswick School Department under the auspices of its federally certified Student and Exchange Visitor Program. Tuition shall be assessed to each F-1 visa student in an amount determined by the School Department in accordance with federal regulations set forth at 8 CFR § 214.2(f)(1)(i)(D). The foreign student shall reimburse the School Department for the full, unsubsidized per capita cost of his or her education during the student’s attendance in the form of tuition payment(s).
