IQBAL 12(b)(6) MOTION ASSIGNMENT
Basics:
• Skim the Iqbal complaint.
• Read the Sample Google-YouTube 12(b)(6) motion, to obtain formatting.
• Skim the Ashcroft 12(b) Motion.
(You do not have to read P’s Opposition or D’s Reply—but doing so is as real as it gets.)
• Draft your 12(b)(6) motion attacking the Iqbal complaint.
• Include the court name, judge, hearing date/time & Department in which this motion will be
heard. You can use fake information for these matters, but be sure to include these always
critical details! (Has something to do with notice & opportunity :-)
Further detail:
• This assignment will result in up to 5-points being added to the final raw point score on your
final exam. For example, if you earn 45 raw points on the final, and do a great job with this
extra credit assignment, you will end up with a total of 50 raw points on the final. (The
midterm is worth 10%, and the final is worth 90% of your course grade.)
• I expect at least 3 pages, and no more than 5 pages (standard 1” margins & 12-point font). This
is not designed to be an exhaustive doctrinal project—but rather a learn by doing mission,
much like you’ll be doing in the near future.
• You may work on this project with others. However, what you submit must be your own work
product. You will thus insert the following paragraph (as you did with your midterm) at the
outset of your submission—with your student exam number (not name):
I, student exam number _____, hereby submit this take-home motion, in accordance with: (1) the TJSL Honor Code; and (2) the Professor’s related instructions.
• Two situations (other than not doing this assignment) will result in no credit:
(1) not including the above paragraph in your motion; and/or
(2) using your name or any other detail that tends to compromise your anonymity.
