All bookings are subject to the following terms and conditions. Please read them carefully.

BOOKING:

Before booking, please read the trip notes thoroughly to make sure that you have fully understood the demands, both physical and psychological, that may be made upon you by the trip.

A non-refundable deposit is required at the time of booking (i.e. on completion and return of your booking form). The deposit is to cover bookings and other non-refundable expenses incurred by us. Details of the cost of the trip, the deposit amount and of all other payment details are set out below and/or in the trip notes.

Your place is confirmed (and your contract made with us, Mountain Logistics Limited) on receipt by us of your deposit and receipt and acceptance by us of your booking form.

If there are differences between the trip notes and these T&Cs, the trip notes will prevail as they have been tailored to the specific trip you are booking.

CANCELLATION BY YOU:

If it becomes necessary for you to cancel your trip, please inform us immediately in writing by email or letter. Cancellation will take effect when we receive your written confirmation. If you cancel more than 42 days before departure, solely your deposit will be forfeited. If you cancel between 42 and 29 days prior to departure, 50% of the trip cost (i.e. including your 10% deposit) will be forfeited. If you cancel between 28 days and 15 days prior to departure, 75% of the trip cost (i.e. including your 10% deposit) will be forfeited. If you cancel 14 days or less prior to departure, 100% of the trip cost will be forfeited. These cancellation charges go to paying, amongst other things, outside guides who have been contracted in, hotel, refuge or airline deposits, staff wages, set up costs etc.

We strongly recommend that you take out cancellation insurance which may cover you should you be unable to make the trip.

CANCELLATION BY US:

We will not cancel your booking unless a) we are forced to do so by circumstances beyond our control, such as war and civil/political unrest, or other force majeure events; b) the minimum number of people needed to operate the trip has not been reached; c) you do not pay us for the trip in full in accordance with the payment terms set out above; d) your insurance cover is, in our opinion, inadequate; or e) based upon our experience, we do not feel the trip is suitable for you - whether as a result of your fitness or a medical condition or otherwise. In the case of the minimum number of people not being met, we will not cancel your trip less than 30 days prior to the date of departure even if the minimum number of people has not been reached. If we cancel your booking, we will offer you another trip or a full refund.

PAYMENT:

(a)Payment amount and timing

  • A non-refundable deposit of 10% of the trip cost is payable on booking, unless otherwise stated in the trip notes.
  • The balance, being 90% of the trip cost, is payable 8 weeks before the start date of the trip unless otherwise stated in the trip notes.

Please do not book flights, buy visas or incur other costs before we have confirmed that the trip is running; we will not be responsible for reimbursing you for any resulting costs if you do so.

FLEXIBILITY:

It is part of our aim to organise trips, which encourage or allow you to push yourself to try new experiences or to go to wild and unexplored parts of the world. As a result, at times we may be in remote wilderness areas with poor communications. Standards of accommodation, transport, safety, hygiene, medical facilities and other infrastructure may at times be lower than you normally expect.In addition, natural disasters, political disturbances, mechanical breakdown, poor acclimatisation, client fitness and accidents - either our own or other peoples’ - can all conspire to delay or interfere with our trip. Weather, particularly in the mountains, can be unpredictable and can impede progress or even halt a trip altogether.

All outdoor pursuits and adventure activities carry an element of risk and danger to a greater or lesser extent, and whilst we make every effort to minimise these, you must be aware of this and accept that it is impossible to reduce the risk to zero. Motorcycling, Ski Mountaineering and Touring, Snow Shoeing and Winter Mountaineering carry greater risks, including those of avalanche, hypothermia and frostbite.

We will try our best to ensure the smooth running of your trip and to keep to the original itinerary, but you must be aware of the above, accept the resulting risks and possible delays and take all appropriate precautions yourselves.

We are unable to give refunds for unused services including as a result of unavoidable changes to the itinerary or if the tour leader excludes you from all or part of a trip (due to lack of fitness, for one of the reasons set out below or otherwise). If reasonably practicable though, we may, in our discretion, help you to make changes required to your travel arrangements and/or accommodation in such a case.

INSURANCE:

It is mandatory that you are properly insured for the full duration of the trip. Your insurance must cover, at least, personal injury, medical expenses, death, mountain rescue and repatriation, helicopter or aircraft rescue, loss of luggage or equipment and cancellation or curtailment. You should also ensure that there are no exclusion clauses limiting protection for the type of activities or the countries included in your trip. Any claims concerning matters for which you are insured must be directed to your insurers.

MEDICAL DETAILS:

Warthog expeditions require differing standards of fitness – please ensure your fitness level is appropriate to the level indicated in the trip notes. If you have any existing medical condition(s), requiring daily/ongoing medication or are carrying an injury that could in any way affect your ability to undertake the trip or influence the normal progression of the trip, please give details where requested in the booking form so that we can assist you in considering the suitability of the trip and/or making the booking. We may require a medical statement from your Doctor confirming that you are fit to participate.

TOUR LEADER AUTHORITY:

Signing the booking form signifies that, while on your trip, you agree to abide by the authority of the trip leader/guide who represents Warthog MTN. If, in his/her opinion, your health or behavior on the trip is detrimental to your own safety, comfort or enjoyment or that of others, you may be excluded from part of the trip or the entire trip. If you are excluded from the trip or part of it, we will cease to have any responsibility for you and no refund will be made.

ESSENTIAL EQUIPMENT:

Certain items of equipment are essential for safe Mountaineering/ Trekking/ Climbing/ Motor biking/ Biking/ Skiing/ Canyoning. Essential equipment for the particular trip you are joining is marked in the trip notes.

Lack of these essential items may result in the guide or leader refusing to allow you to fully participate in the trip. As noted in the booking form and/or trip notes, we may be able to help you to hire certain items of equipment for your trip.

PASSPORTS, VACCINATIONS & VISAS:

It is your responsibility to be in possession of a valid passport and any visa/permits, vaccinations and preventative medication as may be required for the duration of the trip. Information about these is included in the trip notes, but this is for information only and should not be relied upon; you should make your own enquiries about what is required.

JOINING THE TOUR LOCALLY:

Our responsibility commences at the meeting point and time specified in your trip notes. If you fail to arrive at the meeting point at the appointed time, we will not be responsible for any additional expenses incurred by you in meeting up with the group thereafter. If the group arrival at the local meeting point is delayed (from London or elsewhere), the trip will be deemed to begin on the arrival of the group.

PHOTOGRAPHY, ETC & TESTIMONIALS:
We would like to have the ability to use photographs, film and video of you taken on any of our trips. Accordingly, unless you tell us in advance of your trip that you do not agree to this, we will have the right to use such photographs and footage, without charge, for promotional or marketing purposes including brochures, newsletters, slides, video shows or on the internet.

Any written feedback supplied to us may also be used for promotional purposes as detailed above.

RESPONSIBILITIES:

When you book with us, you accept responsibility for, and indemnify us for, loss or damage to personal property, personal injury (or death) and any claim arising from your actions or your own inadequately serviced or maintained equipment. You will also be responsible for meeting any claims subsequently made against us and all costs incurred by us as a result of your actions. You should ensure you have appropriate travel insurance to protect you if this situation arises.

We will not be responsible for any injury/illness, death, loss, damage, expense or claim resulting from force majeure or from your acts and/or omissions or those of any member of your party or a third party not connected with provision by us of your trip and which were unforeseeable or unavoidable. We also cannot accept responsibility for services which are not part of your trip detailed in the trip notes, including services or facilities which a supplier provides for you which we have not agreed to arrange for you.

This contract and any claim or dispute arising from or related to this contract will be governed by English law and the courts of England and Wales shall have exclusive jurisdiction over any claim arising out of it.
