Note:

  • The completion of this form will serve as an application to register for the programme as indicated and once the application is accepted, the form will also serve as the registration form and the registration contract.
  • Applicants, who wish to apply for Recognition of Prior Learning (RPL) of a module or modules in the qualification, must complete Annexure A (pg. 7-8) of this form. Candidates must ensure that he/she is familiar with the terms and conditions that apply to the RPL application as described in the programme prospectus.
  • The onus remains on the programme participant to ensure that he/she is registered for the correct programme and modules as set out in the programme prospectus, and the he/she has familiarize himself/herself with the registration requirements, rules and regulations contained therein.
  • Accordingly, the signatory to this form warrant that he/she understands the content of the prospectus and accepts that on acceptance of the application and registration for the programme, this document is a binding contract between the programme participant and Adapt IT (Pty) Ltd.

Note:

  • Registration for a program as indicated above is only required once at the beginning of a 3-trimeser period, i.e. one academic year, which is the maximum duration provided to complete the programme. If you have not completed the program in this period, you will have to re-register for the programme.
  • Please consult with a consultant or the programme administrators at Adapt IT to plan your enrollment for the module/s that you are enrolling for and for which you will be attending the lectures presented via WebEx (Table 2.1 below), as well as for the module/s that you are applying for RPL (Table 2.2 below). The enrollment plan should be aligned with your workload at your institution and the time required attending the lectures and the completion of the formative assessments (assignments) that forms part of your Portfolio of Evidence (PoE).
  • The summative assessment (examination) for each module will be scheduled at the end of the trimester which you have indicated below that you will be participating in the particular module.
  • Should you need to change your initial enrollment plan and intend to do a module in another trimester as indicated below, you must inform the programme administrator in writing (by e-mail) at least 2 weeks before the commencement of that trimester.

Section 6: Contract and Conditions of Registration

The signatory/ies to this registration contract and all documents forming part hereof (“the contract”) agree/s to the following terms and conditions of registration with Adapt IT(Pty) Limited (“The Company”):

1. Financial

1.1The signatory/ies acknowledge/s that he/she/they will be jointly and severally liable to The Company for payment in full of all course fees and other charges as detailed in Programme Prospectus – Annexure A, subject to the terms and conditions set out below, and that, having regard to all their financial obligations, they have sufficient funds to make all the payments in terms of this contract on due date.

1.2 By signing these terms and conditions the signatory/ies is/are committing to make payment of the full course fee amount referred to in 1.1 above; any failure by the participant to attend lectures will not reduce liability for payment of the full contract amount.

1.3 The registration fee is non-refundable.

1.4 The signatory/ies will be responsible for the cost of transport and any specialised consumables used during the module /programme including but not limited to: specialised stationery, printing of assignments, toolkits or any other material whether in printed or electronic format.

1.5 This contract may not be cancelled unless –

1.5.1 the participant fails to satisfy the entrance requirements (in which event the signatory/ies shall be entitled to a refund of the course fees, or any portion thereof paid to date);

1.5.2 insufficient enrolments are received by The Company to justify, at The Company’s sole discretion which will not be unreasonably exercised, the running of the programme for which the participant has enrolled (in which event the signatory shall be entitled to a refund of the course fee, or any portion thereof paid to date); or

1.5.3 the participant has been expelled following due process (in which event the fees will not be refunded and the signatory/ies will remain liable for the balance of fees).

1.6 If a participant is suspended from attendance of any lecture, module, programme, etc. for any reason whatsoever, but not expelled, following due process, the fees payable by the signatory/ies will not be adjusted or reduced at all as a consequence of non-attendance, and the signatory/ies will remain liable for payment of the full course fee.

1.7 Participants who wish to cancel their registration must submit a written and signed notice of intention to discontinue attendance to the programme manager; provided, however, that the signatory/ies remain/s liable for the balance of the fees, as specified in the Programme Prospectus.

1.8 Should any monies due by the participant or the signatory/ies under this contract not be paid on the due date, the participant may be excluded from (i) attending further lectures, and/or (ii) access to the examinations and all other facilities, and/or (iii) graduation, until such time as all monies due have been paid in full. The Company may withhold results of any assessments conducted until such time as all fees have been settled in full. This is without prejudice to any other rights of The Company. Exclusion, as set out above, will not relieve the signatory/ies of any obligation to pay the course fee amount, or any balance then outstanding.

1.9 The signatory/ies will remain liable for all expenses incurred by The Company as a result of any breach on his/her/their part of this contract and acknowledge/s that this may include legal, tracing and collection costs.

1.10 If any payment due under this contract remains unpaid for a period of thirty (30) days after the due date thereof, the entire outstanding balance will immediately become due and payable. In addition thereto, interest on the outstanding amount due will be charged at the maximum rate permitted by law, from time to time, as determined under the National Credit Act (Act 34 of 2005).

1.11 The finance department of The Company must be informed immediately, in writing, should the signatory/ies hereto change address, or should the participant change his/her module/s or programme/s, subsequent to submission of the registration documentation.

2. Indemnity

2.1 The Company or any of its representatives shall not be liable for any loss or damage, howsoever sustained, whilst the participant is enrolled at The Company. The signatory/ies hereby indemnify/s The Company, against all and any claims made by any person whatsoever in respect of any damage arising out of any grossly negligent or intentional acts or omissions by the participant.

2.2 The signatory/ies accept/s liability for damage to The Company’s property, injury to or death of any participant, or loss or damage to personal effects and possessions as a result of the actions of the participant whilst the participant is on or off The Company’s premises, and he/she/they hereby indemnify The Company, accordingly.

  2. The signatory/ies warrant/s that the information submitted on the application form, if any, and registration contract is both true and correct.

3.2 The Company reserves the right to cancel and/or amend certification, programme syllabi, commencement and termination dates and timetables without prior notice, which discretion shall be exercised reasonably, to accommodate changing circumstances.

3.3 The Company, at its sole discretion, which discretion shall be exercised reasonably, may combine classes of similar academic level and content or cancel tuition in any programme or module advertised and offered on an insufficient demand basis; provided that the contract amount shall be adjusted accordingly.

3.4 The onus remains on the participant to ensure that he/she is registered for the correct module/s and programme. The participant must familiarise him/herself with the registration requirements, subject selection criteria, rules, regulations and prospectus, as well as any rules regarding the maximum completion time for the chosen qualification. Accordingly, the signatory/ies and, more specifically, the participant, warrant/s that he/she/they has/have investigated the programme concerned to his/her/their satisfaction prior to the signing of this contract and further absolve The Company, from any liability resulting from any incorrect registrations, enrolment or assessment.

3.5 The signatory/ies acknowledge/s that he/she/they is/are aware of whom the conferring body is for the programme of study for which the participant registers as well as any particular information in relation to accreditation and registration of this programme of study.

3.6 The participant will be provided with a copy of The Company’s rules/regulations and participant code of conduct within seven (7) days of commencement of classes. The participant has twenty-one (21) days within which to read and acquaint him/herself with the content thereof, and to familiarise him/herself with their application to the modules/programme for which the participant is registering. Thereafter, the participant will be regarded as having read and understood such rules, regulations and code of conduct, and as having undertaken to abide by and comply with the terms thereof, as they may be amended from time to time.

3.7 By signature hereof the signatory/ies consent/s to The Company utilising electronic methods of communication (including SMS and email) in matters of an academic and financial nature, or relating to scheduling of lectures, campus activities or similar issues. The Company may, from time to time, send the participant and/or the signatory/ies marketing material by electronic methods of communication.

3.8 The Company may, from time to time, introduce rules and regulations deemed necessary relating to module attendance, participant conduct and other related matters.

3.9 Academic integrity is taken very seriously. Any violations of academic integrity by the participant including, but not limited to, cheating or plagiarism, will result in disciplinary action being instituted against the participant, which could result in expulsion from the programme.

3.10 In the event of an act of God, war, insurrection, industrial unrest, natural disasters or other such events that may cause the temporary cessation of tuition or classes, The Company shall use its best endeavours to resume lectures as soon as is practically possible; however, no guarantees can be made in this regard.

3.11 The participant and/or the signatory/ies understand/s, accept/s and consent/s to The Company collecting personally identifiable information about the participant or signatory/ies (including consumer credit information where necessary) in connection with this contract. The participant and the signatory/ies acknowledge/s that The Company has the right to view and obtain the participant’s results from external examining bodies. In addition, the participant and the signatory/ies consent to The Company providing information, including personal information and/or participant’s results, to the participant’s employer or any other third party academic partner; and/or providing confirmation of graduation or non-graduation to external bodies; and/or verifying participants’ results upon request from external bodies. Such information will only be provided insofar as may be required for the purposes of this agreement and for the studies being undertaken by the participant.

3.12 The participant and signatory/ies cede and assign to The Company all rights, title and interest in and to any intellectual property that may be created in the course of any study or research project that the participant undertakes or may undertake at The Company or that the participant develops or may develop with the assistance of The Company’s equipment and/or facilities. The participant and the signatory/ies, furthermore, acknowledge that and consent to the outcomes of any work undertaken by the participant being used by The Company in marketing and promotion activities.

3.13 No guarantees, promises or representations of any nature are made by The Company pertaining to the participant’s enrolment for programme/s selected by the participant with regard to the participant’s success or failure or otherwise.

3.14 Registration is conditional pending the submission by the applicant and successful assessment by the programme personnel of the documents required to complete The Company’s administrative process of registration. Failure to submit any of the required documentation will result in the participant being unable to graduate.

3.15 The signatory/ies choose(s) as his/her/their address for service and delivery of legal notices and communications (domicilium citandi et executandi) in connection with this contract the address/es set out in sections 2 and 3 of this contract.
