Summary

PLAYA CLARA:

  Of the three Federal Clean Water Act (CWA) violations just issued by the United States Environmental Protection Agency (EPA), Playa Clara was the only one that has a construction permit from the Puerto Rico permitting Authority (ARPE). In fact, Playa Clara has two permits for same project:

  One of the ARPE permit documents for the dense segregation correctly indicates the current zoning as RO-25C, one residential “R” house per “25” cuerdas, with additional special zoning “O” for restrictions to minimize ecological fragmentation and to protect coastal waters from erosion of the unstable volcanic soils whose best public use is designated by “C” for Conservation. The Culebra Segment of the Coastal Zone Management Plan of Puerto Rico relies on this zoning as one of the only management measures in place to protect coastal waters from clearing related runoff, now destroying the once beautiful waters of Culebra, and the protected marine species that depend on them.

  Posted on the project site was "06PO2-CET00-12058 “Desarollo de 18 Solares 27 Dec 2009 Fernando Chalas #4514" The information this sign did not reflect the ARPE paperwork for same number which indicates a “17 Solares.”

  At no time were public hearings announced or held for this project.

  Rivers of mud from the project resulted in two citizen law suits, for damage to personal property from folks who live down land of the project. The impact was high velocity runoff of muddy waters. CORALations was copied one of the two case numbers: Case Number: NSCI 200700374 /Superior Court Fajardo, (tort case.)

We understand that this case was settled for damages, however, no promised mitigation has yet been completed on the part of the project (defendants) to protect down-land property owners.

  Photo journals were kept online, with information about formal complaints filed an observed impacts. This album software tracks the dates the photos were taken and allows anyone from Government managers, collaborating NGOs, Press, Academia and private citizens to view or download high resolution photos, photo documents and video directly from the site.
