AN ORDINANCE DETERMINING TO RESCHEDULE THE SECOND REGULAR MEETING OF COUNCIL IN DECEMBER, 2013 FROM TUESDAY, DECEMBER 24, 2013 TO MONDAY, DECEMBER 23, 2013

WHEREAS, Article V, Section 5.04 of the Charter of the City of Olmsted Falls requires that Council shall hold regular meetings at least twice during each calendar month; and

WHEREAS, Section 220.01 of the Codified Ordinances of the City of Olmsted Falls provides that regular meetings of Council shall be held on the second and fourth Tuesdays of each month; and

WHEREAS, the fourth Tuesday of December, 2013 falls on Christmas Eve; and

WHEREAS, Council has determined to reschedule the second meeting in Decemberso as not to conflict with Christmas travel plans. Now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OLMSTED FALLS, COUNTY OF CUYAHOGA, STATE OF OHIO, THAT:

SECTION 1. The regular meeting of Olmsted Falls City Council scheduled for Tuesday, December 24, 2013 be rescheduled to Monday, December 23 at 7:30 p.m. in the Council Chambers.

SECTION 2. Adoption of this Ordinance shall not serve to amend any provision of either the Charter of the City of Olmsted Falls or the Codified Ordinances of the City of Olmsted Falls, except to the extent as stated above.

SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.

SECTION 4. This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety of the City of Olmsted Falls and its residents for the reason that the date and time must be published in advance of the meeting. Therefore, this Ordinance shall take effect immediately upon the affirmative vote of not less than five (5) members elected to Council, and signature by the Mayor, or otherwise at the earliest time allowed by law.
