AN ORDINANCE APPROPRIATING $188,500 ($78,647 FROM RINGHAVER PARK IMPROVEMENT, $25,000 FROM CONTRIBUTIONS FROM PRIVATE SOURCES AND $84,853 FROM COUNCIL DISTRICT 14 AUTUMN BOND FUNDS); AMENDING THE 2012-2016 FIVE-YEAR CAPITAL IMPROVEMENT PROGRAM APPROVED BY ORDINANCE 2011-406-E TO AUTHORIZE THE PROJECT ENTITLED “RINGHAVER PARK SOCCER FIELD LIGHTS”; INVOKING THE EXCEPTION OF 126.107(G), ORDINANCE CODE, TO AWARD THE INSTALLATION OF SPORTS LIGHTING AT RINGHAVER PARK TO M GAY CONSTRUCTORS, INC. AND MUSCO SPORTS LIGHTING, LLC; APPROVING, AND AUTHORIZING THE MAYOR, OR HIS DESIGNEE, AND CORPORATION SECRETARY TO EXECUTE AND DELIVER A LICENSE AGREEMENT BETWEEN THE CITY OF JACKSONVILLE AND WESTSIDE SOCCER ASSOCIATION FOR USE OF A PORTION OF RINGHAVER PARK MALLISON LOCATED AT 5198 118TH STREET IN COUNCIL DISTRICT 14, FOR THE PURPOSE OF ALLOWING WESTSIDE SOCCER TO OFFER QUALITY SOCCER PROGRAMMING TO JACKSONVILLE YOUTH; INVOKING THE EXCEPTION OF SEC. 126.107(G) TO AWARD THE USE AND PROGRAMMING TO WESTSIDE SOCCER, INC.; PROVIDING AN EFFECTIVE DATE.

BE IT ORDAINED by the Council of the City of Jacksonville:

Section 1. Appropriation. For the 2011-2012 fiscal year, within the City’s budget, there are hereby appropriated the indicated sum(s) from the account(s) listed in subsection (a) to the account(s) listed in subsection (b):

Section 2. Purpose. The purpose of the appropriation in Section 1 is to provide funding for soccer fields lights at Ringhaver Park. Westside Soccer, Inc. is contributing $25,000 towards the purchase and installment of the lights, and has agreed to pay for 25% of the electric bill annually for the lighting of the soccer fields. The scope of the project is more fully described on Exhibit 1, attached hereto.

Section 3. CIP. Ordinance 2011-406-E, being the 2012-2016 Five-Year Capital Improvement Program for the City and certain of its independent agencies, is hereby amended to authorize the project entitled “Ringhaver Park Soccer Field Lights”. This project is more fully described in the Project Information Sheet, attached hereto as Exhibit 2 and incorporated herein by this reference. This ordinance shall constitute an amendment to Ordinance 2011-406-E. In all other respects, the Five-Year Capital Improvement Program approved by Ordinance 2011-406-E shall continue in full force and effect.

Section 4. Invoking the exception to Sec. 126.107(g), Ordinance Code. The City is hereby authorized to procure the management and oversight services of M Gay Constructors, Inc. and Musco Sports Lighting, LLC to provide the installation of sports lighting at Ringhaver Park located at 5198 118th St., Jacksonville, FL 32244. Pursuant to Section 126.107(g), Ordinance Code, such procurement is exempted from competitive solicitation. With the exception of the foregoing, all other provisions of Chapter 126, Ordinance Code, shall remain in full force and effect.

Section 5. License Agreement for Ringhaver Park and Community Center Approved. There is hereby approved, and the Mayor, or his designee, and Corporation Secretary are hereby authorized to execute and deliver, that certain License Agreement between the City of Jacksonville and Westside Soccer for use of Ringhaver Park, in substantially the same form attached hereto as Exhibit 3. Said License Agreement is for a term of ten (10) years commencing on June 5, 2012, and terminating on June 4, 2022, which may be extended for three (3) additional three (3) year periods under the same terms and conditions as are set forth therein.

Section 6. Invoking the exception to Sec. 126.107(g), Ordinance Code. The City is hereby authorized to procure the use and programming and oversight services of Westside Soccer, Inc. to provide the use and programming at Ringhaver Park located at 5198 118th St., Jacksonville, FL 32244. Pursuant to Section 126.107(g), Ordinance Code, such procurement is exempted from competitive solicitation. With the exception of the foregoing, all other provisions of Chapter 126, Ordinance Code, shall remain in full force and effect.

Section 7. Effective Date. This ordinance shall become effective upon signature by the Mayor or upon becoming effective without the Mayor’s signature.
