AN ORDINANCE REZONING APPROXIMATELY 30.4 ACREs LOCATED IN COUNCIL DISTRICT 5ON LOSCO ROAD East of skylark drive (R.E. NO(s). 156443-0000, 156441-0010, 156442-0010, 156442-0650, 156442-0030, 156441-0250 and 156441-0100), AS DESCRIBED HEREIN, OWNED BYkurt b kalfs, yi ju c kalfs, herman lindsey and shirley lindsey, and parkside lakes development, llc, FROM PUD (PLANNED UNIT DEVELOPMENT) and AGR (agriculture) DISTRICT TO PUD (PLANNED UNIT DEVELOPMENT) DISTRICT, AS DEFINED AND CLASSIFIED UNDER THE ZONING CODE, to permit single family dwellings, AS DESCRIBED IN THE APPROVED WRITTEN DESCRIPTION AND SITE PLAN FOR THE parkside lakes PUD; pud rezoning subject to conditions; PROVIDING AN EFFECTIVE DATE.
WHEREAS, Kurt B. Kalfs and Yi Ju C. Kalfs and Herman W. Lindsey and Shirley L. Lindsey and Parkside Lakes Development, LLC, the owner(s) of approximately 30.4acres located in Council District 5on Hood Road, east of Skylark Drive (R.E. No(s).156443-0000, 156441-0010, 156442-0010, 156442-0650, 156442-0030, 156441-0250 and 156441-0100), and as more particularly described in Exhibit 1,attached hereto (Subject Property), have applied for a rezoning and reclassification of that property fromPUD (Planned Unit Development) and AGR (Agricultural) Districts to PUD (Planned Unit Development) District, as described in Section 1 below; and
WHEREAS, the Planning Commission has considered the application and has rendered an advisory opinion; and
WHEREAS, the Land Use and Zoning Committee, after due notice and public hearing, has made its recommendation to the Council; and
WHEREAS, the Council finds that such rezoning is: (1) consistent with the 2030 Comprehensive Plan; (2) furthers the goals, objectives and policies of the 2030 Comprehensive Plan; and (3) is not in conflict with any portion of the City’s land use regulations; and
WHEREAS, the Council finds the proposed rezoning does not adversely affect the orderly development of the City as embodied in the Zoning Code; will not adversely affect the health and safety of residents in the area; will not be detrimental to the natural environment or to the use or development of the adjacent properties in the general neighborhood; and will accomplish the objectives and meet the standards of Section 656.340 (Planned Unit Development) of the Zoning Code; now therefore
BE IT ORDAINED by the Council of the City of Jacksonville:
Section 1.Property Rezoned.The Subject Property is hereby rezoned and reclassified fromPUD (Planned Unit Development) District and AGR (Agriculture) District to PUD (Planned Unit Development) District, as shown and described in the approved site plan datedMay20, 2013, and written description datedJune 3, 2013, for the Parkside Lakes PUD. The PUD district for the Subject Property shall generally permit single family dwellings, as more specifically shown and described in the approved site plan and written description, both attached hereto as Exhibit 2.
Section 2.Rezoning Approved Subject to Conditions. This rezoning is approved subject to the following conditions:
(a)The Subject Property shall be developed in accordance with the Development Services Division Memorandum, dated June 24, 2013, or as otherwise approved by the Planning and Development Department.
(b)Any direct pedestrian connection from the subject property to Losco Regional Park shall be subject to the review and approval of the Parks and Recreation Department.
Section 3.Owner and Description.The Subject Property is owned by Kurt B. Kalfs and Yi Ju C. Kalfs and Herman W. Lindsey and Shirley L. Lindsey and Parkside Lakes Development, LLC, and is legally described in Exhibit 1. The agent is Hawley Smith, 1 San Jose Place, Suite 7, Jacksonville, FL, 32257, 904-268-9990.
Section 4.Effective Date. The adoption of this ordinance shall be deemed to constitute a quasi-judicial action of the City Council and shall become effective upon signature by the Council President and the Council Secretary.
